Patrick, City Manager SUBJECT Courthouse East Zone Change Request from R-3 to R-5 and Planned Unit Development - Fifth Avenue East MEETING DATE: May 31, 2005 --- Work Session BACKGROUND: At the Kalispell City Council's regular meeting of Mav 16, 2005 the proposal for rezoning the Courthouse East property and associated PUD was tabled for a work session on May 31st. Additionally, the staff was given general direction to facilitate a neighborhood meeting that would provide a forum and opportunity for information and collaboration. A neighborhood meeting has been scheduled between 6:00 PM and 7:00 PM May 31, 2005 just prier to the Kalispell City Council work session. It is anticipated that the format for the meeting would be explanation by the City staff of how the meeting will. proceed. This would include introduction of the project by the City staff, a presentation by the developer, question and answer period for the neighbors and discussion of the issues. Wrap up comments will be taken at the end which will lead into the city council work session. The neighborhood meeting will not be a forum for public comment nor will it be a forum for another public hearing, but rather an opportunity to answer questions and identify issues. During the work session, the city council can and will take public comment under "Hear the Public" on their work session agenda. Hopefully the public will understand this is riot a public hearing. Detailed minutes of the public hearing held before the Kalispell Planning Board on April 19, 2005 have been forwarded to you for your review and consideration along with written public testimony that was received. After the work session the city council may decide there is some merit in scheduling another public hearing. In essence, the property owners / developers are requesting a zone change from R--3, Urban Single Family Residential, to R-5, Residential / Professional Office, with a Planned Unit Development (PUD) to allow the rehabilitation and reuse of the existing Courthouse East building and site. The Courthouse East property is located on the east side of Fifth Avenue East between 7th and 8th Streets East. The address is 723 Fifth Avenue East and is situated on one city block that includes the building and parking area. This one city block contains approximately 2.01 acres. All levels of the building total approximately 65,000 square feet. This includes the prior maintenance building footprint that is intended to be reconstructed with the mechanical room on a subterranean level. The project proposal includes 30 apartments, 20,000 square feet of professional office space and approximately 1,600 square feet of retail. . Providing Community Planning Assistance To: • City of Kalispell • City of Whitefish • City of Columbia Falls - Courthouse East Zone Change and PUD May 11, 2005 Page 2 As previously noted, the Kalispell City Planning Board held a public hearing on the proposal at a special meeting of April 19, 2005. The planning staff provided an evaluation of the proposal in staff report KZC-05- and KPUD-05-3 which have been forwarded to the council previously as part of the planning board's transmittal, public record and basis for decision. Staff recommended approval of the proposal subject to conditions. The board took lengthy public testimony and discussed the project in depth. They considered issues presented at the public hearing and issues raised by individual board members. After careful discussion and consideration of the proposal., the planning board voted three in favor and three opposed to recommend approval of the project to the city council. No recommendation for approval, from the planning board has been given. During this review process, including consideration by the Kalispell City Council, the primary issues identified were the density of the project, parking requirements, access, potential impacts to the neighborhood and the status and condition of the building. Apparently there were also some questions and concerns about the legality of rezoning the property, the non -conforming status of the property and expectations about the future use of the site under an R-3 zoning designation and other potential zoning or uses for the property. The purpose of this work session is to further define and articulate the specific concerns related to the project, provide answers to questions and determine a course of appropriate action. RECOMMENDATION: The Kalispell City Council consider the proposal, the issues and the recommendation of the Kalispell Planning Board. Consideration might also be given to scheduline another public hearing regarding this matter. FISCAL EFFECTS: Minor positive impacts once fully developed. The developer will wake a brief presentation followed by the planning staff review then concluding with a question and answer period. This is not a public hearing. Following the neighborhood meeting, the Kalispell City Council will hold a work session to discuss the project, The public will be given an opportunity to comment briefly to the city council and express their opinion on the proposal or specific issues. No formal action will by taken by the Kalispell City Council at this meeting. A neighborhood meeting will be held regarding a proposal by DEV Properties for a the redevelopment of the Courthouse East site. This includes a change in zoning from R-3, Urban Single Family Residential, to R-5, Residential / Professional Office with a Planned Unit Development (PUD) overlay for a mixed use project has on approximately 2.06 acres. The Courthouse East property is located at 723 Fifth Avenue east on the east side of Fifth Street East between. Seventh Street East and Eighth Street East. As proposed, the project would include the rehabilitation and reuse of the existing Courthouse East building and property. The building has approximately 65,000 square feet. The proposal includes remodeling the building for 28 apartments, 20,000 square feet of professional office space and approximately 1,600 square feet of retail.
