19-20 Parks; Indecent Conduct, Drinking.
A. Indecent Conduct: No threatening, profane, abusive, disorderly, insulting or indecent language,
conduct or behavior or any act tending to a breach of the public peace shall be allowed in or upon any park
or public grounds, nor shall any person play games of chance, dank intoxicating liquor or be drunk or do
any indecent or improper act therein..
B. Intoxicating Liquors: No person shall take into or upon any park, nor into or upon any public grounds,
any intoxicating liquors, either for sale to others in such park or public grounds, nor shall any person sell,
gyre away or in any way dispose of any intoxicating liquor in or upon any park or public grounds.
C. Removal of person: Any drunk or disorderly person or any person doing an act injurious to the park or
public place in which he or she then is or who is in the act of violating any niles or regulations of the board
of park commissioners or any ordinances of the City, may be removed from such park or public place by
the keeper thereof or by any police officer of the City.
D. Hours: City parks shall be posted as open at 6:00 a.m. everyday and closed at 11:00 p.m. everyday. It
shall be unla-%N7ful for any person to remain in any City park during the time when it is closed.
E. Park Access RestTicted: Upon making a finding of guilty to a violation of any portion of this section,
die Municipal Court Judge may, in addition to all other sanctions permitted, order that the violator be
restricted from access to any of the City parks for a period of up to one himdred eighty (180) days.
F. Woodland Skate Park: The rules and regulations of the woodland Skate Park shall be posted in a
clearly visible portion of the skate park, stating that the skate park is not supervised and participants shall
skate at their own risk. The rules and regulations of the slate park are as follows:
1. All participants must wear appropriate safety gear: CS.A approved helmets and footwear are
mandatary. Helmets must fit properly with straps fastened. Pads. gloves and guards are strongly,
recommended.
2. The surface is extremely dangerous when vet; the park will be closed during inclement weather
or if surface and equipment are, vet.
Alcohol, drugs and tobacco are prohibited in and around this facility.
4. All food and drinks are prohibited inside the fenced area. Please use trash containers to keep your
park clean and safe.
5. No animals are allowed inside the fenced skate park area.
G. Skateboards, BMX bikes, and in --tine skates allowed only during designated tines.
7. All BMX bikes must be equipped with protective covering on pegs.
8. Children under the age of ten (10) years old must be accompanied by an adult.
9. Due to safety concerns, spectators who are not skating may not enter the skate park while activit-v
is in progress and must remain outside the fence.
10. Hours of operation are from. one-half (1/2) hour before sunrise to one-half (1/2) hour after stmset
wiless otherwise posted. The Department of Parks and Recreation resentes the right to change the
schedule as necessary. (See posted hours of operation.)
11. Vandalism, including graffiti and tagging is strictly forbidden.

AN ORDINANCE AMENDING SECTION I€ N I9-20 OF THE K LISPE tL CITY CODE
SETTING FORTH THE RULES AND REGULATIONS OF TWOODLAND SKATE
]?ARK .AND DECLARING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA,
AS FOLLOWS:
SECTION I. Section 19--20 of the Kalispell City Code shall be and is hereby amended
by adding the following paragraph:
E. The rules and regulations of the woodland Skate Park shad be posted
in a clearly visible portion of the skate park, stating that the skate park is
not supervised and participants shall skate at their own risk. The rules and
regulations of the skate park are as follows;

AN ORDINANCE PROHIBITING THE USE OF SKATEBOARDS, ROLLER BLADES, ROLLER
SKATES, COASTERS OR SCOOTERS UPON CERTAIN PUBLIC RIGHT OF WAYS IN
CERTAIN AREAS- OF THE CITY OF KALISPELL, AND PRIVATE PROPERTY WHERE
SIGNED, PROVIDING A. PENALTY FOR VIOLATION AND PROVIDING AN EFFECTIVE
BATE.
SECTION I. PROHIBITION IN CERTAIN AREAS: No person shall operate or
Me on a skateboard, roller blades, roller skates, coasters or scooters
on any of the following areas:
(A) Any street or alley.
(B) Parking lots owned or leased by the City of Kalispell.
(C) on any public or private property where signs have
been posted at the entrance or displayers prominently on the
property prohibiting the use of skateboards.
(D) On any sidewalk running parallel to- the following
streets ("sidewalk" meaning on both sides of the street):
1. Main Street from Idaho Street to 10th Street
2. 1st Avenue West from Center Street to 7th
Street
3. 1st Avenue East from Center Street to 5th

SECTION II. PENALTY: A) Any person who violates any of the
Provisions of this Ordinance shall be guilty of a misdemeanor and
shall be fined or imprisoned in accordance with §1-9 of the Kalispell
City Cade.
H ) Any person convicted of a second subsequent offense under this
Ordinance shall have their skateboard, roller blades, roller skates,
coaster or scooter confiscated.
SECTION III, SEVERABILITY CLAUSE: If any section, subsection, para-
graph, sentence, clause, or phrase of this Chapter, or any part
thereof, or application thereof to any person, firm, corporation,
public agency, or circumstance, is for. any=,reason held to be unconsti-
tutional or invalid or ineffective bar arty tours of competent

jurisdiction, such decision shall t effect the validity or effective-
ness of the remaining portions o this Chapter or any part thereof.
It is hereby declared to be tDre legislative intent of the City of
Kalispell that this chapter wat:ld have been adopted had such unconstitu-
tional or invalid provision, clause, sentence: paragraph, section, or
Part thereof not then been included.
SECTION IV- This Ordinance shall become effective 30 days from and
after its passage by the City Council and approval by the Mayor.
