AN ORDINANCE TO PROVIDE FOR SICK LEAVE FOR CITY EMPLOYEES; ACCRUAL
THEREOF; LUMP SU14 REIMBURSE_71ENT FOR UNUSED ACCRUED SICK LEAVE UPON
SEPARATION FROM SERVICE OF THE CITY AND EFFECT OF RE—EMPLOYMENT;
PROVIDING FOR DISMISSAL FROM SERVICE AND FORFEITURE OF LUMP SUM
REIM3URSEME-NT UPON ABUSE OF SICK LEAVE; DECLARING All EMERGENCY AND
PROVIDING FOR EFFECTIVE DATE HEREOF; REPEALING CONFLICTING ORDINANCE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA,
AS FOLLOWS:
Section 1. Every full time city employee who is
unable to,perform
his or her duties by
reason of illness, shall be
entitled to one
working day of sick
leave with pay for each full
calendar month
of service, and any
such 'sick leave accrued and unused in any year
shall be cumulative
for succeeding years subject
to the following
conditions provided
for in this article.
No city employee shall be considered a full time city employee
until after he has completed 90 days of continuous city employment.
After a city employee,has completed 90 days of continuous city
employment he shall be credited with three (3) days accumulated
sick leave. Part time city employees shall not be entitled to
sick leave or any accumulation thereof. An employee may not
accrue sick leave during a suspension or leave of absence without
pay, the duration of which exceeds fifteen. (15) calendar days.
Section 2. Upon separation from service as an employee of the city,
the employee is entitled to a lump -sum payment equal to one-fourth
(1/4) of the pay attributed to his accumulated 'sick leave. The pay
attributed to his accumulated sick leave shall be computed on the
basis of the employees' salary at the time the sick leave accrued.
Accrual of sick leave for the purposes of the lump -sum payment
provided for in this section shall begin July l,'1971. However, no
employee forfeits any rights or benefits he has previously accrued
with respect to sick leave.
Section 3. An employee of the city who receives a lump -sum payment
pursuant to this act and who is thereafter again employed by the
city may not be credited with any sick leave for which he has
previously been compensated.
Section 4. Abuse of sick leave by an employee of the city is cause
for dismissal from such employment and for forfeiture of the lump -
sum payments for accrued sick leave as provided for in this ordinance:
An abuse of sick leave shall include, but not be limited to,a ,
fraudulent or false claim for sick leave by an employee, or a
false certificate to such sick leave for absence from work for
other reasons by a supervisor of such employee.
Section 5. Sections 2-11, 2-15, 2-16, and 2-17 of the Kalispell City
Code are hereby repealed; Sections 2-12, 2-13, and 2-14 shall remain
in full force and effect. All other sections of the Kalispell City
Cpde in conflict herewith are hereby repealed.
Section 6. An emergency is hereby declared to exist and this
ordinance shall become effective as of July 1, 1971.
