Kukulski, City Manager SUBJECT Final Plat for Glacier Village Greens Phase XI MEETING DATE: June 17, 2002 BACKGROUND: This is a request for final plat approval of Glacier Village Greens Phase XI which creates 16 townhouse lots on approximately 2.518 acres at the north end of East Nicklaus Avenue. The lots are intended to be developed with duplex townhouses and each sublot will be conveyed separately. A homeowners park is indicated along the Whitefish River to the east to establish and protect the riparian corridor. The newly developed East Nicklaus Avenue will be dedicated to the City of Kalispell. Most of the work has been completed with regard to water and sewer extensions and roadway construction. However, there is some work yet to be completed with regard to the roadway and sidewalks in the amount of approximately $33,415. A subdivision improvements agreement has been submitted along with a cashiers check in the amount of 125 percent of the improvements or $41,769. It is anticipated that the improvements would be completed no later than October 31, 2002. RECOMMENDATION: A motion to accept the subdivision improvements agreement and approve the final plat for Glacier Village Greens Phase XI would be in order. Drawer 1997 Kalispell, MT 59901 Re: Final Plat for Glacier Village Greens Phase XI Dear Chris: Our office has received an application from Sand Surveying for approval of the final plat for Glacier Village Greens Phase XI which creates 16 townhouse lots on approximately 2.518 acres at the north end of East Nicklaus Avenue. The lots are intended to be developed with duplex townhouses and each sublot will be conveyed separately. A homeowners park is indicated along the Whitefish River to the east to establish and protect the riparian corridor. The preliminary plat for this subdivision was approved by the Board of County Commissioners on April 4, 2002 subject to 15 conditions. Since the plat was approved, Glacier Village Greens has been annexed including this property. Hence the final plat for this subdivision will be reviewed and approved by the Kalispell City Council. The following is a list of the conditions of preliminary plat approval and a discussion of how they have been met or otherwise addressed. COMPLIANCE WITH CONDITIONS OF APPROVAL Condition No. 1. Development of the subdivision shall be in substantial conformance with the preliminary plat with the approved preliminary plat, which shall govern the general location of the lots, roadways and open space. • This condition has been met. The configuration of the lots, roadways and open space areas are in substantial compliance with the approved preliminary plat. Providing Community Planning Assistance To: • City of Kalispell • City of Columbia Falls • City of Whitefish Final Plat for Glacier Village Greens Phase XI June 11,2002 Page 2 Condition No. 2. That the roadways within the subdivision shall be constructed in accordance with the City of Kalispell's Design and Construction Standards for paved streets. Upon completion of the roadways shall be approved by the City of Kalispell Public Works Department and certified by a licensed engineer registered in the state of Montana that the road system has been constructed accordingly. This condition has been adequately addressed. The roadways have been designed in accordance with City standards and reviewed and approved by the Kalispell Public Works Department. Remaining improvements that have not been completed with regard to the roadway have been addressed in the subdivision improvements agreement. Condition No. 3. That in addition to the paved roadway, curb and gutter shall be constructed on both sides. • This condition has been adequately addressed. The remaining roadway improvements have been addressed with the subdivision improvements agreement. Condition No. 4. That a temporary gravel cul-de-sac shall be constructed at the northern terminus of East Nicklaus Avenue which has a minimum of a 50 foot radius. This condition has been met. A temporary cul-de-sac has been constructed at the northern terminus of the road in compliance with this condition. Condition No. 5. That the fire access and suppression system, including the number and location of fire hydrants shall, be reviewed and approved by the fire chief of the Evergreen Volunteer Fire Department. This condition has been met. A letter from the Evergreen Volunteer Fire Department has been submitted with the final plat. Additionally, the Kalispell Fire Department is satisfied with the fire access and suppression system for this subdivision. Since some of the roadway work has not been completed, a note will be placed on the building permit that requires an all weather access road approved by the fire department to be in place prior to combustible material being on -site. Condition No. 6. That a Certificate of Subdivision Approval be obtained from the Department of Environmental Quality which shall approve the water and sewage treatment facilities for the subdivision. • This condition has been met. A certificate of subdivision approval was submitted with the final plat application approving the water and sewer for the subdivision. Condition No. 7. That a letter from the City of Kalispell be obtained which approves the plans and specifications for the sewage treatment facilities and verifies that they have been constructed in accordance with the approved plans. Final Plat for Glacier Village Greens Phase XI June 11, 2002 Page 3 • This condition has been met. From the Kalispell Public Works Department has been obtained approving the sewage treatment facilities for this subdivision. Condition No. S. That an engineered drainage plan be prepared by a licensed profession engineer that retains the storm water runoff on -site or within established drainage culverts. • This condition has been met. An engineers certification from Carver Engineering has been submitted with the final plat. Condition No. 9. That a letter from the utility company be submitted that all new utilities within the subdivision have been placed underground and extended to each lot. • This condition has been met. Certification from Carver Engineering has been submitted with the final plat and the utility installation has been verified by an on - site inspection by the staff. Condition No. 10. That a common off-street mail facility shall be provided by the developer and approved by the local post office. • This condition has been adequately addressed. A common mail facility has been established in previous phases of the Glacier Village Greens development. Condition No. 11. That the parkland dedication shall be met by proposed homeowners park indicated on the preliminary plat. • This condition has been met. The homeowners parks has been indicated on the final plat and each lot designated a pro-rata share of the square footage for taxation purposes. Condition No. 12. That the roadways be named and signed in accordance with the Flathead County Road Department Standards. • This condition has been met. The extension of East Nicklaus Avenue has been previously established and the roadway signed accordingly. Condition No. 13. That a note shall be placed on the face of the final plat requiring house numbers be posted on the house in a clearly visible location or at the driveway entrance. • This condition has been met. A note has been placed on the face of the plat requiring the street addresses. Condition No. 14. That a petition to annex to the City of Kalispell and notice of withdrawal from the rural fire district shall be filed with the City of Kalispell upon final plat submission. Final Plat for Glacier Village Greens Phase XI June 11, 2002 Page 4 • This condition has been adequately addressed. This property was recently annexed into the city of Kalispell. A copy of the petition to annex has been submitted with the final plat. Condition No. 15. That the preliminary plat is valid for a period of three years from the date of approval. • This condition has been met. The final plat was filed prior to the expiration date and in substantial compliance with the subdivision regulations. COMPLIANCE WITH APPROVED PRELIMINARY PLAT: The final plat is in substantial compliance with the preliminary plat which was reviewed and approved by the city council on April 4, 2000. COMPLIANCE WITH THE SUBDIVISION REGULATIONS: This subdivision plat is in compliance with the State and City Subdivision Regulations. COMPLIANCE WITH THE ZONING REGULATIONS: This subdivision is in compliance with the Kalispell Zoning Ordinance which governs the dimensional requirements of the lots within the subdivision and well as the uses within the various areas of the development. RECOMMENDATION: All of the conditions of preliminary plat approval have been met or otherwise adequately addressed. The staff would recommend that the Kalispell City Council approve the final plat for this subdivision. Please schedule this matter for the regular city council meeting of June 17, 2002. Inc SUBDIVISION IMPROVEMENT AGREEMENT THIS AGREEMENT, made and entered into this day of , 2002, by and between CITY COUNCIL, CITY OF KALISPELL, MONTANA, Parry of the First Part and hereinafter referred to as the CITY, and OWENS VENTURES, Parry of the Second Part and hereinafter referred to as DEVELOPER. WITNESSETH: THAT WHEREAS, the Developer is the owner and developer of a new subdivision known as Glacier Village Greens Phase XI, located in Kalispell, Montana in the SW '/4 NE `/4 and NW '/4 SE 1/4 of Section 32, Township 29N, Range 21 W, Flathead County, Montana; and, WHEREAS, the City has conditioned its approval of the final plat of Glacier Village Greens Phase XI upon the conditions as set forth in the Preliminary Plat of the Subdivision being completed and all improvements, as cited in "Exhibit A", have not been completed at this time, and the Developer wishes to bond for the completion of those improvements set forth in "Exhibit A'; and, WHEREAS, the City's Subdivision Regulations require that a subdivider shall provide a financial security of 125% of the estimated total cost of construction of said improvements as evidenced by an estimate prepared by a licensed professional engineer included herewith as "Exhibit B"; and, WHEREAS, the estimated total cost of construction of said remaining improvements is the sum of $33,415, the required additional 25% of the estimated total cost of construction is $8,354, and the total amount of the required financial security is $41,769. NOW THEREFORE, in consideration of the approval of the final plat of said Subdivision by the City, the Developer hereby agrees as follows: 1. The Developer shall deposit as collateral with the City a Letter of Credit, or other acceptable collateral as determined by the City Council, in the amount of $41,769. Said Letter of Credit or other collateral shall have an expiration date of at least sixty (60) days following the date set for completion of the improvements, certifying the following: a. That the creditor guarantees funds in the sum of $41,769, which represents 125% of the estimated cost of completing the required improvements in Glacier Village Greens Phase M. b. That if the Developer fails to complete the specified improvements within the required period, the creditor will pay to the City immediately, and without further action, such funds as are necessary to finance the completion of those improvements up to the limit of credit stated in the Letter of Credit; Page I 2. That said required improvements shall be fully completed by October 31, 2002. 3. That upon completion of the required improvements, the Developer shall cause to be filed with the City a statement certifying that: a. All required improvements are complete; b. That the improvements are in compliance with the minimum standards specified by the City for their construction and that the Developer warrants said improvements against any and all defects for a period of one (1) year from the date of acceptance of the completion of those improvements by the City; C. That the Developer ]mows of no defects in those improvements; d. That these improvements are free and elm of any encumbrances or liens; e. That a schedule of actual construction costs has been filed with the City; and, f All applicable fees and surcharges have been paid. 4. The Developer shall cause to be filed with the City copies of final plans, profiles, grades and specifications of said improvements, with the certification, of the registered professional engineer responsible for their preparation, that all required improvements have been installed in conformance with said plans and specifications. That if the City determines that any improvements are not constructed in compliance with the plans and specifications, it shall furnish the Developer with a list of specific deficiencies and may withhold collateral sufficient to insure such compliance. If the City determines that the Developer will not construct any or all of the improvements in accordance with the plans and specifications, or within the required time limit(s), it may withdraw the collateral and employ such funds as may be necessary to construct the improvement(s) in accordance with the plans and specifications. The unused portions of the collateral shall be returned to the Developer or the crediting institution, as is appropriate. That as improvements are completed, the Developer may apply to the City for a release of part of the collateral deposited with the City. The proportion of the collateral released may not exceed the proportion which the improvements completed represent of all originally required improvements; otherwise, said Letter of Credit may not be withdrawn until released by the City.
