State Super Fund FacilitiesMayor Pam Kennedy and the Kalispell City Council Po Box 1997 Kalispell, MT 59903 Re: Kalispell Pole and Timber, Reliance Refinery, and Yale oil Corporation State Superfund Facilities Dear Mayor Kennedy and Council Persons: Pursuant to § 75-10-713, Montana Code Annotated, the Montana Department of Environmental Quality (DEQ) hereby notifies you of a 30-day public comment period on the proposed Partial Consent Decrees it has entered into with the Kalispell Pole and Timber Company, Montana Mokko, Inc., Stillwater Forest Products, Inc., and Robert Pannenter for the Kalispell Pole and Timber, Reliance Refining Company, and Yale oil Corporation State Superfund facilities in Kalispell, Montana. one document resolves DEQ's claims and bars contribution claims by other parties against the Kalispell Pole and Timber Company and requires the company to assign its remaining potential insurance claims. The other document resolves DEQ's claims and bars contribution claims by other parties against Montana Mokko, Inc., Stillwater Forest Products, Inc. and Robert Parmenter and requires those parties to allow the use of their real property for conducting remediation. DEQ is soliciting public comment on this document from interested persons, the Flathead County Commissioners, and the local governing body of the City of Kalispell. To this end, DEQ has published notice in the Daily Interlake. The public comment period begins January 12, 2008, and will end at 11:59 pm MST on February 10, 2008.
