SUBJECT Creation of a Kalispell City Planning Board and Zoning
Commission

BACKGROUND: Recent actions by the Board of County Commissioners on December
17, 2001 disbanding the joint planning board for Kalispell planning jurisdiction raises
several issues some of which are not easily or clearly resolved. One issue is providing
a mechanism to address pending applications for projects within the city limits that
would normally come before the Kalispell City -County Planning Board. It is
somewhat apparent that there will be no `regular" joint planning board meeting on
January 15, 2002. The Board of County Commissioners apparently do not intend to
appoint board members to the Kalispell City -County Planning Board to attend the
January 2002 meeting. It was their apparent intent to appoint two members
currently serving on the board (or others) from within the unincorporated area of the
Kalispell planning jurisdiction to sit on the Flathead County Planning Board,
expanding that board from nine to 11 members. That action was scheduled for
December 18, 2001, but has apparently been postponed until December 27, 2001.
In any event it leaves the issue of planning board review of pending city applications,
and how they will be brought through the planning board review process unresolved.
Under the state statutes there is a provision for the creation of the planning board
and for the creation of a zoning commission. The role of the planning board is to
prepare a growth policy plan and to review subdivision plats (76-1-106). The role of
the zoning commission is to recommend zoning districts and regulations (76-2-307).
Although they can be two separate boards, there is a provision in the statutes for the
city county planning board to serve as the zoning commission. Kalispell's planning
board has functioned as the zoning commission and it is so stated in the Kalispell
Zoning Ordinance.
After some discussion among the staff it seems rather apparent that the city council
will need to create a planning board to review pending applications. The staff would
suggest that the council create an "interim" Kalispell City Planning Board and Zoning
Commission. An interim board is suggested because the exact legal status of the
actions taken by the Board of County Commissioners and hence the status of the
planning board and the planning jurisdiction boundaries are in question. Once those
issues are more clearly resolved and/or the council has established a clear direction

regarding how these issues may be addressed, the city planning board may become a
permanent entity. In the meantime, an interim board may be a prudent approach to
avoid any indication that the Kalispell City Council acquiesces to the actions taken by
the county commissioners and/or the consequences it may have regarding planning
jurisdiction boundaries.
The Montana statutes have a provision for the creation of planning boards, under
Sections 76-1-101 through 76-1-113. In addressing the current situation and the
need for a planning review board Section 76-1-105 states that "prior to passing an
ordinance creating a city planning board, the city council shall notify in writing the
county commissioners of the county in which the city is located of their intention to
form a city planning board. The board of county commissioners shall elect to form a
city -county planning board or to permit the city to form a city planning board and
shall notify in writing to city council of its election with 30 days from receipt of notice
of the city's intention to form a planning board. In the event the county
commissioners so elect, the planning board to be formed shall be a city -county
planning board."
The city manager has drafted that letter for the commissioners' review to address the
statutory requirements for the creation of the board as it relates to notice to the
county. The county commissioners have accordingly responded by acknowledging it
is their desire to see a "city" planning board formed.
Sections 76-1-201 through 76-1-224 address the membership of the planning boards.
Section 76-1-223, County representative for city planning board, allows the board of
commissioners 45 days to designate a representative of the county for appointment to
the city planning board. The commissioners have also acknowledged that they intend
to appoint a county representative. Section 76-1-221, Membership of city planning
board, addresses board appointments further as follows:
The board shall consist of seven members
• One member to be appointed by the city council from the council membership.
• One member to be appointed by the city council who may be an employee or hold
public office in the city or county.
• One member to be appointed by the mayor upon designation by the county
commissioners. Or if the county elects not to appoint a representative, the mayor
may appoint a person at her sole discretion as a representative of the county.
• Four citizen members to be appointed by the mayor who are resident freeholders
within the city limits.
The language in the statutes is somewhat different than that noted above, specifically
with regard to the four mayoral appointments. The statutes actually state that the
mayor will appoint four citizen members, two of whom shall be resident freeholders
"within the urban area, if any, outside the city limits over which the planning board
has jurisdiction." Since in this case there would be no urban area outside the city
limits over which the planning board has jurisdiction, all of the citizen members

appointed by the mayor would need to be property owners and residents of the city.
Additionally, it may be noteworthy that the statutes do not require the county
representative appointed by the mayor to reside in the county portion of the planning
jurisdiction, but simply to be appointed as a representative of the county.
It appears that in order to create a city planning board the city council will need to
pass an ordinance. That ordinance will require a Furst and second reading. If the first
reading is adopted on December 26, 2001, a second reading could be done on
January 7, 2002. The ordinances require a 30 day effective date. This situation
requires that the ordinance creating the city planning board be an emergency
ordinance so that it can become effective immediately. The emergency ordinance is
effective for 90 days. At the January 7, 2002 regular city council meeting, the city
planning board board appointments can be made and the city planning board will be
in place for the January 15, 2002 meeting. The January planning board meeting was
changed at the December joint planning board meeting from January 8, 2002 to
January 15, 2002 in order to accommodate new board appointments.
It is important to note that the city planning board will be a brand new board and the
joint planning board will not be a consideration. Therefore, at least six and maybe
seven board members will need to be appointed at that January 7, 2002 meeting in
order to create the Kalispell City Planning Board and Zoning Commission. The
commissioners have indicated that they intend to appoint a county representative to
the planning board that will be confirmed by the mayor. In the event that the county
has not selected a representative to serve on the city planning board, the appointed
six member board would still constitute a quorum and could conduct the required
business.
With the joint planning board remains in limbo, there are two city representatives on
the joint planning board, Ron VanNatta and Don Mann, whose terms do not expire
until December 31, 2003. When solicitations for planning board members were done
in November and December of this year it was to fill two terms on the joint planning
board that were expiring. Now, if the city council would like to appoint those
members from the joint planning board whose terms have not expired, those members
would need to submit a letter of interest to be appointed to the city planning board or
be nominated by a member of the council. The council may also want to consider
soliciting additional potential city planning board members up until the first week in
January 2002. There were six people who applied for a position on the joint planning
board whose letters of interest have been forwarded to the city clerk under separate
cover.
Conclusion: There may be other options to creating an interim Kalispell City
Planning Board and Zoning Commission such as having the city council act as the
review body for planning and zoning matters. The city council could hold the public
hearings and simply rely on the staff report for a recommendation. However, the
Kalispell Subdivision Regulations and the Kalispell Zoning Ordinance specifically
designate the Kalispell City -County Planning Board and Zoning Commission as the
review body for the subdivision plats, conditional use permits, zone changes and text

amendments. It seems a simpler process and more in keeping with the established
review process to create a city planning board to handle the public hearings and to
provide a recommendation to the city council.
There appears to be an opportunity to go through the necessary procedures to
establish a Kalispell City Planning Board and Zoning Commission between now and
the January planning board meeting in order to facilitate the review of pending
applications. Should the city council decide that another approach to resolving this
issue is more appropriate, additional time may be necessary to establish an
administrative process.
RECOMMENDATION: The staff would recommend that the city council adopt an
ordinance on first reading establishing an interim city planning board that would also
function as the zoning commission to be known as the Kalispell City Planning Board
and Zoning Commission.
ALTERNATIVES: As suggested by the city council.

AN EMERGENCY ORDINANCE ESTABLISHING AN INTERIM KALISPELL CITY
PLANNING BOARD AND ZONING COMMISSION; AND ESTABLISHING AN IMMEDIATE
EFFECTIVE DATE AND LIMITED 90 DAY DURATION.
WHEREAS, neither City of Kalispell nor the County of Flathead,
Montana have, by majority of those voting, adopted a
self-government charter superior to statutory provisions
as provided for in Art. XI, H 5 and 6 Mont. Const.
(1972) (or as same may have been provided for under the
Montana Constitution adopted and ratified in 1889); and
WHEREAS, on June 2, 1958, by Ordinance No. 663, the Kalispell City
Council created "a combined City and County Planning
Board" in conjunction with the County of Flathead,
Montana pursuant to and under the provisions of Chapter
246, Laws 39"'Montana Legislative Assembly, 1957. (Title
11, Ch. 38 R.C.M., 1947); and
WHEREAS, in 1961-1962, under contract for the Montana State
Planning Board and the Kalispell City -County Planning
Board, Planning Consultant Ronald Thompson and
Associates, City and Regional Planning and Economic
Research, Butte, Montana and the Kalispell City County
Planning Board prepared a City -County Master Plan
"Project No. Montana P.611 denominated: "Master Plan -
Kalispell and Flathead County / City - County Planning
Board 1962"; and
WHEREAS, subsequently, the Montana Legislative Assembly twice
amended certain provisions of Chapter 246, Laws of the
35th (1957), first at Chapter 247, Laws 38th Montana
Legislative Assembly, 1963, and again at Chapter 189,
Laws 38th Montana Legislative Assembly, 1965; and
WHEREAS, on November 8, 1965, by Ordinance No. 725, the Kalispell
City Council repealed City Ordinance 663 and created "a
combined City and County Planning Board" pursuant to and
under the provisions of Title 11, Chapter 38, Revised
Codes of Montana, 1947, as amended, Chapter 247 of the
laws of the 38`h Montana Legislative Assembly, 1963, and,
as amended, Chapter 189 of the laws of the 39th Montana
Legislative Assembly, 1965"; and
WHEREAS, on December 23, 1971, by Resolution No. 115, having
determined that it was in the best interest of Flathead
County to plan "the area adjacent to the City of
Kalispell" and that the City Council of Kalispell had
already approved same, the Flathead County Commission
approved the planning board's proposal and expanded the
Kalispell City -County Planning Board jurisdictional area
to its current size; and
WHEREAS, on or about December 23, 1971, the Flathead County
Commission and the City of Kalispell revised and expanded
the Kalispell City -County Planning Board jurisdictional
area to its current size; and
WHEREAS, on November 28, 2001, by Resolution No. 1539, the Board
of County Commissioners gave notice of their intention to
hold a public hearing on December 17, 2001 to receive
comments on their recent proposal to withdraw from the
Kalispell City -County Planning Board and attempt to
unilaterally eliminate the extraterritorial jurisdiction
of that board; and
WHEREAS, at the public hearing on December 17, 2001, the Board of
County Commissioners of Flathead County passed Resolution
No. 1543, unilaterally, purporting to withdraw from the
Kalispell City -County Planning Board and eliminate the
extraterritorial jurisdiction of that board without
concurrence of the Kalispell City Council; and
WHEREAS, Kalispell City Ordinance § 2-25 provides that in the
event of an emergency, in response to such emergency, the
City Council may pass an Ordinance, effective
immediately, when such a measure is immediately necessary
to preserve peace, health and safety of the City or its
residents; and
WHEREAS, since the aforementioned actions of the Flathead County
Commissioners have created such emergency by leaving
unresolved the issue of the City's process for
statutorily required planning board review of pending and
new applications for projects that would normally
otherwise come before the Flathead County City -County
Planning Board, but for the recent actions taken by the
Flathead County Commissioners described above; and
WHEREAS, a majority of the Flathead County Commissioners have
clarified their intentions concerning the creation of the
Interim Kalispell City Planning Board and Zoning
Commission in writing (see Exhibit A, attached); and
WHEREAS, it is in the best interest of the City of Kalispell that
an interim Kalispell City Planning Board and Zoning
Commission be established in order to temporarily review
such pending and new applications for projects that would
otherwise normally come before the Flathead County City -
County Planning Board, to continue to meet our planning
needs.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL, MONTANA, AS FOLLOWS:
SECTION I. That an emergency is declared to exist in the
City of Kalispell due to the adverse effect
that the previously described deletrious
conditions presently have upon the health,
safety and welfare of the community.
SECTION II. That an interim Kalispell City Planning Board
is hereby established with seven (7) members,
in order to temporarily review pending and new
applications for projects that would normally
otherwise come before the Flathead County
City -County Planning Board, to continue to
meet our planning needs on an interim basis.
SECTION III. This Ordinance shall be effective immediately
upon the date of its final passage and
approval and shall expire by its own terms and
operation of law from and after 90 days of its
passage by the City Council.

This letter requests clarification of the expressed intention of Flathead County Commission in one
provision only of Resolution No. 1543 enacted and effective December 17", 2001, entitled
"Resolution to Withdrawfrom the Kalispell City County Planning Board and Eliminating the Extra
Territorial Area Within Flathead County of Such Planning Board." Limiting this request for
clarification solely to the language contained in the final paragraph of resolution No. 1543, which
reads as follows:
BE IT FURTHER RESOLVED that if it so desires, the City may create a city
planning board without the participation of the County as allowed under MCA § 76-
1-105.
The City of Kalispell seek confirmation of its present interpretation of the above cited language, that
the Commissioner's intention expressed therein is to permit the City of Kalispell to form a new city
planning board immediately, thus minimizing the disruption in new and pending application
processing by the City that might otherwise occur as a result of and because of the transition
proposed in Resolution No. 1543 and 1544.
Specifically, we understand thatunder the above cited language the Flathead County Commissioners
acknowledge receiving notice from the City of Kalispell of its intention to form a city planning
board and have elected during the allowed 30 day response time not to form a city -county planning
board, and that this confirmation, evinced by the signatures appearing below, satisfies the
requirement of MCA § 76-1-105(2) that the Flathead County Board of Commissioners have notified
the City of Kalispell in writing that the Flathead County Board of Commissioners has elected not
to form a city -county planning board for purposes of MCA § 76-1-105.
Please also indicate by selecting where indicated one (1) choice only, as set forth immediately
below, whether the Flathead County Commissioners intend, pursuant to MCA § 76-1-223 to
designate a representative of the county for appointment to any new city planning board created, or
not.
Ve The Flathead County Commissioners DO intend, pursuant to MCA § 76-1-223 to
