ORDINANCE NO. 850
AN ORDINANCE TO AMEND THE ZONING ORDINANCE OF THE CITY OF KALISPELL
TO REQUIRE THE CITY ENGINEER PREPARE, KEEP AND MAINTAIN FOR PUBLIC
INSPECTION A ZONING MAP OF THE CITY; TO PROVIDE FOR METHOD OF
ESTABLISHING ZONE OF TERRITORY TAKEN INTO THE CITY; REPEALING
ORDINANCES IN CONFLICT: AND PROVIDING FOR EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA:
SECTION 1. Section 7 of the Zoning Ordinance of the City of Kalispell
is hereby amended to hereafter provide

A. The City Engineer shall prepare and keep an official
map accurately reflecting the boundaries of the various use
districts and areas included therein as heretofore established
by the City Council. The scale of said map shall be not less
than 1f?_—°00' Said map shall be kept current
and accurate and shall be modified and altered as required as
areas are added to the city or zoning of areas within the city
is changed as provided by law. Said map shall be maintained in
the office of the City Engineer and shall be available for
examination and inspection by the public during regular working
hours.
B. Unless as otherwise provided hereafter, as new
territory is annexed to and taken into the city same shall
take the same zone classification as that portion of the ci!.:-;
that it adjoins; provided, however, if said annexed terr.ito-;
adjoins portions of the city having different zone classific:--
tions, all said territory shall. take the same zone classifi.c.:t-ion
as the highest, or most restrictive zone that it adjoins.
C. If all the owners of new territory to be annexed to
and taken into the city do, in their petition for such annexa-
tion, request that said territory be given a zone classification
higher, or more restrictive, than that of all the portions of
the city that it will adjoin, and if, in considering said
petition; the city council finds that such higher zone classif-
ication will be in the best interests of the city, said territory
may be assigned such higher, or more restrictive, classification
upon its annexation to the city as provided by law. The
petition of annexation may be rejected if the city council does
not so find.
D. If all the owners of new territory to be annexed to
and taken into the city do, in their petition for such annexa-
tion, request that said territory be given a lower, or less
restrictive zone classification than the highest, or most
restrictive zone classification that said new territory shall
adjoin in the city, the council shall hold a public hearing on
said petition of annexation before acting thereon. Notice of
the time and place of such public hearing shall be given by
publication thereof in a newspaper of general circulation in t1l
city of Kalispell at least twice prior to such public hearing;
also, notice of the time and place of such hearing shall be
posted in at least three public places in the city immediately
adjoining the area proposed to be annexed thereto. Said public
hearing shall be held in the council chambers, or at some
other public place, at least 15 days after the last publica-
tion and posting of the notice thereof.
Said hearing may be adjourned from time to time if the
council finds additional time is required to allow all
persons effected by the proposed annexation to be heard.
After such public hearing the City Council shall forth-
with accept or reject the proposed annexation as the best
interests of the City as a whole may require. If said
proposed annexation is rejected as not in the best interest
of the city as a whole, no portion of the area so proposed
to be annexed may be again considered for annexation to the
city under other than paragraphs B and C hereof for at least
one year from the date of such rejection.
f;::CTION 2. All other portions of Section 7 of the Kalispell
ironing ordinance and all other portions of the Kalisepll Zoning
Ociiinance in conflict herewith are hereby repealed. Provided,
hcAvever, that no zoning classification heretofore assigned to
