BACKGROUND: The applicants are proposing to allow an accessory apartment in conjunction
with an art studio on property zoned B-1, Neighborhood Buffer District. This zoning district lists
accessory apartments as a conditionally permitted use. This property where this use is proposed
contains approximately 6,100 square feet, slightly under a typical city lot because a portion of the
northeast comer of this property was acquired for right-of-way when Highway 93 was extended
north. The property address is 494 N. Main Street, Kalispell and is located south of California
Street on the west side of Main Street. The use is proposed as a second story apartment over an
art studio that would be in addition to the office building that currently exists on the property as
a separate structure. The existing office building to the east of the site is approximately 700
square feet. The new office building to the west of the site will contain approximately 780 square
feet and the apartment above will contain approximately 835 square feet. The applicants would
live in the apartment above the art studio where Mr. Clayborn will run his business. The
existing building would be rented as an office or similar use.
A public hearing was held before the Kalispell City County Planning Board on February 13, 2001
The applicant spoke in favor of the proposal, one letter of support was submitted. No one spoke
in opposition. The planning board is recommending approval of the conditional use permit.

The Kalispell City -County Planning Board and Zoning
Commission, after due and proper notice, on February 13, 2001 held
a public hearing on the application, took public comment and
recommended that the application be approved subject to seven
conditions.
After reviewing the application, the record, the FRDO report,
and after duly considering the matter, the City Council of the City
of Kalispell, pursuant to the Kalispell Zoning Ordinance, hereby
adopts Flathead Regional Development Office, Conditional Use Report
#KCU-01-1 as the Council's findings of fact, and issues and grants
to the above -described real property a conditional use permit to
construct an accessory apartment in the B-1, Neighborhood Buffer
District subject to the following conditions:
1. That the proposal will be developed in substantial
conformance with the approved site plan.
2. That all of the stormwater generated from the new
construction will be maintained on -site.
3. That a small apron be provided along the parking lot to
the north to provide an adequate back-up area.
4. That all of the parking areas be paved in accordance with
a plan approved by the Kalispell Public Works Department.

The Kalispell City -County Planning Board met on February 13, 2001, and held a public hearing
to consider a request by James and Leslie Clayborn for a conditional use permit to allow an
accessory apartment in conjunction with an art studio on property zoned B-1, Neighborhood
Buffer District. This zoning district lists accessory apartments as a conditionally permitted use.
Narda Wilson of the Flathead Regional Development Office presented staff report KCU-01-1
evaluating the conditional use permit proposal. The staff recommended approval of the
application subject to conditions.
At the public hearing Jim Clayborn spoke in favor of the proposal, no one spoke in opposition.
The board discussed the request and reviewed the criteria. A motion was made to adopt staff
report KCU-01-1 as findings of fact and forward a recommendation of approval of the conditional
use permit subject to the amended conditions found in Attachment A.

RECOMMENDED CONDITIONS OF APPROVAL
FEBRUARY 13, 2001
The Kalispell City -County Planning board is recommending the following conditions to the
Kalispell City Council for the above referenced conditional use permit approval request. A public
hearing was held on this matter at the February 13, 2001 planning board meeting.
1. That the proposal will be developed in substantial conformance with the approved site plan.
2. That all of the stormwater generated from the new construction will be maintained on -site.
3. That a small apron be provided along the parking lot to the north to provide an adequate
back-up area.
4. That all of the parking areas be paved in accordance with a plan approved by the Kalispell
Public Works Department.
5. That the project be reviewed and approved by the Kalispell Fire Department for
compliance with the uniform fire code.
6. That the sidewalk and landscaping in the public right-of-way be coordinated with the
Kalispell Parks and Recreation Department.
7. That the conditional use permit shall terminate 18 months from the date of authorization of
commencement if the authorized activity has not begun.
MOTION Garberg moved and Van Natta seconded to adopt staff report
KZTA-01-1 as findings of fact and, based on those findings,
recommend to the Kalispell City Council that the Kalispell

OARD DISCUSSION Mann asked why 3,000 square feet was originally put in and
Wilson said it was based on neighborhood character, feel and
scale.

district lists accessory apartments as a conditionally permitted
use. This use is proposed as a second story apartment over an
art studio that would be in addition to the office building that
currently exists on the property as a separate structure. The
existing office building to the east of the site is approximately
700 square feet. The new office building to the west of the site
will contain approximately 780 square feet and the apartment
above will contain approximately 835 square feet. The
applicants would live in the apartment above the art studio
where Mr. Clayborn will run his business. The existing
building would be rented as an office or similar use. Staff
reviewed the criteria and recommended the Kalispell City
County Planning Board adopt the findings of fact and forward a
recommendation of approval to the City Council. The only
comment received was a letter of favorable input.
PUBLIC HEARING The public hearing was opened to those who wished to speak
on the proposal.
PROPONENTS Jim Clayborn, 820 3*d Ave. West, said Wilson outlined the
proposal and hopefully it would be passed. He said they would
do a nice building on their property.
OPPONENTS No one wished to speak and the public hearing was closed.
MOTION Mann moved and Sipe seconded to adopt staff report KCU-0I-1
as findings of fact and recommended the Kalispell City Council
grant the conditional use permit subject to the 7 conditions
recommended by staff.
BOARD DISCUSSION Mann asked if Mr. Clayborn had a problem with any of the
conditions and Clayborn said no, they would do what they

needed to do to make the project go forward and to meet the
conditions.
There was discussion about condition 5. Heinecke stated
concern over the language regarding the fire hydrant. Wilson
said it was a standard condition and it would be more defined
as they went through their building plan review. She
suggested different language to that effect.
MOTION (AMENDED) Heinecke moved and Hines seconded to amend condition 5 to
read, "the project be reviewed and approved by the Kalispell
Fire Department for compliance with the Uniform Fire Code."
ROLL CALL On a roll call vote the amended motion passed unanimously.
BOARD DISCUSSION There was discussion about storm water discharge in condition
2. It was concluded that the City's policy was that any new
development not discharge any more water than what
previously left the site. The applicants were not expected to
clean up any problems already existing on the site, they simply
could not add to it.

OLD BUSINESS There was no old business presented.
NEW BUSINESS A joint work session with Kalispell City County Planning Board
and Board of County Commissioners was set for a noon
meeting on Thursday, February 22, 2001.
The possibility of a work session to discuss four or five items,
such as a transportation by pass, the master plan, joint
planning boards, and conduct of the meetings and public
hearings was discussed. The conclusion of the board was to
wait until after the Commissioner's meeting and all of the
board members were available to be present.
Hines said he was not pushing the growth plan but thought
they needed to show more interest in getting it off center.
Wilson said they had been working on it and moving forward.
ADJOURNMENT The meeting was adjourned on a motion by Sipe and seconded
by Hines at approximately 7:50 p.m. The next regular meeting
will be Tuesday, March 6, 2001 at 7:00 p.m.

D. Existing Land Use and Zoning: There is an existing small office building on the
property, which has a total square footage of approximately 700 square feet. It is
located near the east end of the site. The northeast comer of the building
encroached slightly into the right-of-way which occurred at the time the roadway
was widened and right-of-way was acquired. Once the new art studio and
apartment are built, the property owners intend to rent the existing building for
an office or other use. The current zoning on the property is B-1, Neighborhood
Buffer District, which lists accessory apartments as a conditionally permitted use
in the zone.

immediate area are a mix of residential and office uses.

H. Evaluation of the Request:
a. Adequate Useable. Spare: The property area contains approximately 6,100
square feet which is able to accommodate the existing building as well as the
proposed new art studio and apartment within the necessary setbacks while
accommodating the required parking for all of the uses on the lot. There is
adequate usable space for the project.
b. Adernia Access: Primary access to the site will be taken off of West
California Street on the north side of the property. This will access a small
shared parking lot. Access to the west end of the side will be taken from an
existing paved alley to another small parking lot for the new art studio and
accessory apartment. There may be a necessity to provide for a small
turnaround area on the access to the north to avoid cars backing out onto
West California Street.
C. Environmental Constraints: There are no obvious environmental constraints
associated with this property. Stormwater drainage would need to be
accommodated on -site, and it appears that there is adequate areas around
the buildings to provide for a natural absorption areas. There are no public
storm drainage systems in the immediate area.

a. Parking Scheme: The total office space for both the existing building and the
new art studio would generate a need for four parking spaces and the
accessory apartment would generate a need for two parking spaces for a total
of six parking spaces for the entire site. Parking areas have been broken
down into two areas each containing three spaces. A small parking lot will
be located on the north side of the site and accessed from West California
Street. Another small parking lot would be located on the west side of the
site and access from the existing paved alley. The small lot to the north
would provide the opportunity for some shared parking between the two
offices while the small lot to the west would serve as parking primarily for the
residence and the art studio. A turnaround area will be provided on the
small lot to the north to avoid cars backing out onto West California Street.
The proposed parking complies with the requirements and standards of the
zoning ordinance and functions adequately for the site.
Traffic Circulation: The existing art studio and proposed office use in the
existing building are generally lot impact uses with a minimal of traffic to
andfrom the site. As previously mentioned, traffic will enter the site from
either West California Street or the alley. Cars will have a small back-up
space on the lot to the north, while cars entering and exiting from the alley
parking lot will back directly into the alley. While backing out onto the alley
is not encouraged, it is not prohibited for residential uses or parking lots
with less than three spaces. There is a sidewalk on the east side of the site
along Highway 93. The applicant plans to install a sidewalk along the north
side of the property as part of this project. This will improve the pedestrian
circulation in the area. Traffic circulation is adequate.
b. Open Space: No specific open space requirements are applicable to this type
of use other than those associated with the required setbacks, which have
been adequately observed with the exception of the existing building to the
west which encroaches slightly into the right-of-way. This is a building that
was made nonconforming when the right-of-way was acquired and is not
subject to review as part of this application.
C. Fencing/ Screening/ T.andccaning: landscaping will be placed on the
property primarily on the north side of the site once the development has
been completed. The applicant will coordinate a landscape plan with the
Kalispell Parks and Recreation Director for the placement of street trees. No
screening or fencing appears to be necessary or appropriate.
d. Signag : The applicant does not currently propose signage in association
with this proposal. However, if at such time as signage is needed, a permit
would need to be obtained from the City of Kalispell.
e, Building Heig,ht And Design: Elevation drawings and floor plans were
submitted with the application and are included in the packet. The proposed
building would be approximately 25 feet in height with the accessory
apartment upstairs and the art studio downstairs. The building will be
oriented facing the north and will be residential in character. The building

height complies with the 30 foot limit of the B-1 zoning district and the
overall design of the building is complementary to the neighborhood
character.
a. Schools: This church is within the boundaries of School District #5.
Minimal if any impact on the school district can be anticipated as a result of
the proposed use.
b. Parks and Recreation: No apparent impacts to the Kalispell Parks and
Recreation Department appear to be associated with the proposed
expansion.
C. Police: This property will be served by the Kalispell Police Department. No
increased impacts to the police can be anticipated as a result of the proposed
expansion.
d. Fire Protection: Fire protection is provided by the Kalispell Fire Department.
The new building will comply with the Uniform Fire Code and applicable
building codes.
e. Water: City water currently serves the site. New service lines will be
extended to serve the proposed new uses. No significant impact on water
services provided by the City can be anticipated as a result of this use.
f. Sewer: Sewer service is provided by the City of Kalispell. No significant
impacts on City sewer services can be anticipated as a result of the proposed
use.
g. Solid Waste: Solid waste pick-up is currently provided by the City. No
separate garbage receptacle is proposed nor appears to be required. No
significant increased impacts can be anticipated as a result of the proposed
use.
h. Roads: Access to the site will be obtained from West California Street to the
north and from the paved alley to the west of the property. Traffic will be
generally limited and should not create significant impacts beyond what
currently exists. Roads in the area are adequate to accommodate the
proposed use(s).
i. Immediate Neighborhood impact: The general character of this
neighborhood is a mix of office and residential uses. Impacts associated with
the proposed and existing uses with regard to noise, traffic and hours of
operation will be minimal. The new building on the property will be a quality
addition to the area, complementary to the neighborhood and will enhance
the mix of uses and property values in the area. The proposed expansion
will have a positive impact to the neighborhood and contribute to
maintaining property values in the area.

A notice of public hearing was mailed to property owners within 150 feet of the subject
property approximately 15 days prior to the hearing. No one has contacted the FRDO
regarding this matter at the writing of the staff report.
1. The size and location of the site is adequate to accommodate the proposed and
existing uses on the property.
2. The design of the site with regard to access, parking, location of the buildings, and
setbacks is in compliance with the zoning and design standards of the City of
Kalispell.
3. Public services and facilities are adequate to accommodate the proposed and
existing uses with minimal impacts on those facilities.
4. The proposed new building and uses will be complementary to the neighborhood
and will help to maintain property values in the area.
It is recommended that the Kalispell City -County Planning Board adopt staff report #KCU-
01-1 as findings of fact and recommend to the Kalispell City Council that the conditional
use permit be granted subject to the following conditions:
1. That the proposal will be developed in substantial conformance with the approved
site plan.
2. That all of the stormwater generated from the new construction will be maintained
on -site.
3. That a small apron be provided along the parking lot to the north to provide an

Kalispell Zoning Text Amendment to B-1
Accessory Apartment to Art Studio in B-1 Conditional Use Permit — Main Street
The regular meeting of the Kalispell City -County Planning Board and Zoning Commission is
scheduled for Tuesday, February 13, 2001 beginning at 7:00 PM in the Kalispell City Council
Chambers, Kalispell City Hall, 312 First Avenue East, Kalispell. During the regularly scheduled
meeting of the planning board, the board will hold public hearings and take public comments on
the following agenda items. The board will make a recommendation to the Board of County
Commissioner or the Kalispell City Council who will take final action:
1. An amendment to the Kalispell Zoning Ordinance proposed by Village Plaza Development that
would amend Section 27.13.020(15), permitted uses in the B-1, Neighborhood Buffer Care
District. Specifically, the amendment would increase maximum allowable gross floor area of
"retail enterprises dispensing on premise commodities or food" from a maximum of 3,000
square feet of gross floor area to 4,000 square feet. This amendment would apply to any
properties with a B-1, Neighborhood Buffer District, zoning designation.
2. A conditional use permit request by James and Leslie Clayborn to allow an accessory apartment
in conjunction with an art studio on property zoned B-1, Neighborhood Buffer District. This
zoning district lists accessory apartments as a conditionally permitted use. This use is
proposed as a second story apartment over an art studio that would be in addition to the office
building that currently exists on the property as a separate structure. The property address is
494 N. Main Street, Kalispell and is located south of California Street on the west side of Main
Street. The property can be described as Lot 1, Block 238, Kalispell Addition 6 located in
Section 7, Township 28 North, Range 21 West, P.M.M., Flathead County, Montana.
Documents pertaining to these agenda items are on file for public inspection in the Flathead
Regional Development Office, 723 Fifth Avenue East, Room 414, Kalispell, MT 59901, and are
available for public review during regular office hours.
Interested persons are encouraged to attend the hearings and make their views and concerns
known to the planning board. Comments in writing may be submitted to the Flathead Regional
Development Office at the above address prior to the date of the hearing or you may contact Narda
Wilson, Senior Planner, for additional information.
