SUBJECT: Annexation of a small tract to finalize NW Tracts Addition Annexation of 1989
MEETING DATE: September 4, 2001
BACKGROUND: The 1989 Northwest Tracts Addition No. 234 Annexation failed to include a
small sliver of land due to an error in survey. This small piece, approximately 10 feet by 176
feet, is the subject of the annexation referenced in Resolution 4652.
RECOMMENDATION: Annex property excluded in the original Northwest Tracts Addition
No. 234 annexation
ACTION REQUESTED: A MOTION TO APPROVE RESOLUTION 4652, A RESOLUTION
AMENDING RESOLUTION NO. 3877, NORTHWEST TRACTS ADDITION NO. 234, BY
CORRECTING THE LEGAL DESCRIPTION CONTAINED IN SAID RESOLUTION, AND
DECLARING AN EFFECTIVE DATE.

RESOLUTION NO. 4652
A RESOLUTION AMENDING RESOLUTION NO. 3877, NORTHWEST TRACTS
ADDITION NO. 234, BY CORRECTING THE LEGAL DESCRIPTION CONTAINED IN
SAID RESOLUTION, AND DECLARING AN EFFECTIVE DATE.
WHEREAS, on June 5th, 1989 the City of Kalispell passed
Resolution No. 3877 annexing three tracts of land
commonly known as the Northwest Tracts Addition No.
234, and
WHEREAS, the Exhibits attached thereto as "A", "A-1" and "A-
2" omitted a small sliver of property approximately
10 feet wide and 176 feet long due to a surveying
error, and
WHEREAS, in order to correct the error the Council considers
it advisable to pass a Resolution amending
Resolution No. 3877.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL, AS FOLLOWS:
SECTION I. That Resolution No. 3877 is hereby amended by
including therein the legal description
contained in Exhibit "A-3" attached hereto and
thereby made a part hereof.
SECTION II. All parts and portions of Resolution No. 3877
not amended hereby shall remain the same.
SECTION III. This Resolution shall take effect immediately
upon passage by the City Council.
PASSED AND APPROVED BY THE CITY COUNCIL AND SIGNED BY THE MAYOR OF
THE CITY OF KALISPELL THIS 4TH DAY OF SEPTEMBER, 2001.

Two tracts of land located in the SE 1/4 of Section 1, Township 28
North, Range 22 West, P.M.,M. Flathead County, Montana described as
follows:
TRACT 1
The south ten feet of Lot 8, Block 2 of the Sunset Addition
according to the plat on file with the Clerk and Recorder of
Flathead County, Montana.
TRACT 2
Beginning at the SE corner of Lot 2 of the Brady Addition according
to the plat on file with the Clerk and Recorder of Flathead County,
Montana, thence N 89000,231, E a distance of 60.04 feet to a point
on the easterly boundary line of Northern Lights Boulevard, thence
southerly on and along the east boundary line of Northern Lights
Boulevard to the NW corner of Lot 7, Block 1 of the Sunset Addition
according to the plat on file with the Clerk and Recorder of
Flathead County, Montana, thence westerly to the NE corner of Lot
7, Block 2 of the Sunset Addition, thence northerly on and along
the west boundary line of Northern Lights Boulevard to the Point of
Beginning.
