ORDINANCE NO. 898
AN ORDINANCE TO AMEND THE SEWER RATE SCHEDULES OF THE. CITY OF
KALISPELL; TO PROVIDE AN EFFECTIVE DATE THEREFOR.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL,
MONTANA, AS FOLLOWS:
SECTION 1. Section 23-6 of the Kalispell City Code as here-
after enacted and amended by Ordinance No. 632, Section 4, Ordin-
ance No. 635, Section 1, Ordinance No. 731, Section 1, Ordinance
No. 794, Section 1, Ordinance No. 817, Section 1, Ordinance No.
821, Section 1, Ordinance No. 841, Section 1, and Ordinance No.
855, Sections 1 and 2, is hereby amended to hereafter provide
as follows:
Section 23-6_ Schedules:
Rates, rentals or charges as provided for in the
preceding section shall be as follows:
(a) Every person using City water within
the City Limits shall be charged a basic rate
of sixty three (63).cents per thousand gallons
of water reflected on the adjusted water bill
rendered to such person for each meter measuring
city water delivered to such person; the
adjusted water bill will not include water
furnished and billed at sprinkling rates, nor
will it include any water identifiable as furn-
ished for fire suppression purposes.
(b) Every person within the City Limits
discharging sewage into the City Sanitary Sewer
originating from a source of water other than
the City water system, shall, at the expense of
such person, install in such water source a meter
approved by the City Superintendent of Public
Works. Such person shall be charged a basic
rate of sixty three (63) cents per thousand
gallons of water which such meter shall reflect
has been furnished the premises. The meter so
installed may be sealed by the City and same shall
be read at such intervals as the City may deem
necessary, but no less frequently than every two
months. Failure of such person to install a
proper meter or refuse to permit an authorized
city employee to inspect and read same at regular
intervals will be grounds for. the City to deny
such person further use of the City sewer or for
the City to estimate the gallonage of water such
person is discharging into the City sanitary sewer
system and charge for same at the above quoted rate.
(c) In the event there are multiple businesses
in the same building served through one water meter
or from the same private water source, the person
responsible for such water service shall pay a
minimum sewer charge based on the minimum water
use that would be chargeable to all such businesses
as if each was on ,a separate water meter.

(d) Any sanitary sewer services provided
to persons outside the City Limits shall pay at
double the rate required for in -city service.
(e) Surcharge rate for special waste. In
addition to the above, a surcharge rate will be
charged for all wastes which are stronger than
normal. Charges for special waste shall be deter-
mined by averaging the analysis of sewage char-
acteristics. Composite.samples shall be taken
by the property owner in a frequency and manner
approved by the City. All necessary control man-
holes, access facilities and composite samplers
shall be furnished and installed by property owners
of a type and in a manner approved by the City.
Access to sampling locations shall be granted to
the City at all times. Analysis of the samples
shall be done by the City.
The special waste charge will be a propor-
tional charge based on monthly operating, main-
tenance, and equipment replacement costs of the
sewer facilities department. This will be deter-
mined monthly based on records of the department.
Surcharge rates shall be charged for five
day biochemical oxygen demand, suspended solids
and organic grease. It will be 33% of amount by
which the special waste characteristics exceed
the normal waste characteristics as determined
by the following formula:

Values for normal wastes shall be determined
by averaging sewage treatment plant records.
(f) There shall be no maximum sewer charge for
any person required to pay a charge for sewer services
hereby.
(g) Minimum sewer rates shall be charged based
on the same minimum gallonage as is established by
the City water rate schedule, except, however, where
a water.service is larger than 5/8", the minimum
gallonage shall be:

SECTION 2. All. other portions of Chapter 23, Kalispell City
Code shall remain in full force and effect. If any portion of
this ordinange is declared illegal by a court of competent
jurisdiction, other portions not in conflict thereof shall not
be effected thereby.

SECTION 3. This ordinance shall be effective on the 1st
day of the next month more than 30 days following passage and
approval hereof.
