Ordinance 860 - Plumbing, Steam Fitting and Heating Systemss ORDINANCE NO. 860 AN ORDINANCE TO AMEND THE KALISPELL CITY CODE :RELATING TO PLUMBING, STEAM FITTING AND HEATING SYSTEMS, TO PROVIDE THAT A CONVICTION FOR VIOLATION THEREOF MAY BE PUNISHED; TO PROVIDE THAT REVOCATION OR SUSPENSION OF PLUMBERS LICENSE BY iMONTANA BOARD OF PLUMBING EXAMINERS IS ALSO A REVOCATION OR SUSPENSION OF SUCH PERSON'S KALISPELL PLUMBING LICENSE, AND, TO PROVIDE FOR SUSPENSION OF KALISPELL PLUMBING LICENSE' AFTER A FAIR HEARING; TO PROVIDE FOR THE DUTIES OF THE CITY BUILDING INSPECTOR IN ENFORCEMENT OF PLUMBING CODES AND PROCEDURE BY WHICH HE CAN ORDER REPAIRS OR REMOVAL OF CERTAIN CONDITIONS; TO PROVIDE FOR POSTING PLUMBING OR STEAM FITTING PERMIT UPON PREMISES WHEN WORK IS PERFORMED; TO PROVIDE FOR TYPE OF PIPE OF WHICH A HOUSE SEWER PLAY BE CONSTRUCTED; TO PROVIDE FOR POSTING; TO PROVIDE FOR REPEAL OF PROVISIONS OF THE KALISPELL CITY CODE IN CONFLICT WITH THESE AMENDMENTS; AND TO PROVIDE FOR EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA, AS FOLLOWS: SECTION 1. Section 21-1, Kalispell City Code, is hereby amended to hereafter provide as follows: A certain document, three copies of which are on file in the office of the city clerk, designated as "State of Montana, Plumbing Law Rules and Regulations", published and adopted by the Montana State Plumbing Board, July, 1974, (see R.C.^M., •1947, Section 66-2416) shall be the Plumbing Code for the city, regulating the practice of plumbing and establishing minimum standards for plumbing work in the city. Any person convicted of violating any of the provisions of the.""Montana State Plumbing Code" adopted by this section sh_;11 be punished as provided by Section 1-9, Kalispell City Code. SECTION 2. Section 21-2, Kalispell City Code, is hereby amendee to hereafter provide as follows: (a) All plumbing work done within the city shall conform to the rules, regulations and requirements described and defined in the Plumbing Code and this chapter and shall be inspected and approved in the manner herein set forth. (b) All work of plumbing and drainage shall be performed by a journeyman plumber duly licensed hereunder as such, and under the supervision of an employing or master plumber, duly licensed and bonded as such as herein provided; provided, however, such licensure and supervision shall not be required in those instances set forth in Section 66-2401(2), R.C.M., 1947, as amended. A change in the plumbing and drainage system shall be governed by the same rules as any work. (c) Any person engaged in the business of plumbing in the city, either as a master or as a journeyman plumber, shall first secure a license as prescribed by the Revised Code of Montana, 1947, Section 66-2401, and in addition thereto, must first obtain a license from the city clerk at the following rates: Master plumbers - $25.00 per year, or any fraction thereof.' Journeyman plumbers - $5.00 per year, or any fraction thereof. All such licenses so issued by the city clerk shall expire on the thirty-first day of December of each year; shall be renewed annually, at any time prior to expiration upon the payment of the sum of ten dollars for each master plumber's license and five dollars for each journeyman plumber's license. Any such renewal shall also be for the period of one year. If the license granted and issued to a master or journeyman plumber by the State of Montana Board of Plumbing Examiners shall be suspended or revoked by the State Plumbing.Board, such action shall also constitute a similar suspension or revocation of the license granted to such person by the Citv of Kalispell. Also, the City Council may, upon good cause shown and after affording such licensee a fair hearing, revoke or suspend any city license granted and issued hereunder. Willful violation of any provision of the Plumbing Code of the City by any licensee shall be good cause for such a suspension or revocation. (d) No person shall engage in the business of plumbing under a master plumber's license without first furnishing a public liability bond in the sum of one thousand dollars, approved as to form and sufficiency by the city council and conditioned that he will in good faith perform all the things required of him by this chapter and that if anv injury to any person or damage to any property results by reason of his failure or neglect to conform with this chapter he shall save harmless and indemnify such person injured, or the owner of such property damaged. SECTION 3. Section 21-3, Kalispell City Code, is hereby amended to hereafter provide as follows: The work of inspecting the installation and repairs of all plumbing done within the city shall be under the supervision of the City Building Inspector. He shall enforce and carry into effect the state law, this chapter and any other ordinances of the city relating to the installation and maintenance of plumb- ing and drains connected with the public water and sewer system, or with private cesspools. He shall, in person or by his deputies or assistants, have power to examine any building in which plumbing fixtures are being installed and to condemn and order removed any plumbing found unsanitary and not in compliance with the provisions of this chapter and state law. When, upon examination, any plumbing or connections thereto in any building or other structure shall be adjudged dangerous to life or health, or to be a nuisance, by the board of health, having jurisdiction of health matters within the city, and upon receipt of such notice, the City Building Inspector shall immediately notify, in writing, the owner or agent of the owner of such building or structure, or the occupant thereof, to have same removed or repaired within ten (10) days thereafter, and if the owner, agent or occupant neglects or fails so to do, such person shall be deemed guilty of a violation of this code. In the enforcement of this chapter and state law the said City Building Inspector will work in connection with the Board of Health, City Council and City Engineer. SECTION 4. Section 21-17, Kalispell City Code, is hereby amended by adding thereto the following subdivision, other subdivisions of said section remaining unchanged: - 2 - "(d) Any permit issued hereunder shall be posted in a prominent place on the premises where the work is to be per- formed and remain thereon until the work performed is finally accepted and an occupancy permit issued." SECTION 5. Section 21-18, Kalispell City Code, is hereby amended to hereafter provide as follows: Whenever practicable, every building shall have an indep- endent connection with a public sewer. Where a building stands in the rear of another on the same lot, the house drain from one building may be extended to the other building, and the whole will be considered as one house drain; provided, however, that the portion of the house sewer not covered by a building with a concrete or masonry foundation may be of vitrified pipe but the diameter of the conduit must not be reduced from the front building to the public sewer. The house sewer shall be constructed of cast iron soil pipe,, salt glazed vitrified clay pipe, transite pipe, or such pipe as is approved by the "State of Montana Plumbing -Law Rules and Regulations" and adopted by the Montana State Plumbing Board; provided, however, that no transite pipe shall be used or installed within two (2) feet of any building. A permit shall first be obtained from the plumbing inspector for the construction of the sewer. The fee for this permit shall be two dollars and fifty cents. Wherever it is necessary to excavate in any street or alley, a separate permit for such purpose must be procured from the proper city officals. Meas- urements shall be obtained to locate the "Y" junctions in thy- , public sewer to which the house sewer shall connect. If suc`_ junction cannot be found within three feet of the location g. such permit shall permit the holder thereof to tap the sewer under the direction of.the City Building Inspector. Wherever it is possible, pipe shall be laid with a grade of one-fourth inch, or more to the foot. In no case shall a grade of less than one -eighth inch to the foot be used. The pipe shall be laid uniformly to line and grade. Change in direction shall be made with one -eighth bends, except where the pipe can be laid upon a circle with a radius exceeding fifteen feet, in which case uniform deflection may be made in each joint. No pipe shall be laid under any building having a concrete or masonry foundation, or within two feet of the same, and whenever such a building is constructed over a vitrified pipe sewer or within two feet thereof, such sewer shall be removed or relaid with soil pipe of equal inside diameter. All pipe in the main house sewer shall have an internal diameter of not less than four inches. Short branches may have such diameter of four inches and be connected to the main house sewer with "Y" junctions. Wherever possible, the house sewer shall be laid at such depth as to permit the house drain to enter the building below the level of the basement or cellar flo When deemed necessary by the Building Inspector, for the purpose of inspection, no backfilli_ng over the pine shall be done until permission is ,given by him. SECTION 6. Secti hereafter provide 21-22,,Kalispell City Code, is hereby amended to follows:. - 3 - f .. Any permit issued under the provisions of this article may be revoked by the proper inspector for failure to comply with the provisions of this acticle or any other provision of this Code relating to heating systems, and it shall be unlawful to continue any work authorized by such permit. Any permit issued hereunder shall be posted in a prominent place on the premises where the work, is to be performed and remain thereon until the work performed is finally accepted and an occupancy permit issued. SECTION 7. All other rovisions of the Ka ispell City Code relative to plumbing, ste itt`ing and heating,syst ms not in conflict here- with shall remain in full force and effect; those provisions of said code in con ict herewith are hereby repeal d.
