ORDINANCE NO. 966
AN ORDINANCE TO ADOPT A FORMULA TO BE USED IN DETERMINING THE ASSESS-
MENT OF LOTS WITHIN SPECIAL IMPROVEMENT DISTRICT #330:
WHEREAS, the City Council has received a petition to create a
Special Improvement District #330 from the Kalispell Parking Com-
mission; and
WHEREAS, the Kalispell Parking Commission has held numerous pub-
lic meetings with owners of property in said proposed District and
other -persons interested in the creation of such a District and the
formula_to be>used -in determining the assessment of each lot or par-
cel within such a district; and, in the course of such meetings and
hearings those items.set forth in Sec. #7-12-4161 through #7-12-4165,
M.C.A., were considered as well as other items and considerations
raised by such persons as would be effected thereby; and
WHEREAS, as a result, the Kalispell Parking Commission has pro-
posed a formula for such assessment that appears to be equitable and
just; and
WHEREAS, the City Council has held a public hearing, after due
notice, on said proposed formula of assessment and heard all persons
concerned who made their wishes known, present any objections they
may have to said formula or any part thereof and point out any errors
or inequities with their reasons for amendment or correction, and the
Council having made any changes or corrections therein deemed neces-
sary, right and proper;
NOW, THEREFORE, BE IT ORDAINED AS FOLLOWS:
The Council does hereby adopt the following formula to be used
in determining the assessment of each lot or parcel within Special
Improvement District #330 in accord with Resolution #3310:
1) Twenty percent (20%) of the total amount of said
District Assessment will be raised by assessment
based on the percentage which the square foot area
of each lot within the district bears to the total
square footage area of the entire district, less
streets, alleys, avenues and public places stated
as follows:
Area of a lot or parcel 20% of total
Area of all lots or parcels X amount Of
assessment
Any lot, parcel or portion thereof within the dis-
trict used exclusively for off-street parking or
being vacant with no other use thereon, shall be
exempt from this portion of the total assessment
and, further, such a lot or parcel or portion there-
of shall not be included in the total area of the
district for this portion of the assessment.
2) Twenty percent (20%) of the total amount of said
District Assessment will be raised by assessment
based on a distance base determined as follows:
The center of the intersection of Main and Second
Street is the centroid point; distance factors
range from 2000 to 1000 with the closest lot or
parcel to the centroid point assigned a 2000 factor
and the farthest lot or parcel from such point as-
signed a 1000 factor and intervening lots or par-
cels assigned a factor in proper proportion to the
distance from the centroid point.

Each lot or parcel will be assessed in the propor-
tion which its distance factor bears to the total
of such factors of all lots or parcels in the Dis-
trict. This assessment is stated as follows:

3) Fifty percent (50%)-of the total amount of the Dis-
trict Assessment will be raised by assessment based
on the proportion of Net Demand for parking spaces
which each lot or parcel of land within the Dis-
trict bears to the total present deficiency of the
total demands for the entire district. The Demand
in each case shall be calculated according to the
provisions of Chapter 4, Appendix "B" Kalispell
City Code, also known as the "City of Kalispell Zon-
ing Ordinance". Each lot or parcel will be given
credit for parking spaces presently provided to meet
the demand for said lot, but no credit beyond a zero -
demand will be allowed.
This assessment is stated as follows:

' 41 Ten percent (10,1) of the total amount of the Dis-
trict Assessment will be raised by assessment
based on the general tax assessed value of a lot
or parcel and the proportion thereof to the total
general tax assessed valuation of all real property
within the District as of July 1, 1980, in the
records of Flathead County and the Department of
Revenue.
This assessment is set forth as follows:
