Second Reading for the Initial Zoning of R-3, Residential -
Summit Ridge Area
January 7, 2002
BACKGROUND: This is the second reading on the zoning for property located in the
Northridge area. The City of Kalispell initiated annexation proceedings for strip of land
approximately 20 feet wide and 300 feet long on the south side of Summit Ridge Drive
west of Parkway Drive. This is a housekeeping item since this strip of land was
inadvertently omitted when the properties of which they are a part of were annexed to
the city of Kalispell in 1984. The land use in the area is primarily single-family
residential. All of the area immediately surrounding the strip of land proposed to be
annexed is zoned R-3, Residential, a single-family district. The staff recommended R-3,
Residential, zoning which allows single-family residences as permitted uses and has a
minimum lot size requirement of 7,000 square feet.
On December 17, 2001 the Kalispell City Council approved the first reading of an
ordinance for R-3 zoning for the property. The Kalispell City -County Planning Board
held a public hearing at their regular meeting of November 13, 2001. The
unanimously recommended to the council that initial zoning for this property should
be R-3, Residential, upon annexation.
RECOMMENDATION: A motion to adopt the second reading of the ordinance for R-3
zoning upon annexation would be in order.
FISCAL EFFECTS: Minor positive impacts once developed.
ALTERNATIVES: As suggested by the city council.

ORDINANCE NO. 1410
AN ORDINANCE TO AMEND SECTION 27.02.010, OFFICIAL ZONING MAP, CITY
OF KALISPELL ZONING ORDINANCE, (ORDINANCE NO. 1175), BY ZONING
CERTAIN REAL PROPERTY DESCRIBED AS APPROXIMATELY 20 FEET WIDE AND
300 FEET LONG ON THE SOUTH SIDE OF SUMMIT RIDGE DRIVE WEST OF
PARKWAY DRIVE CONTAINING 5,052 SQUARE FEET AND MORE PARTICULARLY
DESCRIBED ON EXHIBIT "A" (PREVIOUSLY ZONED COUNTY R-4, RESIDENTIAL)
TO CITY R-3 (RESIDENTIAL), IN ACCORDANCE WITH THE CITY -COUNTY
MASTER PLAN, AND TO PROVIDE AN EFFECTIVE DATE.
WHEREAS, the City of Kalispell has requested that the zoning
classification attached to the above described tract of
land be changed to R-3, Residential, and
WHEREAS, the property as described exists as property surrounded
to the North by single family residences, R-3
classification, to the East by single family residences,
R-3 classification, to the South by single family
residences, R-3 classification, and to the West by single
family residences, R-3 classification, and
WHEREAS, the City of Kalispell's request was the subject of a
report compiled by the Tri-City Planning Office, #KZC-01-
7, dated November 5, 2001, in which the Tri-City Planning
Office evaluated the petition and recommended that the
property as described above be zoned R-3, Residential as
requested, and
WHEREAS, the Kalispell City -County Planning Board and Zoning
Commission adopted the TCPO report and recommended the
property as described be zoned R-3, Residential, and
WHEREAS, after considering all the evidence submitted on the
proposal to zone the property as described R-3,
Residential, the City Council adopts, based upon the
criterion set forth in Section 76-3-608, M.C.A., and
State. Etc. v. Board of County Commissioners Etc 590
P2d 602, the findings of fact of TCPO as set forth in
Report No. KZC-01-7.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL AS FOLLOWS:
SECTION I. Section 27.02.010, of the Official Zoning Map
of the Kalispell Zoning Ordinance, (Ordinance No. 1175)
is hereby amended by designating the property described
on Exhibit "A" as R-3, Residential.
SECTION II. The balance of Section 27.02.010, Official
Zoning Map, City of Kalispell Zoning Ordinance not
amended hereby shall remain in full force and effect.
SECTION III. This Ordinance shall be effective thirty
(30) days from and after the date of its final passage
and approval by the Mayor.

That portion of land not previously annexed which falls
within the City of Kalispell, more particularly described
as follows:
the northerly portions of Lots B, C, D and the 10
foot wide Tract 1 (County Tract 2W) falling between
Lots C and D, northerly of the North Right -of -Way
line of the abandoned Mission Lane, as shown on
Northridge Summit, an amended subdivision plat of
Lots 10, 11 and 12 of Block 8 of Northridge Heights
section 3 and Lot 21 of Block 2 of Summit Ridge
Number 1, located within the NE 1/4, Section 1,
T28N, R22W, PM, M, Flathead County, Montana
according to the plat on file in the Clerk and Recorder's
Office, Flathead County, Montana.
