Flathead County, pursuant to Section 7-14-4114, M.C.A., hereby petitions the Council of
the City of Kalispell to abandon the following street and alley in the City of Kalispell:
Tenth Street West, between Main Street (Highway 93) and First Avenue West.
2. The alley in Block 132, Kalispell Original Townsite.
The street and alley subject of this Petition are shown on Exhibit A hereto. The purpose
for the closure is to facilitate the construction by Flathead County of an office building on the
Eastern '/z of Block 132 and parking for that building.
Flathead County is the owner of all property adjacent to the alley in Block 132, Kalispell
Original Townsite, and of property adjacent to Tenth Street West between Main Street and First
Avenue West.

RE: Petition — Street and Alley Abandonment
Dear Commissioners:
Thank you for your petition of February 5, 2004, requesting the City consider abandonment of 10`h Street
West, between Main Street (Highway 93) and I s' Avenue West and the alley in Block 132, Kalispell
Original Townsite. I apologize for the untimely response.
As you are aware, 10th Street West does provide relief in handling traffic in that area. At this time, the
City is willing and in agreement with the request to abandon the alley. However, more serious
consideration must be given to the abandonment of the proposed portion of 10`t' Street West. In recent
months, we responded to a similar request from St. Matthew's to abandon 6`h Street West from Main to
1" Avenue West (See attachment).
The City's concern is the large amount of traffic in the whole area and how such a change may influence
all traffic, most especially traffic in and out of the high school area and access to Main Street. With
existing one way streets, and if the City approved either or both requests, it could be eight to ten blocks
before a motorist could reach Main Street. Your request is very similar to the St. Matthew's request,
with all the same concerns. We suggested that they consider a traffic study for the area to address their
issues and their mitigation.
Should the County be willing to initiate discussion and a traffic study with St. Matthew's and the City as
partners, a workable solution may arise that meets the needs and concerns of all three entities.
One last thought. I am sure that the Commissioners have considered this, but I feel compelled to advise
you that if the street is closed, purchase of the right of way from the City may be required.
We applaud your efforts to search out facilities solutions that will take you into the future while
remaining in Kalispell's core area. If the City staff can help you as you move through the process, please

Dear Fr. Langhans,
Thank you for your letter of September 6, 2003, requesting the City consider a proposal closing 6"'
Street West, from Main to I' Avenue West, on behalf of St. Matthew's. As stated in the letter, 6a'
Street West does provide significant relief in handling traffic in that area.
After consideration, the City feels it is not inclined to agree to St. Matthew's proposal to close the
street. However, the City does not want to close the door entirely on the proposal. The City's
concern is the large amount of traffic in the area and how such a change may influence all traffic,
most especially traffic in and out of the high school area and access to Main Street. Should St.
Matthew's be willing to undergo the expense of a traffic study for the area, and provide a workable
solution, the City would be willing to entertain further discussion of the proposal.
St. Matthew's has served Kalispell well over the last century. We applaud your efforts to search out
facilities solutions that will take you through the next century. If the City staff can help you as you
move through the process, please feel free to call me. As an example, height restrictions on
buildings have been lifted through out the community over the last three years and thus may offer
new opportunities for your buildings layout.
