Several issues have arisen with the park since that time, including a severe increase in criminal violations such as disorderly conduct, criminal mischief, threats, drug use, etc. A mandatory helmet rule was instituted by council., Kalispell Municipal Code 19--20, we are continually issuing citations for non-compliance. City Code states that suns must be posted stating skate park rules but as soon as they are installed they disappear. These are just a few of the issues that have arisen as a result of the skate park. RECOMMENDATIONS: There are several areas that we would like to discuss with council to get their input such as; -revisiting the helmet rule. -revisiting the City Code mandating that the rules "shall be posted' -Institute consequences, such as park closure, for criminal or bad behavior at the park. -What level of enforcement/ supervision should be present at the park? City Council and Cite Manager FROM- Roger Nasset, Chief of Police Mike Baker, Parks and Recreation Director FETING DATE- April 28. 2008 BACKGROUND NI : In 2003 the City of Kalispell opened the Kalispell Skate Park at woodland Park. Since its inception we have seen a dramatic rise in criminal complaints associated with the skate park, its users and acquaintances of the users. The complaints range from threats, vandalism, indecent exposure, disorderly conduct, assaults, underage drinking, multiple park violations, drug possession and sales and traffic complaints. our police officers responded to the skate park over 90 times between May and September of 2007, The Parks and Recreation Department has also spent multiple hours picking up litter, repairing vandalism, replacing signs, and removing graffiti. Several attempts have been made to mitigate the above mentioned culture. Parks and Recreation has attempted to monitor the skate park with a camera system.; the camera has been vandalized several tunes since its installation. Additionally, an attempt was made by Parks and recreation to provide supervision to monitor the park, and to promote positive interaction. After the first season, these workers refised to return and subject themselves to the disrespect, vandalism to one of their vehicles and threats from the park users. I can tell you that from the Kalispell police officers' prospective, responding to the skate park or doing proactive patrol of the skate park is amongst their most undesirable duties because of the negative culture and disrespect. We are bringing this natter to you for recommendations and direction on the level of community standards we are willing to enforce. It is our intention to maintain. a positive relationship with the youth and adults who use and visit the skate park, but I also believe we must have a strong commitment to enforcing quality of life standards for these users if we are to be successful in providing a favorable atmosphere for all visitors to woodland Park. It is very disturbing to learn that pool users and woodland Park visitors have been intimidated to the point they do not wish to subject themselves and/or their kids to the culture emanating from the skate park. With all of this being said, I feel the spate park is an asset to the city and a great recreational opportunity for the young people of our community. We all know that 80% of the users are not the issue but it is the other 20% that have forced us to ask for your direction on use, enforcement and standards for the park. Indecent Conduct: No threatening, profane, abusive, disorderly, insulting or indecent language, conduct or behavior or any act tending to a breach of the public peace shall be allowed in or upon any park or public grounds, nor shall any person play games of chance, drink intoxicating liquor or be drunk or do any indecent or improper act therein. B. Intoxicating Liquors: No person shall take into or upon any park, nor into or upon any public grounds, any intoxicating liquors, either for sale to others in such park or public grounds, nor shall any person sell, give away or in any way dispose of any intoxicating liquor in or upon ,-cmy park or public grounds. C. Removal of Person: Any drunk or disorderly person or any person doing an act injurious to the park or public place in which he or she then is or who is in the act of violating any rules or regulations of the board of park commissioners or any ordinances of the City, may be removed from. such park or public place by the keeper thereof or by any police officer of the City. D. Hours: City parks shall be posted as open at 6:00 a.m. everyday and closed at 11:00 p.m. everyday. It shall. be unlawful for any person to remain in any City park during the time when it is closed. E. Park Access Restricted: Upon making a finding of guilty, to a violation of any portion of this section, the Municipal Court Judge may, in addition to all other sanctions permitted, order that the violator be restricted from access to any of the City parks for a period of yap to one hundred eighty (190) days_ F Woodland skate Dark: The roles and regulations of the Woodland Skate Park shall be posted in a clearly visible portion of the skate park., stating that the skate park is not supervised and participants shall skate at their own risk. The rules and regulations of the skate park are as follows: 1. All participants must wear appropriate safety gear: CSA approved helmets and footwear are mandatory. Helmets must fit properly with straps fastened. Pads, gloves and guards are strongly recommended. 2. The surface is extremely dangerous when wet; the park will be closed during inclement weather or if surface and equipment are vet. �. Alcohol, drugs and tobacco are prohibited in and around this facility. 4. All food and drinks are prohibited inside the fenced area. Please use trash containers to keep your park clean and safe. 5. No animals are allowed inside the fenced skate park area. 6. Skateboards, BMX bikes, and in -line skates allowed only during designated times. 7. All BMX bikes must be equipped with protective covering on pegs. 8. Children under the age of ten 10) years old must be accompanied by an adult. 9. Due to safety concerns, spectators who are not skating may not enter the skate park while activity is in progress and must remain outside the fence. 10. Hours of operation are from. one --half (1/2) hour before sunrise to one-half (112) hour after sunset unless otherwise posted. The Department of Parks and Recreation reserves the right to change the schedule as necessary. (see posted hours of operation.) 11. Section. I9-20 of the Kalispell City Code shall be and is hereby amended by adding the following paragraph: E . SKATES, COASTERS OR SCOOTERS UPON CERTAIN PUBLIC RIGHT OF WAYS IN CERTAIN ,AREAS- OF THE CITY OF KALISPELL, AND PRIVATE PROPERTY WHERE SIGNED, PROVIDING A PENALTY FOR VIOLATION AND PROVIDING AN EFFECTIVE DATE, SECTION I. PROHIBITION IN CERTAIN AREAS: No person shall operate or ride on a skateboard, roller blades, roller skates,, coasters or scooters on any of the following areas: ( A ) Any street or alley. (B) Parking lots owned or leased by the City of Kalispell. (C) On any public or private property where signs have been posted at the entrance or displayed prominently on the property prohibiting the use of skateboards. (D) On any sidewalk running parallel to- the following streets ("sidewalk" meaning on both sides of the street) : 1. SECTION III, SEVERABILITY CLAUSE: If any section, subsection, para- graph, sentence, clause, or phrase of this Chapter, or any part thereof, or application thereof to any person, firm, corporation, public agency, or circumstarice, is for. azy-vreason held to be unconsti- tutional or invalid or ineffective by, any court of competent jurisdiction, such decision shall t effect the validity or effective- ness of the remaining portions o this Chapter or any part thereof. It is hereby declared to be tyre legislative intent of the City of Kalispell that this chapter wok€ld have been adopted had such unconstitu- tional or invalid provision, clause, sentence, paragraph, section, or part thereof not then been included. SECTION IV. This Ordinance shall become effective 30 days from and of ter its passage by the City Council and approval by the Mayor.
