Agreement - Meridian Trail Connector
MEETING DATE: June 18, 2001
BACK GROUND: A modification to the CTEP General Project Development and
Construction Agreement for the Meridian Trail Connector has been requested by MDT.
The standard revision of the original design and construction
estimates is necessary upon submittal of the final design and engineers construction
estimates.
The trail begins at the intersection of Meridian Road and Highway
93, traveling along the west side of Highway 93 to the KYAC, then along Four Mile
Drive to the soccer fields. The trail is 5,235 feet in length, 8 feet wide, in accordance
with the current design and ADA requirements. Also inclusive is landscaping to plant
50 trees, install 5 pedestrian benches, a retaining wall and appropriate signing and
easement acquisitions.
After original Preliminary Engineering was completed, the project
scope was substantially increased to include an additional c 1,000 feet of trail with
landscaping and trees. Trail modifications were required to better serve the entire KYAC
site and accommodate handicap access. Modification of the Preliminary Engineering,
Construction and Construction Engineering costs are needed as follows:

RECOMMENDATION: Adopt and sign agreement Modification with the State of Montana
to include increase from $113,490.00 to $197,074.00.
FISCAL EFFECTS: Minimal. FY2002 budget is adjusted to accommodate the new estimates.
This increase in funding will not require additional dollars, as the CTEP
account has the funds from previous year's contributions to allow for this
adjustment.
ALTERNATIVES: As Councils recommends.

The Montana Department of Transportation has received your request to modify the General
Project Development and Construction Agreement.
After all original documents have been signed and sealed by the City Officials, return all
originals to the CTEP Office. After our Chief Engineer has signed all originals, we will
return one original to you, for your files. All Agreement changes are shown in bold type.
Under WITNESSETH, fourth paragraph:
WHEREAS, the total estimated cost of the project development and construction totals
$197,074; and,
Section 1. Will be modified to read:
"Design and construction for a pedestrian path that includes: sub -grade preparation and
asphalt surfacing for a path about 8-feet wide and approximately 5,235 feet in length in
accordance with current design standards and ADA requirements. Also included is
landscaping to plant about 50 trees, install 5 pedestrian benches, a retaining wall
construction, appropriate signing and easement acquisition."

The Local Agency will engage a project engineer for preliminary engineering, contract bid
document preparation and construction engineering. Construction will be by competitive
bid. The state will perform a final inspection to ensure substantial compliance with project
plans, specifications and estimates.
8. That the Federal participation in this project will be $170,627 and the Local Agency
will be responsible for the matching funds that total $26,447. The Local Agency will be
responsible for 100% of the project costs, exceeding the proposed $197,074, required to
complete the work described in item 1 above.
9. That the Local Agency may submit a claim detailing items and quantities of
acceptable work completed that period to the CTEP Engineering Coordinator, at most
monthly, for 100% of the project development and/or construction costs incurred.
Documentation will accompany the request substantiating the amount requested. The Local
Agency will also request State processing of the 86.58% federal participation reimbursement
payment that is not to exceed a cumulative amount of $170,627.
All other terms of the original agreement will remain in full force.
Upon receipt of the signed and sealed, agreement modification we will send you a notice
identifying the next step to be taken in the development of your project.
