Kukulski, City Manager Final Plat for Westgate Subdivision MEETING DATE: April 2, 2001 BACKGROUND: This is a request for final plat approval of Westgate Subdivision, a four lot commercial subdivision on approximately 2.4 acres. The property is located on the west side of Corporate Way, north of Highway 2 West in Kalispell. Water and sewer along Corporate Way were installed and accepted by the City of Kalispell in 1995 in association with other development in the area. As part of this subdivision approval, some additional improvements have been installed along Corporate Way and the private road to the north including curb, gutter, sidewalks and underground utilities. The only remaining improvement left to be completed is the placement of the trees in the boulevard. A subdivision improvements agreement has been submitted along with a letter of credit in the amount of 125 percent of the costs of the improvements. As an additional note, the roadway along the northern boundary of the subdivision was paved to the western property boundary rather than just to the driveway for the apartments. This roadway provides access to the senior housing project and for the fire department. The road will be privately owned and maintained. Preliminary plat approval was granted by the Kalispell City Council on May 17, 1999 subject to 11 conditions. All of the conditions of approval have been met or otherwise adequately addressed. RECOMMENDATION: A motion to accept the subdivision improvements agreement and approve the final plat for Westgate Subdivision would be in order. FISCAL EFFECTS: Minor positive impacts once developed. Box 1997 Kalispell, MT 59903 Re: Final Plat for Westgate Subdivision Dear Chris: Our office has received the application for final plat approval of Westgate Subdivision, a four lot commercial subdivision on the west side of Corporate Way, north of Highway 2 West in Kalispell. The entire subdivision contains 2.404 acres and is zoned B-2, General Business. Preliminary plat approval for this subdivision was granted by the city council on May 17, 1999 subject to 10 conditions. The following is a list of the conditions of approval and a discussion of how they have been met. COMPLIANCE WITH CONDITIONS OF APPROVAL: Condition No 1. That the development of the site will be in substantial conformance with the approved preliminary plat which shall govern the general location of the lots and accesses. This condition has been met. The subdivision complies with the preliminary plat. Condition No 2. That all improvements for the subdivision shall be designed and constructed in compliance with the City of Kalispell's Design and Construction Standards for local streets. Certification from an engineer licensed in the state of Montana shall be submitted with the final plat stating that all of the improvements have been constructed accordingly. This condition has been met. Water and sewer for the subdivision existed in Corporate Way at the time the preliminary plat was filed. The City and State MDEQ have reviewed, approved and accepted the improvements which have been certified by Carver Engineering. Condition No 3. That approval of the water and sewer facilities for the subdivision be obtained from the Montana Department of Environmental Quality and the Kalispell Public Works Department. This condition has been met. Water and sewer improvements have been installed in accordance with City standards and have been accepted by the City. Condition No 4. That a letter from the Kalispell Public Works Department shall be obtained which states that the proposed plans and specifications all improvements including pavement, curbs, gutters, sidewalks, landscaping and drainage systems have been reviewed and approved in accordance with Kalispell's Design and Construction Standards and have been constructed accordingly for Corporate Way. This condition has been adequately addressed. All of the required improvements have been installed in accordance with City standards with the exception of the landscaping for with a subdivision improvements agreement has been submitted. A letter from the Kalispell Public Works Department verifying those improvements has been submitted with the final plat application. Condition No 5. A letter from the Kalispell Public Works Department shall be obtained which states that a storm water drainage plan which addresses storm water management has been reviewed and approved. This condition has been met. A letter from the Kalispell Public Works Department has been submitted with approves drainage management for the subdivision. Condition No 6. That the future roadway indicated on the plat be constructed with curb and gutter and a sidewalk on the north side of the roadway to City standards to the western terminus of the driveway to the north serving the apartment complex to the north. The remaining portion of the roadway shall be of gravel construction with a temporary cul-de-sac at its terminus. The roadway shall be identified on the plat as a 60 foot wide road and utility easement with a 55 foot temporary cul-de-sac. The roadway shall be privately owned and maintained until such time as subsequent development may necessitate its dedication to the City. A note shall be place don the face of the final plat stating that this roadway is privately owned and maintained. This condition has been adequately addressed. The roadway to the north serving the senior housing has been constructed with curb, gutter and sidewalk along the north side of the road and the pavement extended to the westerly edge of the property boundary. There is a note on the plat that the roadway will be privately owned and maintained. Condition No 7. That sidewalks be constructed on the west side of Corporate Way to the driveway entrance to Ashley Square mall to the east. Sidewalks shall be separated by a five foot landscape boulevard and the placement of street trees shall be at 50 foot intervals and shall be a minimum of one and one half inch caliper at planting. This condition has been adequately addressed. Sidewalks have been installed with a five foot boulevard along the west side of Corporate way to the driveway entrance to Ashley Square. The placement of has been addressed through a Westgate Subdivision Final Plat March 28, 2001 Page 3 subdivision improvements agreement which has been submitted with the final plat. Condition No S. That an approach permit be obtained from the Kalispell Public Works Department for the placement of the driveways or access road which will serve the lots in the subdivision. If a cross access road is used, a cross easement should be noted on the plat. This condition has been adequately addressed. As the lots within the subdivision are developed, access from Corporate Way will be coordinated with the public works department so that shared access is accomplished when possible. Condition No 9. That a common mail facility be located for the subdivision and be approved by the local postmaster. This condition has been met. A letter from the U.S. Postal Service has been submitted with the final plat stating that no central delivery site is required at this time. Condition No 10. That the number and location of fire hydrants within the subdivision be reviewed and approved by the City of Kalispell Fire Department. This condition has been adequately addressed. A letter dated 2/26/01 from the Kalispell Public Works Department it is noted that the fire department has approved the location of the existing hydrants, and that as these lots develop additional hydrants and /or sprinkling of the building(s) may be required. Condition No 11. That preliminary approval shall be valid for a period of three years from the date of approval. This condition has been met. The final plat was filed prior to the expiration of the preliminary plat approval. COMPLIANCE WITH APPROVED PRELIMINARY PLAT The final plat is in substantial compliance with the preliminary plat which was submitted and approved. COMPLIANCE WITH THE SUBDIVISION REGULATIONS: This subdivision plat has been found to be in compliance with the State and City Subdivision Regulations. COMPLIANCE WITH THE ZONING REGULATIONS This subdivision complies with the Kalispell Zoning Ordinance and the B-2, General Business, zoning designation. The Flathead Regional Development Office recommends that the Kalispell City Council approve the final plat for this subdivision. Water, sewer, roads, sidewalks and utility improvements that will serve the four (4) lots in Westgate are existing, and all such improvements were designed and constructed in accordance with the City of Kalispell's Design and Construction Standards in effect at the time the various improvements were constructed. 3. Water and sewer mains serving Westgate are existing and some have been in use for many years. The sewer main in Corporate Way was installed in 1985/86 as a part of improvements for Two Mile Vista Apartments, and the water main in Corporate Way, from Hwy. 2 to the new road along the north side of Lot 4, was installed much earlier than that. The water main, in Corporate Way, from the new road to the north end of the Corporate Way, was installed in 1995 as a part of the reconstruction of Corporate Way. Water and sewer mains in the new road along the north side of Lot 4 were installed with improvements for the Westgate Senior Apartments. Carver Engineering was involved in the Two Mile Vista Apartment project and the Corporate Way Reconstruction project, and approvals from the MDEQ for both projects are attached. An approval letter from City for the Corporate Way project is also attached; however, we could not find an approval letter from the City for Two Mile Vista. They either sent the letter directly to the MDEQ or they called them to give verbal approval. During that era, the engineer sometimes did not receive written approval from the City. Our understanding of City approval usually came from receiving MDEQ approval or a discontinuance of disapproval letters from the City. Page 2 Westgate - Final Plat March 6, 2001 4. The roadway along the north side of Lot 4 has been constructed with curb and gutter and with a sidewalk along the north side of the road. The paved road, curb & gutter and sidewalk extend beyond the driveway serving the apartment complex to the westerly edge of the property. This roadway is identified on the plat as a private road and utility easement, and that this road is privately owned and maintained. 7. A sidewalk, with a 5' boulevard, has been constructed along the west side of Corporate Way to the driveway entrance to Ashley Square. The placement of trees has not been done, as yet, and the cost of the proposed trees has been included in a Subdivision Improvement Agreement. 8. Approach permits for driveways will be obtained by the new property owner(s) at the time of development. With the uncertainty of building type, size, location and access needs, driveways will not be installed until specific development plans are known. This was discussed with and agreed to by Dick Amerman. 9. A common mail facility is not required at this time. See letter from Pennie Ulvila, of the U.S. Postal Service, dated January 18, 2001. 10. The Kalispell Fire Department has indicated that additional fire hydrants will likely be needed when development of the lots occurs, but the exact number of hydrants and the most suitable locations for additional hydrants cannot be determined until specific development plans are proposed. All of the four (4) lots are fronted by recently constructed improvements which include Corporate Way with a sidewalk on the west side, sewer, water and street lighting. Additionally, there is a new street and sewer and water north of Lot 4. Since all of the lots are served by the above improvements, it appears that the conditions of final plat that require those improvements have been met. As each lot is developed, it will be subject to specific site' development requirements which could include sidewalks, drainage structures and additional fire hydrants. Also, new sewer and water services may have to be installed depending on the development requirements of each lot. W ITNESSETH: THAT WHEREAS, the Developer is the owner and developer of a new subdivision known as Westgate, located in Kalispell, Montana in the SW 1/4, SE 1/4 of Section 12, Township 28N, Range 22W, Flathead County, Montana, and, WHEREAS, the City has conditioned it's approval of the final plat of Westgate, upon the conditions as set forth in the Preliminary Plat of the Subdivision being completed and all improvements, as cited in "Exhibit A", have not been completed at this time, and the Developer wishes to bond for the completion of those improvements set forth in "Exhibit A'; and, WHEREAS, the City's Subdivision Regulations require that a subdivider shall provide a financial security of 125% of the estimated total cost of construction of said improvements as evidenced by an estimate prepared by a licensed professional engineer included herewith as "Exhibit B", and, WHEREAS, the estimated total cost of construction of said remaining improvements is the sum of $ 2,550.00 . NOW THEREFORE, in consideration of the approval of the final plat of said Subdivision by the City, the Developer hereby agrees as follows: 1. The Developer shall deposit as collateral with the City a Letter of Credit, or other acceptable collateral as determined by the City Council, in the amount of $ 3,187.50 . Said Letter of Credit or other collateral shall have an expiration date of at least sixty (60) days following the date set for completion of the improvements, certifying the following: a. That the creditor guarantees funds in the sum of $ 3,187.50 , which represents 125% of the estimated cost of completing the required improvements in Westgate. b. That if the Developer fails to complete the specified improvements within the required period, the creditor will pay to the City immediately, and without further action, such funds as are necessary to finance the completion of those improvements up to the limit of credit stated in the Letter of Credit; 2. That said required improvements shall be fully completed by June 15, 2001 3. That upon completion of the required improvements, the Developer shall cause to be filed with the City a statement certifying that: Page 1 a. All required improvements are complete, b. That the improvements are in compliance with the minimum standards specified by the City for their construction and that the Developer warrants said improvements against any and all defects for a period of one (1) year from the date of acceptance of the completion of those improvements by the City; C. That the Developer knows of no defects in those improvements; d. That these improvements are free and clear of any encumbrances or liens; e. That a schedule of actual construction costs has been filed with the City; and, f. All applicable fees and surcharges have been paid. 4. The Developer shall cause to be filed with the City copies of final plans, profiles, grades and specifications of said improvements, with the certification, of the registered professional engineer responsible for their preparation, that all required improvements have been installed in conformance with said plans and specifications. IT IS ALSO AGREED BY AND BETWEEN THE PARTIES HERETO AS FOLLOWS, TO WIT: That the Developer shall provide for inspection of all required improvements by a registered professional engineer before the Developer shall be released from the Subdivision Improvement Agreement. That if the City determines that any improvements are not constructed in compliance with the plans and specifications; it shall furnish the Developer with a list of specific deficiencies and may withhold collateral sufficient to insure such compliance. If the City determines that the Developer will not construct any or all of the improvements in accordance with the plans and specifications, or within the required time limit(s), it may withdraw the collateral and employ such funds as may be necessary to construct the improvement(s) in accordance with the plans and specifications. The unused portions of the collateral shall be returned to the Developer or the crediting institution, as is appropriate. That as improvements are completed, the Developer may apply to the City for a release of part of the collateral deposited with the City. The proportion of the collateral released may not exceed the proportion which the improvements completed represent of all originally required improvements, otherwise, said Letter of Credit may not be withdrawn until released by the City. That this agreement shall inure to the benefit of and be binding upon any successors in interest, heirs, or assignees. That the Findings of Fact contained in Flathead Regional Development Office Report #KSR 99-2, are hereby adopted as the Findings of Fact of the City Council. =110N.-II• That the application of Ronnie Pack, the owner of certain real property known as Assessor's Tract 7A, Section 12, T29N, R22W, P.M.M., Kalispell, Flathead County, Montana is hereby approved subject to the following conditions: 1. That the development of the site will be in substantial conformance with the approved breliminary plat which shall govern the general location of the lots and accesses. 2. That all improvements for the subdivision shall be desicned and constructed in compliance with the City of H:\at:sec\`+p\res',plata\weetgate.vpd 1 Kalispell's Design and Construction Standards for local streets. certification from an engineer licensed in the State of Montana shall be submitted with the final plat stating that all of the improvements have been constructed accordingly. 3. That approval of the water and sewer facilities for the subdivision be obtained from the Montana Department of Environmental Quality and the Kalispell Public 'Works Department. 4. That a letter from the Kalispell Public Works Department shall be obtained which states that the proposed plans and specifications for all improvements including pavement, curbs, gutters, sidewalks, landscaping and drainage systems have been reviewed and approved in accordance with Kalispell's Design and Construction Standards and have been constructed accordingly for Corporate Way. 5. A letter from the Kalispell Public Works Department shall be obtained which states that a storm water drainage plan which addresses storm water management has been reviewed and approved. 6. That the future roadway indicated on. the plat be constructed with curb and gutter and a sidewalk on the north aide of the roadway to City standards to the western terminus of the driveway to the north serving the apartment complex to the north. The remaining portion of the roadway shall be of gravel construction with a temporary cul-de-sac at its terminus. The roadway shall be identified or the plat as a 60 foot wide private road and utility easement with a 55 foot radius temporary cul- de-sac. The roadway shall be privately owned and maintained until such time as subsequent development may necessitate its dedication to the City. A note shall be placed on the face of the final plat stating that this roadway is privately owned and maintained, 7. That sidewalks be constructed on the west side of Co--perate Way to the driveway entrance to Ashley Square mall to the east. Sidewalks '.shall be separated by a five foot landscape boulevard and the placement of street trees shall be at 50 foot intervals and shall be a minimum of one and one half inch caliper at planting. 9.
