ORDINANCE N0. 917
AN ORDINANCE TO AMEND THE KALISPELL CITY CODES REGARDING ALCOHOLIC BEVERAGES TO
CHANGE THE AGE OF PERSONS PERMITTED TO POSSESS ALCOHOLIC BEVERAGES OR TO WHOM
ALCOHOLIC BEVERAGES MAY BE SOLD, GIVEN OR FURNISHED FROM EIGHTEEN TO NINETEEN
YEARS OF AGE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA, AS
FOLLOWS:
SECTION 1. Section 3-5 of the Kalispell City Code is hereby amended to hereafter
read as follows:
"Sec. 3-5. Possession by persons under nineteen.
It shall be unlawful for any person who shall not have reached.
the age of nineteen years to have in his possession beer or liquor;
proved, however, a person does not commit this offense when in the
course of his employment it is necessary to possess alcoholic
beverages."
SECTION 2. Section 3-5.1 of the Kalispell City Code is hereby amended to hereafter
read as follows:
"Sec. 3-5.1. Sale or gift to persons under nineteen prohibited.
It shall be unlawful for any person, firm or corporation to sell,
give away, furnish or dispose of intoxicating liquor to any person or
persons under the age of nineteen years.
Intoxicating liquor shall be construed to include alcohol, brandy,
whiskey, rum, gin, beer, ale, porter and wine or any liquid containing
more than one-half of one percent alcohol by volume."
!�XTION 3. Section 3-9 of the Kalispell City Code is hereby amended to here-
after read as follows:
"Sec. 3-9. Sales, etc., to certain Rersons prohibited.
No licensee as regulated by this article shall sell, deliver or give
away, or cause to permit to be sold, delivered or given away any liquor to:
1. Any person under the age of nineteen years.
2. Any intoxicated person or persons actually, apparently or obviously
intoxicated.
3. A habitual drunkard.
4. An interdicted person as defined by the laws of the state,"
SECTION 4. Section 3-20 of the Kalispell City Code is hereby amended to hereafter
read as follows:

It shall be unlawful for any licensed beer retailer or club to sell
or dispose of beer to any person under the age of nineteen years, or to
any person who shall appear to be in an intoxicated or disorderly condi-
tion or to allow or permit any intoxicated or disorderly person to come
into or remain in or about the premises of any retailer."

SECTION 5. This ordinance is effective thirty days from the passage and adoption
thereof.
