Ordinance 1394 Amending Ordinance 1166 Altering the Rotation of Council Vote
Including the Mayor
MEETING DATE: September 4, 2001
BACKGROUND: The City ofKalispell's City Council and administration are guided by Ordinance 1166
which established an Administrative Code. During the July 16, 2001 Council workshop the Council directed
me to bring forward several amendments to the Administrative Code. The attached amendment alters the
rotation of Council vote and includes the Mayor in the rotation.
In researching this issue, it is common to have the Chairman vote last however, this is often accompanied by
the fact that the Chairman only votes in circumstances that involve a tie vote by an even numbered Council
body. In addition, it is believed that Kalispell's presiding officer has always voted last because he/she is
elected at large, however, there is nothing in Montana law or Roberts Rules of Order requiring it.
RECOMMENDATION: The City Council approve Ordinance 1394 on first reading.
FISCAL EFFECTS: No fiscal effect.
ALTERNATIVES: As suggested by the Council.

AN ORDINANCE AMENDING CHAPTER 2, ADMINISTRATION, KALISPELL
MUNICIPAL CODE BY AMENDING ORDINANCE 1166, 9 2-14(e) ALTERING THE
ROTATION OF COUNCIL VOTE AND INCLUDING THE CHAIRMAN IN THE
ROTATION; AND AUTHORIZING THE CITY ATTORNEY TO RECODIFY 9 2-14 (e)
IN ACCORDANCE WITH THIS ORDINANCE AND DECLARING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL,
MONTANA AS FOLLOWS:
SECTION I. That Ordinance No. 1166, 9 2-14 (e) (9 2-
14(e), Kalispell City Code) is hereby amended
to read as follows:
VOTING PROCEDURE
(e) The Clerk in calling the roll call vote shall rotate the
call each vote to members of the Council present, and
shall include the chairman in the rotation.
SECTION II.
That the City Attorney is hereby authorized and directed to
recodify § 2-14 (e), in accordance with this Ordinance.
SECTION III.
This Ordinance shall take effect 30 days from and after its
passage by the City Council.
