SUBJECT: Contract Supplement #7, Meridian Road Project Design & Right of Way Acquisition
MEETING DATE: February 5, 2001
The Meridian Road Project has been in the works for many years. In April 1999
contract supplement #6 was approved so that the consultant could immediately begin all the work necessary
to acquire right of way for construction. Normally MDT staff would have performed this work. However
MDT was unable to do this because of an increased workload from the TEA-21 program. Since April
1999, the consultant's work has moved generally forward until about two months ago. At that point the
utility companies reassessed their ROW needs and additional ROW was specified. This change caused
significant concern because approximately one half of the affected parcels were negotiated and checks had
been issued completing the purchase. The additional requirement has been incorporated into the design and
now must be acquired. This has added unbudgeted costs for redesign along most of the project length, and
has required new negotiations for completed parcels. Supplemental funds are required for this added work.
Supplement #7 totals $48,551.84 and includes the costs of the primary engineering consultant and sub-
contracted costs of the right of way contractor. Approval of this supplement will raise the contract ceiling
to $820,841.14. We have reviewed the request and find the costs to be normal and consistent for the
intended work.
RECOMMENDATION: A motion to approve a Resolution for Supplement #7 raising the Meridian Road
design contract ceiling from $772,289.30 to $820,841.14.
FISCAL EFFECTS: There is no cost to the City of Kalispell. MDT pays all costs for design and right
of way acquisition after review by the City of Kalispell.

RESOLUTION NO. 4599
A RESOLUTION TO ALTER AND AMEND THE CONTRACT WITH ROBERT PECCIA AND
ASSOCIATES ON THE NORTH MERIDIAN ROAD RECONSTRUCTION PROJECT, STPU
6701(6).
WHEREAS, the City on October 10, 1995 did enter into a
contract with Robert Peccia and Associates, Helena, MT for the
reconstruction of North Meridian Road and
WHEREAS, certain elements in the project required additional
work, as well as time to complete; and said additional work and
time requirements could not have been necessarily foreseeable when
the original construction contract was entered into, and said
changes are contained in Exhibit "A", attached hereto and are by
this reference made a part hereof; and
WHEREAS, upon the advice and recommendation of Jim Hansz,
Public Works Director, it appears in the best interests of the City
to approve said changes and alterations.
NOW THEREFORE, pursuant to the provisions of Section 7-5-
4308(1) MCA be it hereby resolved:
1. The alterations and modifications of the contract between
the City of Kalispell and Robert Peccia and Associates, dated
January 17, 2001, as set out in Exhibit "A" attached hereto are
hereby approved, and
2. As soon as the alterations and modifications are agreed to
in writing, signed by the City Manager, as hereby approved by the
Council, this approval thereof shall be in effect.

THE CITY OF KALISPELL THIS 5TH DAY OF FEBRUARY, 2001.

Dear Jim:
Attached is a revised cost proposal for revising the plans and re -appraising
parcels to which an additional 1-meter of right-of-way was added. It is our
understanding that after utility plan -in -hands have been conducted, the MDT
Right -of -Way Bureau will determine whether or not it will be necessary to
reopen the nine closed parcels to obtain additional rights -of -way. For this
reason, reappraisal and renegotiations of the nine closed parcels was removed
from the original cost proposal. Negotiation of the remaining parcels will
continue during the re -appraisal of the 12 parcels that were not closed.
