Ordinance 829 - Hours When Sale of Alcohol Prohibited353 ORDINANCE NO. 829 AN ORDINANCE TO PROVIDE FOR THE HOURS WHEN SALE OF INTOXICATING LIQUOR AND BEER IN THE CITY OF KALISPELL IS UNLAWFUL; TO PROVIDE FOR THE (CLOSURE OF LICENSED PREMISES OR PARTS THEREOF DURING SUCH HOURS; TO PROVIDE PENALTY FOR VIOLATION AND ESTABLISH THE EFFECTIVE DATE; AND TO REPEAL EXISTING ORDINANCES IN CONFLICT THEREWITH. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA: l Section 1. It is unlawful for any person in the City of Kalispell to sell, offer for sale or give away, intoxicating liquor, including beer as defined by Section 4-302(b), R.C.M., 1947, upon any premises licensed to sell intoxicating liquor or such beer at retail'during the following hours: A. Sunday, from 2:00 A.M. to 1:00 P.M.; B. On any other day between 2:00 A.M. and 8:00 A.M. of the same day. Section 2. All establishments licensed for the sale at retail of intoxicating liquor, including beer as defined by,Section 4-302 (b) R.C.M., 1947, shall be closed during the hours it is unlawful to sell,'offbr for sale or give away intoxicating liquor, including beer as ddfined by Section 4-302(b) R.C.M., 1947; and it shall be unlawful for any licensee to permit such premises to be open at such times and all persons, save employees of such licensed estab- lishment, shall be excluded therefrom at such times; provided, however, that when a licensed establishment is operated in con-. junction with a hotel, restaurant, bus depot, railway terminal, or other lawful business other than that of the satle of intoxicat- ing liquor or beer, then such other lawful business need not be closed, but only the part of said licensed premises thereof where such beer or liquor is sold. ' Section 3. It is unlawful for any licensee to,deliver intoxicating liquor or beer or permit same to be drunk on a licensed premises during hours said premises are required to be closed. Section 4. Any person violating any of the provisions of this act may, upon conviction thereof, be punished as provided in Section 1-9 of the Kalispell City Code. Section 5. Those portions of Sections 3-10 (Revised Ordinances, 1947, #772; Ordinance #557(1) and'prdinance #783) and Section 3-22 (Ordinance #556(1)(2_)-of the Kalispell City Code and any other. ordinance or pas � tlp& breof in conflict herewith are hereby repealed.
