SUBJECT: The Willows Stormwater Improvements Project
MEETING: September 3, 2013
BACKGROUND. The Willows Stormwater Improvement Project brings the existing undersized
and problematic storm sewer system for the Willows subdivision Lip to current City standards as
a requirement for City ownership and maintenance. The project involves installation of 2
stormwate,r treatment devices, pond slope stabilization and grading, installation of 2 skimmer
structures in the pond, installation of about 1,250 linear feet of storm main, 6 manholes, an outlet
into the Stillwater River, and other related appurtenances and construction activities. Bids were
received and opened on August 27, 2013 at 2:00 PM, Four responsive bids were received from
local contractors.
The bid results follow in order of price:

Shellinger Construction Co., Inc. $238,350.00
NCC Neumann Construction Co. $242,592.00
LHC, Inc. $297,065.00
Sandry Construction $348,789.00
The engineer's estimate was $346,600 and was developed from bid prices of projects of similar
size and scope.
References for Shellinger Construction were checked and they were determined to be a
responsible contractor, successfully completing prcjects of similar scope and magnitude,
STAFF RECOMMENDATIONS: Award the bid for The Willows Stormwater Improvements
Project to Shellinger Construction Co. Inc. in the amount of $238,350.00.
ACTION REQUESTED: Motion to award The Willows Stormwater Improvements Project to
Shellinger Construction Co., Inc. in the amount of $238,350.00.
FISCAL EFFECTS: The project will be funded by a combination of a Special Improvement
District, a State Revolving Fund Loan, Storm Sewer Impact Fees, and the Storm Sewer Fund
(953-Willows Stormwater Improvement Project).
TERNATIVES: As suggested and approved by the City Council.

This letter will acknowledge receipt on August 28, 2013 of the request to award bid and
supporting documents for the above -referenced project.
You may consider this letter authorization to award the construction contract to Schellinger
Construction Co. Inc., the low responsive, responsible bidder. The total amount of the contract
is $238,350.00 of which $238,350.00 is eligible for SRF loan assistance.
We also approve Addendum No. 1 for the above -referenced project and have enclosed an
approved copy for your records.
This authorization to award is provided contingent upon the adoption of a bond resolution that
signifies the borrower is eligible and authorized to borrow loan funds from the Montana State
Revolving Fund.
Construction may now begin at your convenience. Please furnish this office with one copy of the
authorization to the contractor to begin construction and one copy of the executed contract
documents as described in the enclosed Department of Environmental Quality (DEQ) Policy
Statement No. 9 dated September 18, 2002.
The borrower must forward copies of subcontracts and purchase agreements/orders, which the
project contractor(s) and the architectural and engineering firm(s) execute with Minority and
Women Business Enterprise (MBEIWBE) firms, to the undersigned project officer. If additional
MBEIWBE subcontractors or purchases are made after work has begun, this information is
required and should be forwarded to the project officer within 15 days of their execution_ The
approved MBEMIBE participation for this project is listed below:

The contract documents require the contractors maintain adequate fire and extended coverage
(where approp(ate), worker's compensation, public liability and property damage, and "all risk"
builders risk insurance (including blasting where appropriate) during the construction phase of

the contract. Please send the workers` compensation and insurance certificates and
performance and payment bonds. Also assure that contractor's wage determinations are
properly posted: at the construction site.
We will be monitoring construction progress and are planning to attend the preconstruction
conference. Please advise us as soon as the preconstruction conference is scheduled.

This policy statement is intended to ensure that all necessary executed contract documents for
State Revolving Fund (SRF) loan projects are submitted to this office.
Discussion
A review of contract documents is made to ensure compliance with approved project
specifications, and the applicable laws and regulations. The documents are to be submitted for
inclusion in the approved specifications following award of the contract and prior to the initiation
of construction. One (1) copy of the following executed documents should be submitted to the
Technical and Financial Assistance Bureau, WPCSRF Program Staff:
Executed Agreement
2. Notice to Proceed
3. Workers Compensation and Insurance Certificate including:
a) Fire and extended coverage (if appropriate)
b) Public liability and property damage
c) All risk builders (including blasting where appropriate)
4. Performance and Payment Bonds
Further, copies of subcontracts and purchase agreements/orders signed with Minority and Women
