AN ORDINANCE TO AMEND SECTIONS 1, 2, AND 4 OF ORDINANCE NO. 777
(Sections 2-17.1, 2-17.2, and 2-17.4 of the Kalispell City Code)
TO PROVIDE FOR TRAVEL AND EXPENSE COSTS FOR OFFICERS AND EMPLOYEES

OF THE CITY, AMOUNTS ALLOWABLE AND COMPUTATION THERrOFt PROVIDING
AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL,
MONTANA, AS FOLLOWS:
SECTIONS 1, 2 and 4 of Ordinance No. 777 (Sections 2-17.1, 2-17.2,
and 2-17.4 of the Kalispell City Code) are hereby amended to here-
after provide as follows:
1. (Section 2-17.1 of the Kalispell City Code) Any officer or
employee of the city, or any department thereof, who shall be
required to travel outside the city on the official business of
the city, and, who does so travel with the prior approval of the
city council, shall be allowed, for the time engaged in such
travel,sixteen dollars per day for such travel within the state,
and the sum of twenty-five dollars per day for such travel out-
side the state, and thirty dollars per day for travel in the
District of Columbia. Such per diem allowance shall be in lieu
of any claim by such officer or employee .for actual expenses
incurred while on such travel for meals, lodging or any other
necessary expenses; provided, that this section shall not affect
the ability of the city council to allow membership fees"or dues
and other necessary expenses as permitted in Section 25-508,
Revised Codes of Montana, 1947.
2. (Section 2-17.2 of the Kalispell City Cbde) In computing
the per diem in lieu of subsistence for continuous travel for
more than twenty-four hours, the calendar day, midnight to
midnight, shall be the unit, and for fractional parts of,a day
at the commencement or ending of such continuous travel', consti-
tuting' a travel period, one-fourth of the rate for a calendar
day shall be allowed for each period of six hours or fraction
thereof. When a change in the per diem rate is made during a
day, the rate of per diem in effect at the beginning of the
quarter in which the change occurs shall continue to the end
of such quarter. For continuous travel of twenty-four hours or
less, constituting a travel period, such period shall be regarded
as commencing with the beginning of the travel and ending with
the completion thereof, and for each six hour portion of the
period or fraction thereof, one-fourth of the rate for a calendar
day 'shall be allowed; provided, that no per diem, except an
allowance not to exceed two dollars per day for money actually
expended for mid -day meals, shall be allowed when the departure
is at or after 9:00 A..M. and the return on the same day is at
or prior to 6:00 P.M. In no case shall any per diem or allow-
ance whatsoever be paid for any absence not exceeding three
hours.

3. (Section 2-17.4 of the Kalispell City Code) Any officer
or employee of the city performing travel outside the city as
provided herein and who, with the prior authority of the city
council, shall use his own automobile or airplane for such
travel shall be entitled to mileage therefor at the rate of
twelve cents per mile for the most direct or practical route
by automobile or at the rate of twelve cents per air mile for
the distance by the most direct or practical route by airplane;
provided, that if two or more city officers or employees travel
together in the same automobile or airplane only one such
officer or employee may claim mileage for such travel so jointly
performed. For mileage and route computation purposes under
this section the latest edition of the Rand -McNally map shall be
utilized, actual speedometer readings notwithstanding.
SECTION 2. This ordinance shall be effective for all claims for
per -diem, travel or other expenses allowable retroactive to July
1, 1973; if claims have heretofore been submitted, allowed and
paid under the heretofore existing provisions of ordinance 777,
a similar claim for any added sums allowable by instant ordinance
may be submitted for approval and payment in accord herewith.
Such claims for added reimbursement will be allowed and paid upon
approval in the regular course of vouchers for claims against the
city.
