SUBJECT: Sunny View SID
MEETING DATE: February 20, 2001
BACK GROUND: As a result of discussions yesterday with the parties involved in the SID, I am
requesting that the City Council "continue" the public hearing to the March 5, City Council meeting. During
last evenings neighborhood meeting, all of the parties in attendance agreed to work with the City prior to the
March 5 continuation in an effort to find an acceptable solution (i.e. will the city be a financial partner in the
project). After discussing the situation with MaeNan Ellingson, bond council, she recommends that we open
the public hearing in order to comply with our advertized public notice and than inform the public that the
public hearing will be reconvened during the March 5, 2001 regularly scheduled meeting.
RECOMMENDATION: The City Council not take any action regarding the Sunny View SID and
"continue" the public hearing during the March 5, 2001 city council meeting.

ALTERNATIVES: As suggested by the Council.

Dear Sirs:
I am protesting the creation of Special Improvement District No. 343 involving
Sunnyview Lane. My property borders it on the south but there is absolutely no reason
why my home should even be considered as part of the hospital district or this SID. My
only entrance to my property is accessed off Highway 93 North and has no approach or
access from Sunnyview Lane. Any improvements of Sunnyview lane will not affect my
property or property value. A jog has been made in the SID map just to enclose my
property. This is not fair or necessary. I request my property be removed from this SID
as it should not be applicable to my property. The city has road easements already for
Sunnyview Lane and should not involve my property.

Dear Duane, Theresa and Chris:
A few nights ago I received a call from Julia Evenson, a property owner adjacent to
the Kalispell Medical Arts building, advising of the creation of a Special
Improvement District #343 and an assessment for a road improvement, advising
her in turn that I was totally unaware of any process being enacted by the city of
Kalispell. I talked with Jim Oliverson, Vice -President of Northwest Healthcare, and
he was unaware of any documents, nor had the hospital received any and only
yesterday did I receive the official notification of the meeting tonight, February the
1511 and the closure date for written protest, tomorrow, February the 160.
I visited both with the hospital administrator, Velinda Stevens, and Jim Oliverson
this morning and neither of them had yet to see the documents regarding the
roadway construction and the specific assessment to the landowners along that
right-of-way.
This letter is to serve as notice that Kalispell Medical Arts at 210 Sunny View Lane
does vigorously oppose the creation of the Special Improvement District and the
assessment against this facility for tract 7EU and Kalispell Arts Addition #35/2 with
assessments totaling nearly $50,000.
A few months ago we received an inquiry as to whether or not we had an objection
for the hospital to realign Sunny View Lane to add additional space in front of the
hospital for building. At that time, there was only the reconfiguration of the road
to the north end of the hospital property and no mention whatsoever of additional
road improvements through the medical complex. Indeed, we had closed both of
our Sunny View Lane entrances to the Kalispell Medical Arts building with concrete
abutments to avoid the north/south traffic between Sunny View Lane and Conway
Drive because of patient/vehicle safety. We opened them only because of the
