ORDINANCE. NO. 902
AN ORDINANCE TO AMEND ORDINANCE 885 (CITY OF KALISPELL ZONING
ORDINANCE) TO EXTEND TO APRIL 1, 1979 WHEN ALL PROPERTY WITHIN
THE CITY SHALL BE ZONED IN ACCORD THEREWITH; TO EXPAND THE
PERMITTED USES AND REORGANIZE THE IiEIGHT, BULK AND GENERAL
REQUIREMENTS IN A NEIGHBORHOOD PROFESSIONAL BUSINESS B-2
DISTRICT; AND TO AMEND RECOMMENDATION CONCERNING THE STATED
INTENT AND AMEND THE BULK AND DIMENSIONAL REQUIREMENTS IN A
COMMUNITY BUSINESS B-4 ZONE; TO AMEND THE FENCE REQUIREMENTS
FOR RESIDENTIAL DISTRICTS; TO PROVIDE AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL,
MONTANA, AS FOLLOWS:
SECTION 1. Section 3.02(m) of Ordinance 885 (City of Kalispell
Zoning Ordinance) is hereby amended to read as follows:
(m) Neighborhood Professional Business (B-2). A business
district intended to accomodate professional offices
where they are compatible with residential uses and
where it is not deemed desirable to permit a more
intensive business activity of a retail nature. These
office structures need not be commercial in appearance;
they should be architecturally harmonious with the
adjacent residential structures. Such a district
should serve as a buffer between residential areas and
other commercial districts or be closely associated
with primary intensity generators.
SECTION 2. Section 3.02(o) of Ordinance 885 (City of Kalispell
Zoning Ordinance) is hereby amended to read as follows:
(o) Community Business B-4. A business district to provide
areas for the development of community shopping areas, to
serve the range of a number of neighborhoods to a major
segment of the Planning Area. This district shall be a
business island of not less than five acres and not a strip
development.
SECTION 3. Section 3.04 of Ordinance 885 (City of Kalispell
Zoning Ordinance) is hereby amended to include in the list of
uses in its proper alphabetical place the following:
Office buildings, providing professional and.privat.e
services only, no wholesale or retail sales on
premises. (For exceptions see apothecary shop and
optical supply shop.)
And in the columnar.list of District Classifications after the
above use, an "x" shall be placed under "B-2" only.
SECTION 4. Section 3.05 of Ordinance 885 (City of Kalispell
Zoning Ordinance) is hereby amended to include in Table_3-2
the following data relating to a Neighborhood Professional BusinessB-2)
District.

SECTION 5. Section 3.05 of Ordinance 885 (City of Kalispell
Zoning Ordinance) is hereby amended to amend Table 3-2 thereof
by reflecting the column for "Maximum Fence Limits (feet)" to
read that in zoning districts desiganted "R-1", "R-2", "R-3",
"R-4", "R-5", "RA-111, "RA-2" and "RA-3" the side fence height
limit shall be three (3) feet from the front of the lot to the
minimum side yard setback depth distance and six (6) feet from
that point to the rear lot line.
SECTION 6. Section 6.17(c),Ordinance 885 (City of Kalispell
Zoning Ordinance) is hereby amended to read as follows:
(c)-Until.a resolution is passed and adopted making this
ordinance applicable to a property within the city,
the zoning ordinance of the City of Kalispell in force
when this ordinance becomes effective shall continue to
apply to said property within the city. All property
within the city shall be assigned a zone district clas-
sification in accordance with this ordinance before April
1, 1979.
SECTION 7. All other provisions of Ordinance 885 (City of Kalis-
pell Zoning Ordinance) shall remain in full force and effect.
SECTION 8. The amendments to Ordinance 885 provided for hereby
are effective 30 days after passage and approval hereof.
