Resolution postponed from April 15th meeting to reexamine City assessments for storm drain on private parklands. MEETING DATE: May 6th, 2002 BACKGROUND: This matter was brought to the attention of Council by staff to point out possible inequities in the way in which the storm drain assessments were going to be applied to the owners in Glacier Village Greens; i.e. each phase of development was going to be assessed differently for the private parkland within the development. Staff suggested at the last meeting that there may be a method of averaging the assessments across the entire development. This issue may now become moot if Council passes Ordinances 1420 and 1421, which exempt private parklands from storm drain and street assessments. RECOMMENDATION: If Council pass Ordinances 1420 and 1421, this resolution is no longer meaningful and should be disapproved. FISCAL EFFECTS: The fiscal effects of such action are minimal. Chris Kukulski, City Manager RESOLUTION NO. 4692 A RESOLUTION SETTING SPECIAL ASSESSMENT QUANTITIES FOR HOMEOWNER PARKLAND IN GLACIER VILLAGE GREENS AT A UNIFORM AVERAGE AMOUNT TO ENSURE ASSESSMENT EQUITY BETWEEN PARCELS AND CONSISTENCY WITH PRE - ANNEXATION COMMITMENTS. WHEREAS, all phases of the Glacier Village Greens Subdivision were annexed on October 16, 2000, with an effective date of November 1, 2001, and WHEREAS, the Glacier Village Greens Subdivision plat requires proportioning parkland in each phase to the lots within that phase, and WHEREAS, the various phases of Glacier Village Greens have differing quantities of parkland, thereby creating disproportionate assessment values for comparable properties between phases, and WHEREAS, in order to assure equitable assessments within Glacier Village Greens, the average amount of the total subdivision parkland per residential lot, currently 3,050 square feet, should be used for assessment purposes for residential lots. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA: SECTION I. That the homeowner parkland assessments for Glacier Village Greens be equalized at a value equal to the average amount of total subdivision parkland per residential lot, currently 3,050 square feet. SECTION II. This Resolution shall become effective immediately upon passage by the City Council and approval by the Mayor.
