SUBJECT: Resolution 4678 - Approving a Temporary Amendment to the Tri-City
Planning Board Interlocal Agreement
MEETING DATE: January22, 2002
BACKGROUND: On October 17, 2001, Kalispell, Columbia Falls and Whitefish signed an
Interlocal Agreement establishing an administrative body for planning purposes. The agreement
states that prior to the first day of February of each year, the Board will ascertain budget
requirements for the next ensuing fiscal year and then prepare an estimate overall budget for the
planning office. The agreement further states that on or before February 1 st of the fiscal year, a party
may withdraw upon lawful resolution of the governing body and service of written notice on the
remaining parties. A joint cities meeting is scheduled for January 28th to discuss fiscal issues. Due
to the meeting falling so close to February 1st, the three cities are each passing a resolution
extending the deadline for notice of withdraw from February 1 st to March 1 st, 2002. The resolution
affects only the current fiscal year.
RECOMMENDATION: Council pass Resolution 4678.

RESOLUTION 4678
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA,
APPROVING A TEMPORARY AMENDMENT TO THE TRI-CITY PLANNING BOARD
INTERLOCAL AGREEMENT.
WHEREAS, the. City of Columbia Falls, the City of Kalispell, and
the City of Whitefish have entered into an agreement
entitled the TRI-CITY PLANNING BOARD INTERLOCAL AGREEMENT
(the "Agreement"), by which the three cities agreed to
share the expenses of a joint planning office, and which
provides for administration by the Tri-City Planning
Board; and
WHEREAS, Article VII of the Agreement provides that prior to the
first day of February of each year, the Tri-City Planning
Board will ascertain the budget requirements for the
following fiscal year, and determine each City's share of
the expenses for the following fiscal year; and
WHEREAS, Article II of the Agreement provides that a party
desiring to withdraw from the Agreement must do so by
serving written notice of withdrawal on the other parties
on or before February first of the fiscal year in which
it intends to withdraw; and
WHEREAS, because of unique budgetary difficulties being faced in
the current fiscal year, and because of unique budgetary
issues that may arise in the following fiscal year, the
Tri-City Planning Board has requested a joint meeting of
the three City Councils on the evening of Monday, January
28, 2002; and
WHEREAS, because the deadline for serving notice of withdrawal
from the Agreement comes only three days after the joint
meeting of the three City Councils, the Tri-City Planning
Board has requested that the three Cities approve a joint
resolution extending this year's deadline for service of
notice of withdrawal from the Agreement to March 1, 2002;
and
WHEREAS, it is in the best interest of
its inhabitants, to agree to
withdrawal from the Agreement

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL, MONTANA, AS FOLLOWS:
SECTION I. The City of Kalispell agrees that the deadline
for service of notice of withdrawal from the
Tri-City Planning Board Interlocal Agreement
shall be extended for the current fiscal year
only, from February 1, 2002 to March 1, 2002.
SECTION II. This Resolution shall become effective
immediately upon its adoption, but the City of
Kalispell shall not be bound by the extension
contained herein until a resolution, in
substantially similar form, has been adopted
by the City Councils of the City of Columbia
Falls and the City of Whitefish.
SECTION III. Because this Agreement affects only the
current fiscal year, it will not be necessary
for the parties to the Tri-City Planning Board
Interlocal Agreement to sign a formal
amendment to the Agreement.
SECTION IV. All other terms of the Tri-City Planning Board
Interlocal Agreement shall remain in effect
and unmodified.
