BACKGROUND: This is a request for a conditional use permit to allow the expansion
of Shining Mountain church onto an undeveloped area of their property to the east of
the existing church building. The addition would be an extension of the east wall of
the existing building. The existing church building contains approximately 1,430
square feet. The new portion of the building will have approximately 1,643 square
feet with seating for up to approximately 150 people. The entire square footage of the
church with the existing and new addition would be approximately 3,073 square feet
when completed. The building will be one story in design with an overall building
height of less than 14 feet.
Shining Mountain Church is located at 475 Eight Avenue E.N. which is located on the
east side of Eight Ave E.N. and north of Oregon Street in Kalispell. The property is
zoned R-3, Residential which lists churches as a conditionally permitted use. The
property contains nearly one fulljl city block and is 142 feet wide and 200 feet long or
42,600 square feet (0.98 of an acre). This area can be described as residential in
character with commercial to the south that borders Idaho Street. There are also
apartments and multi -family dwellings in the area.
The Kalispell City -County Planning Board held a public hearing at their regular
meeting of November 13, 2001. The pastor spoke in favor of their proposal and no
one was there to speak in opposition. A motion was made and passed unanimously
to forward a recommendation that the conditional use permit for the expansion of
Shining Mountain Church be approved subject to the recommended conditions.
RECOMMENDATION: A motion to approve the conditional use permit for Shining
Mountain Church would be in order.
FISCAL EFFECTS: Minor positive impacts once developed.
ALTERNATIVES: As suggested by the city council.

The applicants have applied to the City of Kalispell for a
conditional use permit to allow for the expansion of an existing
church on undeveloped property located to the East of the church
property. The addition would be an extension of the east wall of
the existing building. It will be approximately 1,643 square feet
and would have seating for up to 150 people.
The Kalispell City -County Planning Board and Zoning
Commission, after due and proper notice, on November 13, 2001, held
a public hearing on the application, took public comment and
recommended that the application be approved subject to certain
conditions.
After reviewing the application, the record, the Tri-City
Planning Office report, and after duly considering the matter, the
City Council of the City of Kalispell, pursuant to the Kalispell
Zoning Ordinance, hereby adopts Tri-City Planning Office,
Conditional Use Report #KCU-01-06 as the Council's findings of
fact, and issues and grants to the above -described real property a
conditional use permit to allow the addition onto the existing
Shining Mountain Church, in a Residential, R-3 zoning district
subject to the following conditions:
SECTION I.
1. That the proposal will be developed in substantial
conformance with the approved site plan, which shall
govern the location of the buildings and access.
2. That the City of Kalispell Building Department and the
Kalispell Fire Department shall review and approve the
building plans and fire suppression system for compliance
with the applicable building and fire codes.
3. That a drainage plan utilizing on -site detention methods
shall be reviewed and approved by the Kalispell Public
Works Department.
4. This permit is valid for a period of 18 months after
which time it will terminate if commencement of
authorized activity has not begun. Activity can be
demonstrated by a continuous, good faith effort to secure
financing, permits, engineering and design.

Dear Chris:
The Kalispell City -County Planning Board met on November 13, 2001, and held a
public hearing to consider a request by Shining Mountain Church for a conditional
use permit to allow the expansion of their existing church. The property is zoned R-3,
Residential, which lists churches as a conditionally permitted use permitted use. The
expansion would be an extension of the east wall of the existing church building
church building which contains approximately 1,430 square feet. The new portion of
the building will have approximately 1,643 square feet with seating for up to
approximately 150 people. The entire square footage of the church with the existing
and new addition would be approximately 3,073 square feet when completed.
Narda Wilson, of the Tri-City Planning Office, presented staff report KCU-01-6
evaluating the proposal. No comments or inquiries had been received from the
surrounding neighbors. Staff recommended the conditional use permit be approved
subject to the conditions outlined in the staff report.
At the public hearing the pastor of the church spoke in favor of the proposal and no
one spoke in opposition.
After the public hearing the board discussed the proposal. A motion was made and
passed unanimously to forward a recommendation to the city council that the
conditional use permit for the church expansion be granted subject to the conditions
outlined on attached Exhibit A.

request for a conditional use permit for the expansion of an existing church. A public
hearing has been scheduled before the Kalispell City -County Planning Board for November
13, 2001, beginning at 7:00 PM, to consider this request. The planning board will forward a
recommendation to the Kalispell City Council for final action.

D. Existing Land Use and Zoning: There is an existing church on the property which
contains approximately 1,430 square feet and has a seating area for approximately 58
people. There is a parking lot located to the south and to the north of the existing
buildings. Two approaches onto Eighth Ave. E.N. currently exist. The church is open
weekdays from 10:00 AM to 2:00 PM, Wednesday evenings 7:00 PM to 9:00 PM and
Sundays from 8:00 AM to 6:00 PM.
E. Surrounding Zoning and Land Uses Zoning: This area can be described as residential
in character with commercial to the south that borders Idaho Street. There are also
apartments and multi -family dwellings in the area.
North: Single family residences, County R-1 zoning
South: Apartments, City RA-1 zoning
East: Single family residences, City R-3 zoning
West: Assisted living facility, City RA-1 zoning

F. Master Plan Designation: The Kalispell City County Master Plan Map designates this
area as urban residential. The plan itself anticipates the need for semi-public services
such as schools and services within residential districts. This proposal can be found
to be in substantial compliance with the master plan.

a. Adequate Useable She: There is approximately one acre of property the
church currently owns, but only about half of it is currently proposed for use
with the existing church, the expansion, parking and landscaping. There is
adequate usable space on the properly to accommodate the proposed
expansion.
b. Adequate Access: Access to the site is currently by way of two driveways onto
Eighth Ave. E.N. The driveways onto Eighth Ave. E.N. are two-way. The
roadway is a paved City street and provides adequate access to the site.
C. Environmental Constraints: There are no obvious environmental constraints
associated with this property or in the area such as floodplain or wetlands
areas, steep slopes or severe drainage problems. The site is nearly level and
there is adequate room on the site to accommodate on -site drainage retention.
A stormwater management plan will need to be reviewed and approved by the
Kalispell Public Works Department prior to the issuance of a building permit.
Appropriate Dnsig :
a. Parking Sc`hP*= Currently there are approximately 20 unpaved parking
spaces provided in conjunction with the existing church. This parking lies to
the north and south of the existing building. The proposed expansion of the
church will create a sanctuary that has a seating capacity for approximately
150 that will increase the need for additional parking. According to the
Kalispell Zoning Ordinance, one space per five seats is required for churches.
As such a total of 30 parking spaces will be required. The new parking
indicated on the site plan to the north of the new sanctuary and south of the
church shows 32 parking spaces. All of the parking and driving surfaces will
be required to be paved. There is adequate usable space on the property to
accommodate the parking needs for the church facilities.
b. Traffic Circulation: Traffic circulation for this property will not change once the
new church building has been constructed. Access to and from the property
can be obtained from the existing approaches onto Eighth Ave E.N. Although a

16-foot alley is indicated on the survey of this property and on the section map,
in reality, the alley does not exist and there are a number of encroachments
into the alley with fences, shed, parked vehicles and storage of other items.
Access by way of the alley is not feasible either as a primary or secondary
access. Furthermore, it is unlikely that the alley will be developed since it does
not have an outlet. The staff would recommend that the City consider
abandoning the alley which would give the property owners on either side an
additional eight feet of usable space.
C. Open Snare: No specific open space requirements are applicable to a church
use other than those associated with the required setbacks which have been
adequately observed on the site plan. Because of the large size of the parcel,
there is a significant amount of space on the site that is undeveloped. There
may be adequate space to create two additional lots on the property to the
south after the new building has been constructed and all of the required
parking has been developed.
d. Fencing '/Screening/Landsc aping: Mature landscaping currently exists around
the existing building which will generally be preserved with the addition to the
church. No additional landscaping, fencing or screening appears to be
necessary or appropriate.
e. Sigaage: There is an existing sign on the property which identifies the church
and no additional signage is proposed.
a. Schools: This church is within the boundaries of School District #5. No impact
on the school district can be anticipated as a result of the proposed expansion.
No school is proposed or currently operates in conjunction with the church.
b. Parks and Recreation: There are no City parks within the immediate proximity
of this property. It is unlikely that there will be any significant impacts to the
parks or the Kalispell Parks and Recreation Department associated with the
proposed expansion.
C. Enlice: This facility is currently served by the Kalispell Police Department. No
increased impacts to the police can be anticipated as a result of the proposed
expansion.
d. Fire Protection: Fire protection is currently provided by the Kalispell Fire
Department. There are hydrants currently in the area with one located at the
northeast comer of Eighth Ave E.N. and Oregon Street. At the time of building
plan review, the building will be reviewed for compliance with the Uniform Fire
Code. Access to the site and the building are good and it does not appear that
any modifications to the proposed site layout would be necessary to
accommodate the fire department's needs.
e. pater: City water currently serves the church, and no significant impact on
water services provided by the City can be anticipated as result of this
expansion.
f. Sewex: Sewer service is currently provided by the City of Kalispell.
Insignificant impacts on City sewer services can be anticipated as a result of the
proposed expansion.

g. Solid Waste: Solid waste pick-up is currently provided by the City. The refuse
containers are stored in the courtyard and moved to the street for pick-up as
necessary. No significant increased impacts can be anticipated as a result of
the proposed expansion.
h. Roads: Access to the property is currently provided to the site from two
approaches from Eight Ave E.N. Roadways in the area are adequate to
accommodate the expansion.
i. Immediate N ighhorhond Impart: The general character of this neighborhood is
residential with a significant amount of relatively high density residential in the
immediate area to the south. Limited hours of operation and occupancy are
associated with this church because it does not operate as a school, pre-school
or day care. Church services are generally limited to two days a week plus
occasional special events such as weddings and funerals. The church
expansion will not have significant impacts on the neighborhood with regard to
noise or hours of operation and will not have a negative impact on the character
of the area.
REACTION OF NEAR RV PROPFRTP OWNERS
A notice of public hearing was mailed to property owners within 150 feet of the subject
property approximately 15 days prior to the hearing. There have been no comments either in
favor or in opposition at the time of writing this staff report.

1. The size and location of the site is adequate to accommodate the proposed expansion
of the church.
2. The design of the site with regard to access, parking, location of the building, and
setbacks is in compliance with the zoning and design standards of the City.
3. Existing public services and facilities are adequate to accommodate the proposed use.
4. No significant impacts to the neighborhood can be anticipated as a result of the
expansion of the church.

OLD BUSINESS:
Tire Rama - Nothing back from them. They have issues with flood plain, site plan. Will
probably need subdivision review per Narda. Narda will discuss with Tom and Charlie.
Summit Fitness Center - A dozen things wrong with parking. One-way traffic flow in
parking area is a mess and access needs straightening out. Drainage is an issue. The original
permit set parking facility at 337 + the tennis facility requirements + new construction
requirements. Joint use with Two Medicine? Narda will look into the parking issue in regard
to previous arrangements. Will need to confirm compliance with prior CUP? Landscaping
and Public Works issues - parks and public works will need to review for CUP compliance
and new construction. The Westerly ends were suppose to have landscaping.
Comm Shop - P. J. spoke with the contractor - they were to pick up parking and floodplain
information, but never came in. There is no stacking area for drive through and parking will
be taken out.

Nicholson - Off of Montana Street at 152-3rd Avenue W. N. Take out garage and put up
structure with new garage and professional office. They will need to fix the parking and
adjust the garage size. The boundary line was previously adjusted. Dick will drive by to
check out the drainage issue.

Planning Board Issues
Zone change on North Meridian on undeveloped land. Owned by Flathead Orthopedic. No
issues. Discussed timetable for rezoning ofNorth Meridian area. It is tied to a degree to the
Meridian road project. MDOT is ready to do Meridian according to Narda, but the County
Commissioners do not want to give up the 18 foot set back for the pedestrian walkway. They
are concerned that the Carnival people will not come to Kalispell. They are taking it under
advisement.
Shining Mountain Church - Has basically a 1 /2 City block. Will expand by about 100 percent.
For now, they meet the front, rear, and side setbacks, but any subdivision would change the
designations and either affect their current Iayout or prevent fixture subdivision since a
subdivision cannot create a zoning violation. The Fire Department has given their O.K.
Tyre are no curbs, gutters, sidewalks, etc. We will need to get them to sign a waiver of SID
if the area is ever upgraded.
Northridge Summit - clean-up annexation; primarily a strip along the north which was missed.
Request based on Glen's advice was for the entire area in order to eliminate arguments for
other strips. Narda said that Cookie researched it and that the entire omitted area is included
in this action.
Home Depot - They would like to put a 23 foot tall flag pole on their building. This would
not work on the building according to zoning rules. They could put a flag pole in the parking
lot, perhaps a three -pole flag display. The maximum on the building is 45 feet, and they are
already to that height.
Mental Health Facility - No approval on their site work, but they've started anyway. One
problem is the location of 14 parking spaces a foot away from the front parking line. They
could designate them as compact spaces. Entrances are way too narrow. They only have
"foundation only" permits which specifically required site plan approval prior to remainder
permits. Basically, the architect hasn't gotten done what he needs to get done in a timely
manner, and the contractor moved ahead with their construction.
314 Apartments - Dasen and Waatti will have their first reading onMonday night regarding
their B-2, multi -family, want to get started on their project. Should turn in building plans on
Tuesday after the first reading to begin review. If Charlie says it's O.K., then after the second
reading they can begin their project. They will need to compact the dirt because of the flood
problems in that area.
Glacier Village Greens - Their annexation into the City is effective today.
Gerry's Tires - corner of 3rd Ave EN and Center. Snow removal issue on that property.
Dick will take care of this.
Teton Terrace - Jerry Begg's property behind Teton Terrace - Jerry has put in berms where
Teton Terrace drains after it snows. It was suggested that Susan should call TD&H and tell
them they designed the drainage to drain onto someone else's property. They will need to
fix this. Public Works is looking at doing some work there as well, but will need easements.

The regular meeting of the Kalispell City -County Planning Board and Zoning Commission is
scheduled for Tuesday, November 13, 2001 beginning at 7:00 PM in the Kalispell City
Council Chambers, Kalispell City Hall, 312 First Avenue East, Kalispell. During the
regularly scheduled meeting of the planning board, the board will hold public hearings and
take public comments on the following agenda items. The board will make a
recommendation to the Kalispell City Council who will take final action.
A zone change request by Flathead Valley Orthopedic Profit Share from B-1,
Neighborhood Buffer District, a limited commercial district, to B-2, General Business, a
district that allows a broad mix of commercial uses. The property lies between the east
side of North Meridian Road and the west side of Hwy 93, north of Three Mile Drive. It
contains approximately 4.6 acres and is currently undeveloped. The property proposed
for rezoning can be described as Lot 5 of the Hall Addition #82 in Section 6, Township
28 North, Range 21 West, P.M.M., Flathead County, Montana.
2. A request by Shining Mountain Church for a conditional use permit to allow the
expansion of an existing church located at 475 Eight Avenue E.N. The property is in an
R-3, Residential, zone which lists churches as a conditionally permitted use. The
existing church contains approximately 1,450 square feet and the new addition would
be constructed to the east of the existing building and would contain approximately
1,650 square feet. The property can be described as Lot 1, Block 1, Northeast Addition
located in Section 8, Township 28 North, Range 21 West, P.M.M., Flathead County,
Montana.
3. A proposal by the City of Kalispell to annex a small strip of property approximately 33
feet wide and 300 feet long on the south side of Summit Ridge Drive west of Parkway
Drive which contains approximate 5,052 square feet (012 of an acre). This annexation
is a housekeeping item since this strip was inadvertently omitted when the properties of
which they are a part of were made part of the city of Kalispell in 1984. The properties
proposed for annexation can be described as the northerly strip of Lots B and C of
Northridge Summit and the northerly strip of Northridge Summit Amended Subdivision
Lot D and the northerly strip of Assessor's Tract 2W located in Section 1, Township 28
North, Range 22 West, P.M.M., Flathead County, Montana.
