Annexation Update - Greenacres & Stillwater EstatesJ City of Kalispell Post Office Box 1997 - Kalispell, Montana 59903-1997 - Telephone (406)758-7700 Fax(406)758-7758 REPORT TO: Honorable Mayor and City Council FROM: PJ Sorensen, Zoning Administrator Chris Kukulski, City Manager SUBJECT: Greenacres and Stillwater Estates Annexations MEETING DATE: April 15, 2002 (workshop) BACKGROUND: Last fall, the potential annexation of Greenacres was discussed at a work session. Based on the Council's input, staff refined the annexation proposal in an effort to limit, to the greatest extent possible, the annexation to those lots connected to one or more city utilities without creating a "checkerboard" effect. We have attached a map of the proposed annexation area for your reference. Staff is presently compiling an extension of services plan for the area, as required by state statute. Once the plan is completed (including a Council work session), the proposal would formally come before the council. The Greenacres annexation would be accomplished in three distinct phases. The first phase would involve only those properties in the Kelly Road and 3' Avenue East vicinity. The annexation would be pursued under the provisions for the annexation of contiguous land. The first formal step for the Council is the consideration of a resolution of intent to annex the designated area. If the Council approves the resolution, public notice is published and mailed to the registered voters in the area. About 3-4 weeks later, the Council would vote on a resolution of annexation. Initial zoning for the area would follow a separate, but related, track. The second phase involves the county streets throughout the Greenacres area. We anticipate annexing and acquiring all of the county owned rights -of way not only within the annexed area, but also portions of Willow Glen, Woodland Avenue, South Woodland Drive, and 8'h Avenue East. This phase needs to be accomplished through separate procedures, and would be performed after completion of the first phase. The third phase would bring in properties accessed off of 5' and 8' Avenues East. This area is not contiguous to the first phase, and needs to be pursued as a separate action. We would likely annex this phase as wholly surrounded land. The process is similar to the process described above for contiguous land, but is more streamlined in terms of legal requirements and challenges. This phase would begin after the annexation of the rights -of -way. Stillwater Estates would be more straight -forward in terms of process. Both existing phases could be annexed as contiguous land as part of a single action. After the completion of an extension of services plan, we would move forward according to the same process as the first phase of Greenacres. A map of the Stillwater Estates area is included for your reference. RECOMMENDATION: The Council direct staff to continue the annexation process. ALTERNATIVES: As suggested by the Council.
