AN ORDINANCE TO AMEND SECTION 17-79, KALISPELL CITY CODE TO PRO-
VIDE THAT THE OWNER OR OPERATOR OF ANY VEHICLE FOUND PARKED ILLEGALLY
AND MOVED BY AUTHORITY OF THE POLICE SHALL PAY THE COSTS OF SUCH
MOVING THEREOF AND PERMITTING THE SAID COSTS TO BE ASSESSED BY
THE CITY JUDGE; AND, TO PROVIDE THAT THE REGISTERED OWNER OF ANY
VEHICLE FOUND TO BE STANDING, STOPPING OR PARKING IN VIOLATION
OF LAWS OF THE CITY RELATED THERETO, SHALL BE PRIMA FACIE RESPON-
SIBLE FOR SUCH VIOLATION; TO PROVIDE AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL,
MONTANA, AS FOLLOWS:
SECTION 1. Section 17-79 of the Kalispell City Code is amended to
hereafter read:

Any motor vehicle parked or left in violation of this
article or any other provision of this chapter or other
ordinance of the city regulating the stopping, standing or
parking of vehicles may be moved by or under the authority
of any police officer who shall certify the cost thereof
to the city judge. Such cost may be added to any fine
assessed for the violation involved; the owner or operator
of such vehicle shall pay all costs of the moving and
storage of said vehicle.
Such motor vehicle may be moved to any parking lot
provided by the police, or to a local garage for outdoor
storage.
If any vehicle is found to have been stopping, standing
or parking in violation of any ordinance of the city or law
of the state of Montana over which the city court has
jurisdiction, the registered owner thereof shall be prima
facie responsible for such violation and subject to the
penalty therefor; provided, however, that unless said
registered owner shall be proven to have personally wil-
fully committed said violation by corroborating independent
evidence, the penalty therefor shall be limited to a fine
of less than.$500.00 only..
SECTION 2. This ordinance is effective thirty days after final
passage and adoption hereof.
