SUBJECT: Acting City Attorney Appointment
MEETING DATE: September 17, 2001
BACKGROUND: Pursuant to Ordinance 1166 Section 2-3, Duties ofthe Mayor, "Appoint, with
the consent of the City Council, all members of the advisory boards and commission, and the City
Attorney", it is my recommendation that Charles Harball be appointed Acting City Attorney. I have
spoken with Mr. Harball and he has agreed to fill this position for this period of time. In addition,
I would ask that the position for permanent City Attorney be advertised in the Montana Lawyer, a
publication received by all members of the Bar Association and a standard advertising strategy for
filling attorney positions.. Following the advertising procedure, a permanent City Attorney needs
to be selected as soon as possible since Mr. Harball does not meet the requirements of the City
Attorney position, specifically he does not live within the City limits.
RECOMMENDATION: The City Council approve the recommendation to appoint Charles
Harball as Acting City Attorney.
