SUBJECT: Annexation - City Service Tract No. 8PA (20-28-21)
MEETING DATE: November 5, 2001
BACKGROUND: The subject property (Tract 8PA) is located on the east side of 3`d Avenue
East across from the Southfield Park development and is currently owned by NW Investment
Partnership. In 1997, the area was annexed into the city. This tract was part of the annexation
proposal throughout the process, including the public hearing, but was apparently accidentally
omitted from the final resolution. The purpose of this resolution is essentially a housekeeping
item to correct that omission. Dick Dasen was contacted regarding the situation, and had no
objection on behalf of the partnership.
RECOMMENDATION: The Council move to approve annexation of the property.
FISCAL EFFECTS: Minor positive impact.
ALTERNATIVES: As suggested by the Council.

RESOLUTION NO. 4668
A RESOLUTION AMENDING RESOLUTION NO. 4345, CITY SERVICES, INC./
MONTANA GOLD BULLET, INC. ADDITION NO. 282, BY CORRECTING THE LEGAL
DESCRIPTION CONTAINED IN SAID RESOLUTION, AND DECLARING AN
EFFECTIVE DATE.
WHEREAS, on July 21, 1997 the City of Kalispell passed
Resolution No. 4345 annexing various tracts of land
commonly known as the City Services, Inc./Montana
Gold Bullet, Inc. Addition No. 282, and
WHEREAS, Exhibit "A" attached thereto omitted one tract of
land due to a typographical error, and
WHEREAS, in order to correct the error the Council considers
it advisable to pass a Resolution amending
Resolution No. 4345.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL, AS FOLLOWS:
SECTION I. That Resolution No. 4345 is hereby amended by
including therein the legal description
contained in Exhibit "A-1" attached hereto and
hereby made a part hereof.
SECTION II. All parts and portions of Resolution No. 4345
not amended hereby shall remain the same.
SECTION III. This Resolution shall take effect immediately
upon passage by the City Council.
PASSED AND APPROVED BY THE CITY COUNCIL AND SIGNED BY THE MAYOR OF
THE CITY OF KALISPELL THIS 5TH DAY OF NOVEMBER, 2001.
