ORDINANCE NO. 877
AN ORDINANCE TO AMEND, THE ZONING ORDINANCE OF KALISPELL TO
CLARIFY LOT SIZE AND USE REQUIREMENTS BY BUILDINGS AND
DWELLING UNITS.
BE IT HEREBY RESOLVED that the ordinance known as "The
Zoning Ordinance", being Ordinance No. 672, Revised Ordinances
of 1947,,be and it is hereby amended as follows:
SECTION 1.
Article I, Section 3(1) is amended to read as follows:
"Lot. Land fifty feet or over in frontage, except
business lots in District No. 5, occupied or to be
occupied by one or more buildings and accessory buildings
and uses and including open spaces required under this
ordinance. A tract of land with less than 50 foot frontage
may be a "lot" if the total area of said tract is sufficient
to qualify for erection of a single family dwelling thereon,
and said tract is a portion of a subdivision or a planned
development and strict compliance with 50 foot frontage
is impractical. A lot may be land shown as such on the
records of the County Clerk and Recorder of Flathead County,
Montana. Two adjoining twenty-five foot lots, or two or
more adjoining tracts of land having a total frontage of
fifty feet or more, if so surveyed, shall constitute one
lot for residence purposes."
SECTION 2.
ARTICLE I, Section 3(t) is amended to read as follows:
"(t) Apartment House or Condominium. A building under
one roof but divided into separate dwelling accomodations
of one or more rooms for human occupation; access to any
such apartment being from a hall or corridor for the common
use of two or more tenants, and the building having one or
more entrances from the street or grounds for the use of a
single apartment or for the common use of two or more, or
all tenants of the apartments, each apartment to be complete
in itself with cooking equipment and bathroom and toilet
facilities. For the purposes of this ordinance, a building
classed as a condominium under the Unit Ownership Act of the
State of Montana (Chapter 23 T. 67, R.C.M. 1947) shall be
considered the same as an apartment house and be subject to
the same requirements as an apartment house."
SECTION 3.
ARTICLE I, Section 4 is amended to read as follows:
"Use Regulations and Districts. (a) No more than one
dwelling and necessary accessory buildings shall be erected
upon a lot. More than one multiple family dwelling, apart-
ment house or condominium, or combination thereof, may be
erected on a single lot, provided, however, that: (1) the
density (maximum number of dwelling units to be constructed
on the lot) is in conformity with the master plan of the
City and the building plan of the entire lot development
has been approved by the City Council; (2) that set -back
and open space requirements of this ordinance are complied
with; and (3) that no further subdivision of said lot shall
occur without compliance with existing subdivision regulations
and approval of the City Council.
(b) For the purpose of classifying, regulating and

restricting the location of trades and industries and the
location of buildings designated for specific uses, the City
of Kalispell is hereby divided into six classes of Use Districts:

- Business Residence Districts.

- Industrial Districts.
Said districts shall be shown in the Use District Map on file in
the office of the City Engineer, marked "Use District Map, Zoning
Ordinance", as required by Article I, Section 8 of this Ordinance,
and expressly made a part of this ordinance. The Use Districts
are hereby created in the City of Kalispell, Montana, as the
same are designated on the Use District Map. No building shall
be created, altered or used, and no premises shall be used for
any purpose except in conformity with all the regulations herein
prescribed the Use District in which such buildings or
