Ordinance 950 - All City Zoning Extended to June 15, 1980ORDINANCE NO. 950
AN ORDINANCE TO AMEND ORDINANCE NO. 941 TO EXTEND TO JUNE 15, 1980,
THE TIME WHEN ALL PROPERTY WITHIN THE CITY OF KALISPELL SHALL BE
ZONED IN ACCORD WITH THE "CITY OF KALISPELL ZONING ORDINANCE" (ORDI-
NANCE NO. 885, AS AMENDED); TO DECLARE AN EMERGENCY AND TO PROVIDE
FOR THE IMMEDIATE EFFECT OF THIS ORDINANCE FOR NINETY DAYS, AND TO
WAIVE THE SECOND READING THEREOF.
WHEREAS, the City Council has found that, because of the com-
plexity involved in rezoning various areas of the City in accord
with the "City of Kalispell Zoning Ordinance" (adopted by Ordinance
No. 885 and amended), additional time appears necessary before all
property within the City as of January 1, 1978, can be properly re-
viewed by the Zoning Commission, and considered adequately by the
City Council before acting on specific parcels of property, and pro-
per zone district classifications assigned thereto; and
WHEREAS, the Zoning Commission and the City Council should be
allowed sufficient time to properly consider and finish such re-
zoning review;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF KALISPELL, MONTANA, AS FOLLOWS:
SECTION I. Section 6.17(c), Ordinance No. 941 which amended Ordinance
No. 930 which amended Ordinance No. 915 which amended Ordinance No.
902 which amended Ordinance No. 885 (City of Kalispell Zoning Or-
dinance) is hereby amended to read as follows:
(c) Until a resolution is passed and adopted making this
ordinance applicable to a property within the city, the
zoning ordinance of the City of Kalispell in force when this
ordinance becomes effective shall continue to apply to said
property within the city. All property within the city shall
be assigned a zone district classification in accord with this
ordinance before June 15, 1980.
SECTION II. All other provisions of Ordinance No. 885 (City of
Kalispell Zoning Ordinance) and Ordinance No. 902, shall remain in
full force and effect.
SECTION III. An emergency is hereby declared to exist for the pur-
pose of this ordinance. Said emergency is occasioned by the length
of time it has taken and will take for the City Council to adequately
and thoroughly study, consider and apply the City of Kalispell Zoning
Ordinance to certain portions of the City that were within the City
on January 1, 1978. The Council finds that in certain of such areas
it will not be possible to apply same prior to March 15, 1980, the
date set therefor by Ordinance No. 941. Further, the statutory time
schedule for adoption of an amending ordinance in relation to such
time limit for applying the City of Kalispell Zoning Ordinance there-
to cannot now be followed.
The City Council does further waive the second reading of this
ordinance as allowed by Section 7-5-104, MCA.
SECTION IV. This ordinance is effective immediately upon passage and
approval and shall remain in effect for no more than ninety days.
