06. Ordinance 1394 - Amends Admin Ordinance 1166 - Roll Call Rotation - 1st ReadingREPORT TO: FROM: SUBJECT: City of Kalispell Post Office Box 1997 - Kalispell, Montana 59903-1997 - Telephone (406)758-7700 Fax(406)758-7758 Honorable Mayor and City Council Chris A. Kukulski, City Manager Ordinance 1394 Amending Ordinance 1166 Altering the Rotation of Council Vote Including the Mayor MEETING DATE: August 20, 2001 BACKGROUND: The City ofKalispell's City Council and administration are guided by Ordinance 1166 which established an Administrative Code. During the July 16, 2001 Council workshop the Council directed me to bring forward several amendments to the Administrative Code. The attached amendment alters the rotation of Council vote and includes the Mayor in the rotation. In researching this issue, it is common to have the Chairman vote last however, this is often accompanied by the fact that the Chairman only votes in circumstances that involve a tie vote by an even numbered Council body. In addition, it is believed that Kalispell's presiding officer has always voted last because he/she is elected at large, however, there is nothing in Montana law or Roberts Rules of Order requiring it. RECOMMENDATION: The City Council approve Ordinance 1394 on first reading. FISCAL EFFECTS: No fiscal effect. ALTERNATIVES: As suggested by the Council. Respectfully submitted, Chris A. Kukulski City Manager Report compiled August 14, 2001 Page 1 of 1 ORDINANCE NO. 1394 AN ORDINANCE AMENDING CHAPTER 2, ADMINISTRATION, KALISPELL MUNICIPAL CODE BY AMENDING ORDINANCE 1166, § 2-14(e) ALTERING THE ROTATION OF COUNCIL VOTE AND INCLUDING THE CHAIRMAN IN THE ROTATION; AND AUTHORIZING THE CITY ATTORNEY TO RECODIFY § 2-14 (e) IN ACCORDANCE WITH THIS ORDINANCE AND DECLARING AN EFFECTIVE DATE.
