OF VIOLATION OF ORDINANCES OF THE CITY, OR RULES OR REGULATIONS C' ORDERS OF THE CITY, OR OFFICERS THEREOF, WHEN NO OTHER PENALTY THEREFORE IS PROVIDED FOR; PROVIDING THAT EACH DAY OF SUCII VIOLA TION SHALL CONSTITUTE A SEPARATE OFFENSE; PROVIDING THAT REVOCAa'z:-)'N OR SUSPENSION OF ANY LICENSE OR PERMIT SHALL NOT BAR SAID GENER.`_I, OR OTHER LAWFUL PENALTY ALSO BEING IMPOSED; PROVIDING THAT SENT'ICE OR FINE ALONE MAY AMOUNT TO CIVIL JUDGMENT AND/OR IMPRISONMENT 'T $10.00 PER DAY FOR NON-PAYMENT OF FINE; PROVIDING FOR GRANTING '.IF PARDON AND REMITTING OF FINE BY MAYOR IN INTEREST OF PUBLIC JUS!'ICE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MO'd'I'ANA, THAT SECTIONS 1-9 and 1-10 OF THE CITY CODE (FORMERLY ORDINANCE NO. 746 R 1 ) BE AMENDED TO PROVIDE AS FOLLOWS: SECTION 1. Section 1-9, Kalispell City Code, shall hereafter provide: "Whenever in any provision of this Code.or other ordinance o` the city or in any rule, regulation or order promulgated by any officer or agency of the city under authority vested in him or if by law or ordinance any act is prohibited or is made or declared to be unlawful or an offense, or whenever the doing of an act is required or the failure to do any act is declared to be unlwaful, where no specific penalty is otherwise provided for the disobedience of such provision, ordinance, rule regulation or order, or whenever said act is done or not done, as may be prohibited or required, any person upon conviction for the violation of any such provision of this Code, ordinances, rules regulations or orders, or said act or failure to act, as the case may be, shall be punished by a fine not exceeding five hundred dollars or by imprisonment not to exceed six months, or by both such fine and imprisonment, for each such offense. Each day any violation of any provision of this Code or other ordinance, rule, regulation or order, or prohibition or requirement shall con- tinue shall constitute a separate offense." SECTION 2. Section 1-10, Kalispell City Code, shall hereafter provide: a) Upon rendition of judgment after pronouncement of a sentence imposing punishment of imprisonment, the court shall commit the defendant to the custody of the chief of police for. confinement as adjudged. b) If the judgment is for a fine alone, execution may issue thereon as on a judgment in a civil case. c) If the judgment is for a fine and imprisonment until fii be paid, the defendant must be committed to the custody Of the proper officer, and by him detained until the judgment is complic with.
