MEETING DATE: December 16, 2002
BACKGROUND: Owl Corporation has petitioned for annexation and an initial zoning
designation of R-4, a Two -Family Residential district, on approximately 29.041 acres
on the north side of Glacier Village Greens Golf Course. A preliminary plat for a 177
lot residential subdivision, to be platted as Glacier Village Greens Phases 14 through
22, has been submitted concurrently with this annexation and initial zoning request.
The plat shows East and West Nicklaus Drives will be extended to the north with West
Nicklaus Drive eventually connecting with Palmer Drive. Currently the property is
zoned County R-5, a Two -Family Residential district, under the Flathead County
Zoning Regulations. The proposed R-4, Two -Family Residential, zone allows duplexes
and single-family residences as permitted uses and has a minimum lot size
requirement of 6,000 square feet and a width of 50 feet.
The Kalispell City Council has annexed all other phases of the Glacier Village Greens
development in previous actions and have assigned a zoning designation consistent
with the R-4 that is being requested for this property.
On November 12, 2002 the Kalispell City Planning Board held a public hearing to
consider the initial zoning on the property. There was no testimony from the public
regarding the initial zoning designation. Staff recommended that the requested R-4
zoning be adopted, consistent with previously annexed areas that were given a City
zoning designation. A motion was made and passed unanimously by the planning
board to recommend R-4, Two Family Residential, zoning upon annexation into the
city.
RECOMMENDATION: A motion to adopt the resolution annexing the property and
the first reading of the ordinance for R-4, Two Family Residential, would be in order.
FISCAL EFFECTS: See attached estimated impacts and cost of services.
ALTERNATIVES: As suggested by the city council.

A RESOLUTION TO PROVIDE FOR THE ALTERATION OF THE BOUNDARIES OF
THE CITY OF KALISPELL BY INCLUDING THEREIN AS AN ANNEXATION CERTAIN
REAL PROPERTY, MORE PARTICULARLY DESCRIBED AS GLACIER VILLAGE
GREENS PHASES 14 THROUGH 22, A PORTION OF ASSESSOR'S TRACTS 1+AND 2A+
IN SECTION 32, TOWNSHIP 29 NORTH, RANGE 21 WEST, O.K., FLATHEAD COUNTY,
MONTANA, TO BE KNOWN AS GLACIER VILLAGE GREENS PHASES 14 THROUGH
22 ADDITION NO. 320; TO ZONE SAID PROPERTY IN ACCORDANCE WITH THE
KALISPELL INTERIM ZONING ORDINANCE, AND TO DECLARE AN EFFECTIVE
DATE.
WHEREAS, the City of Kalispell has received a petition from Owl Corporation, the owner of
property located on the north side of Glacier Village Greens Golf Course and further
described as Glacier Village Greens Phases 14 through 22 in Section 32, requesting
that the City of Kalispell annex the territory into the City, and
WHEREAS, the Tri-City Planning Office has made a report on Glacier Village Greens Phases 14
through 22 Annexation Request, #KA-02-12, dated November 4, 2002, and
WHEREAS, the Kalispell City Planning Board and Zoning Commission recommended that the
territory be zoned City R-4, Two Family Residential, upon annexation into the City
of Kalispell, and
WHEREAS, the City of Kalispell desires to annex said property in accordance with Title 7,
Chapter 2, Part 46, Montana Code Annotated.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL AS FOLLOWS:
SECTION I. That all the real property as described above be annexed to the City of
Kalispell and the boundary of the City is altered to so provide, and shall be known as
Glacier Village Greens Phases 14 through 22 Addition No. 320.
SECTION IL Upon the effective date of this Resolution, the City Clerk is directed
to make and certify under the seal of the City, a copy of the record of these
proceedings as are entered on the minutes of the City Council and file said
documents with the Flathead County Clerk and Recorder.
From and after the date of filing of said documents as prepared by the City Clerk, or
on the effective date hereof, whichever shall occur later, said annexed territory is part
of the City of Kalispell and its citizens and property shall be subject to all debts, laws
and ordinances and regulations in force in the City of Kalispell and shall be entitled
to the same privileges and benefits as are other parts of the City.
SECTION I1I. The territory annexed by this Resolution shall be zoned in
accordance with the Kalispell Interim Zoning Ordinance.
SECTION IV. This Resolution shall be effective immediately upon passage by the
City Council.

The Kalispell City Planning Board met on November 12, 2002, and held a public
hearing to consider an initial zoning designation of R-4, a Two -Family Residential

The planning board is recommending City R-4, a Two Family Residential zoning
district, which has a minimum lot size requirement of 6,000 square feet and allows
duplexes and single-family homes as permitted uses. This is consistent with the City
zoning for other phases of Glacier Village Greens.
Narda Wilson with the Tri-City Planning Office presented staff report #KA-02-12,
evaluating the proposed zoning noting that the proposed zoning is consistent with the
other City zoning adopted for the Glacier Village Greens development and the current
County R-5, Two Family Residential zoning. No one spoke at the public hearing.
After the public hearing the board discussed the zoning for the property and the
proposed preliminary plat. A motion was made and passed unanimously to forward a
recommendation that initial zoning for this property should be R-4, Two Family
Residential, upon annexation.

STAFF REPORTS Narda Wilson, of the Tri-City Planning Office, gave a
KA-02-12 AND presentation of staff reports KA-02-12 and KPP-02-7, which
KPP-02-7 evaluates the appropriate assignment of a City zoning
classification in accordance with Section 27.03.010(4) of the
Kalispell Interim Zoning Ordinance. Also, a request for
preliminary plat approval of a 177 lot residential subdivision
on approximately 29.524 acres in the Glacier Village Greens
development. This property is proposed for annexation into
the city of Kalispell concurrent with the preliminary plat and
to be given a zoning designation of R-4, a Two -Family
Residential zone. The subdivision would plat the remaining
phases of the Glacier Village Greens development and be
developed in phases over a period of time depending on the
market. Overall there will be 55 single-family homes and
122 townhouses developed in 9 phases. Staff reviewed
report KA-02-12 and recommended adoption of the findings
and the R-4, Two -Family Residential zoning, upon
annexation. Staff further recommended adoption of the
findings of staff report KPP-02-7, to grant a variance to
secondary access. Staff also recommended adoption of staff
report KPP-02-7 and approval of the preliminary plat subject
to conditions.
Wilson further explained that the Public Works Department
has requested geo technical analysis be made of the slope
areas to the north and west to insure stability on the slope
and to identify any potential failure areas.
Brechel asked about paving the 20-foot emergency easement
and Wilson said they would use alternative types of
compaction to provide stability for fire trucks rather than
traditional paving. She said the developer was working with
the fire marshal on different options. She added that it
would need to be signed "emergency access only".

APPLICANT/AGENCIES Mark Owens stated he would like to go forward with the
project and encouraged the board to give them favorable
consideration of the project. The noted they are in
agreement with the staff report.
PUBLIC HEARING The public hearing was opened to those who wished to
speak.
PROPONENTS Erica Wirtala, of Sands Surveying, spoke on behalf of Owl
Corp. stating the number of school children estimated was a
best guess. She said that because Village Greens is a golf
course there were approximately 8 to 12 children at present
and estimates of 40 to 50 school children might be high. She
said they took that same number into consideration when
working with the park, which is why they didn't create
additional parkland dedications and thought the existing
parkland was more than adequate. She said there are plans
for a recreation center. Wirtala clarified condition #15 and
offered some alternative wording, that preliminary approval
for each phase be valid for a period of three years from the
date of each approval.
Paul Price, 224 W. Nicklaus Ave., said he was in favor of the
proposed annexation but against certain areas of the plat as
proposed. He said he was against Lots 3 thru 8 in Phase 16.
He said there were two natural drainages and he had
concerns about storm water, mudslides, and slough -off. He
thought if they opened it up and increased the angle of slope
they would have a bad situation. Other than that he thought
it looked good. He found the park recommendation weak for
adding number of lots proposed and asked what was done
with the money in lieu. He said there were not many
children but the older people liked to use the park areas too.
He thought it would be good to take the money in lieu and
put in a nice restroom and wean away from the port -a -potty.
Gary Schand, 402 Kings Way, spoke in opposition of the
proposal. He understood that when they first put in the golf
course there was a portion along the river that was never to
be developed. He said it was a bird refuge and were always
told it would never be bothered, which effected Lots 1BD,
1BC, 1BB, IBA, and 1BE to the east. He stated that the
developer came in and mowed out all the brush 12 to 15 feet
from where they were building. He said this was wetland
and no habitat can come in now because they came in and
backfilled where the brush was and completely destroyed 5
or 6 acres of wildlife habitat that had been there for years.
He thought they should have looked at it prior to doing this
and stated that animals don't have voting rights. He thought
it would have been a nice buffer zone. He said they were
trading a lot of commercializing for wildlife and where they

once were protected they now don't have any place to go. He
didn't think it was necessary and was astonished that they
mowed all except a 20-foot fringe on the water line.
Angie Kruckenberg, 1116 Sunnyside Dr., stated that the old
master plan said we were to protect wildlife, fish and fowl in
the Flathead Valley. She said that if we eradicate the places
where these animals live we are destroying the best times of
everyone's lives. The old plan says do not destroy the
habitat, it's important. She wondered if it was because we
were in between an old growth plan and a new one that we
were allowed to do this. She said we should protect the
natural habitat we have around us.
No one else wished to speak and the public hearing was
closed.
MOTION
Atkinson moved and Anderson seconded to adopt staff report
KA-02-12 as findings of fact and recommend to the Kalispell
City Council that the initial zoning for this property should
be R-4, Two -Family Residential, upon annexation.
BOARD DISCUSSION
Atkinson commented on the points that were brought up,
especially the slope. He asked if engineering had problems
and Wilson said that was the purpose of condition #4 and
the geo-technical analysis. Atkinson asked what would
happen if they found the slope to be inadequate and Wilson
said the lots would have to be eliminated.
Atkinson asked if it was determined if that was a wildlife
refuge and Wilson said, not to her knowledge. She said the
board could add language to the conditions of approval
addressing that issue, essentially stating that any wildlife
habitat disturbed along the Whitefish River during
construction be re-established along with Montana
Department of Conservation and Montana Fish & Wildlife's
best management practice in re -vegetating those areas.

MOTION
Atkinson moved and Brechel seconded to adopt staff report
KPP-02-7 as findings of fact and recommend to the Kalispell
City Council that the variance to secondary access be
granted subject to conditions that require secondary
emergency access to be developed in accordance with the
Fire Marshall's recommendations and additional hydrants be
placed within the subdivision as required to meet the
uniform fire code.

Atkinson moved and Anderson seconded to adopt staff report
KPP-02-7 as findings of fact and recommend to the Kalispell
City Council that the preliminary plat be approved subject to
15 conditions, as recommended by staff.
BOARD DISCUSSION
Atkinson asked if staff had any problem with changing
condition #15 and Wilson said it should read, with a three
year extension on each phase of the plat as it is filed.
Wilson also recommended two additional conditions; one,
that the 100-year flood plain be delineated on the final plat
and two, if the board wished, that they address the
reestablishment of the wildlife habitat that was disturbed
during construction.
Brechel asked her to explain delineating the 100-year flood
plain and Wilson said, so they know where it is.
Van Natta commented on the eastern lots that were wildlife
habitat. He said that if they build townhouses they would
not be able to reestablish the entire area. Wilson deferred to
Mr. Sands.
Sands stated they were not arguing it was wildlife habitat
because any area that is brush is wildlife habitat. He
addressed the floodplain issue stating it was not in the
floodplain. He said they went through it with a fine-tooth
comb and the floodplain map shows it is right at the rivers
edge. He said it's not in a wetland area, but a thick, brushy
area that was a protection area between the Kings Loop area
and the Whitefish River. He said things change and they
have to deal with the loss of habitat and what people do with
their back yards. The properties in Village Greens were
cleaned up alongside the banks and most people were re -
vegetating. He said they opened up the west side and it was
not 6 acres, but closer to an acre and a half that had been
disturbed. He noted the back slopes of the fill areas would
maintain cautious fill for drainage.
MOTION (AMENDMENT)
Atkinson moved and Anderson seconded to amend condition
#15 to read, with a 3 year extension for each phase of the
final plat as it is filed.

Van Natta commented that meant they could have 20 years
of extensions. Wilson agreed.

Atkinson commented that it was not to determine whether it
was in or out of the flood plain, but thought it good planning
to have designations involved in the final plat.

BOARD DISCUSSION
There was a lengthy discussion on the re -vegetation of
wildlife habitat along the river.
Mr. Owens stated this was not an established wildlife refuge
and they needed to be careful. He said that using words like
re -construct or re-establish implied they created a problem
by removing the brush. He offered that if they wanted the
appropriate entities to review it they could let them make the
decision as to what had to be done down the road. Wilson
agreed.
The board discussed a possible amendment to add a
condition # 17 regarding re -vegetation and it was concluded
that management standards were not regulatory, however,
they could build on condition # 14. Mr. Sands stated there
was a Streamline Protection Act that had rules for 20-feet of
the high water mark, but no rules beyond that and nobody to
enforce it.
Mr. Owens stated they had not touched anything within 20
plus feet of the river. He said that one guy's wildlife refuge is
another man's brush pile.
It was concluded there would not be a motion.
Van Natta asked if they needed to mention specific lots for
the geo-technical analysis and Wilson thought they needed to
keep it more general in this case.

OLD BUSINESS
Atkinson announced he would not be able to make it to
tomorrow night's workshop.
NEW BUSINESS
Wilson commented on the reason for including Ordinance
No. 1435, the establishment of planning board members'
terms. She offered to send a letter asking members to
reapply. She said that with the board's concurrence she
would write a memo to the City Council or City Attorney
asking that all terms be extended until April rather than
December and that Council member terms come due in two

Availability of Public Services and Utilities
The broad -based extension of services plan, together with this "mini -plan," comprises
the Extension of Services Plan for this annexation. Once annexed to the City, full City
services will be made available to the property owner. The subject property is within the
Service Area Boundary of the City of Kalispell as described by the Extension of
Services Plan City of Kalispell adopted on November 5, 1995 (Resolution #4241).

Water: An eight inch water main belonging to the Evergreen Water District is in place
along Ritzman Drive and connects East and West Nicklaus Avenues. This water main
also serves a hydrant located on the north side of Ritzman Drive and west of proposed
LotlA of Glacier Village Greens Phase XII. Adequate capacity to serve the site is available
once the extension is made.
Sewer: An eight inch sewer main exits along Ritzman Drive between East Nicklaus and
West Nicklaus Avenues. This main currently belonging to the North Village Sewer
District but maintained by the City of Kalispell Public Works Department via an
interlocal agreement with the District. The main delivers effluent to a lift station in the
northern portion of Buffalo Hills Golf Course west of Fairway Boulevard Townhouses.
The wastewater treatment plant has sufficient capacity to service this property.
Storm Drainage: A storm drain system lies to the west of the Glacier Village Greens
Development that serves several developments in the area. However, no storm drainage
system exists in the immediate area of this site. Infiltration and natural absorption areas
are proposed to mitigate any potential storm runoff associated with development of the
site.
Streets: East and West Nicklaus and well as Ritzman Lane was taken over by the City of
Kalispell as part of the annexation of the Glacier Village Greens development. The City
currently maintains the roadway that will service these lots as part of the road
maintenance in the subdivision .
Garbage Collection: Available by contract from private companies.
Police Protection: Flathead County Sheriffs Department.

Fire Protection: Evergreen Fire Department.
Anticipated Service Needs and Costs:
Water: An eight inch water main which will belong to the Evergreen Water District is to
be constructed from the north end of an existing eight inch main at the north end of
Glacier Village Greens, Phase IV, to the north end of an existing eight inch main at the
north end of Glacier Village Greens, Phase VI. This main will be approximately 3,350
feet in length and loop the north end of West Nicklaus Avenue to the north end of Palmer
Drive. An eight inch water main which will belong to the Evergreen Water District is to
be constructed from the north end of an existing eight inch main at the north end of
Glacier Village Greens, Phase XI, to the north end of Glacier Village Greens, Phase 18,
and from there will loop through Glacier Village Greens, Phase 22, to tie back into the
eight inch water main at the north end of Glacier Village Greens, Phase 14. This main
will be approximately 1,880 feet in length. The total water main to be constructed is
approximately 5,230 feet. All water mains will be constructed within the street right-of-
ways. Fire hydrants will be placed at the distances recommended by the city fire
department. Adequate capacity to serve the site is available.
There would be no additional maintenance costs associated with this since the
Evergreen Water District maintains the system.
Sewer: An eight inch sewer main will be constructed from an existing sewer manhole at
the north end of Glacier Village Greens, Phase IV, north along West Nicklaus Avenue to a
manhole to be located between Lots 8 and 12A of Glacier Village Greens, Phase 16. An
eight inch sewer main will be constructed from a proposed manhole to be located
between Lots 10B and 11A of Glacier Village Greens, Phase 16, east along West Nicklaus
Avenue to a proposed sewer lift station to be located near the north end of Glacier Village
Greens, Phase 19. An eight inch sewer main will be constructed from a proposed sewer
lift station to be located near the north end of Glacier Village Greens, Phase 19, south
along Palmer Drive to a proposed manhole to be located near Lot 13 of Glacier Village
Greens, Phase 17. An eight inch sewer main will be constructed from a proposed
manhole to be located between Lots 4 and 14 of Glacier Village Greens, Phase 17, south
along Palmer Drive to an existing sewer manhole at the north end of Glacier Village
Greens, Phase VI. A sewer force main of approximately 1,200 feet in length will be
constructed from the proposed sewer lift station to the nearest available sewer manhole.
An eight inch sewer main will be constructed from an existing sewer manhole at the
north end of Glacier Village Greens, Phase XI, north along East Nicklaus Avenue to the
north end of Glacier Village Greens, Phase 18, from where it will contiune east and south
through Glacier Village Greens, Phase 22, to tie in the to eight inch sewer main to be
constructed through Glacier Village Greens, Phase 14. All sewer mains and the sewer for
main will be constructed within the street right-of-ways. The total sewer mains to be
constructed will be approximately 5,090 feet. The sewer mains will belong to the North
Village Sewer District but will be maintained by the City of Kalispell Public Works
Department via an interlocal agreement with the District. The Glacier Village Greens
sewer collection system delivers effluent to a lift station in the northern portion of Buffalo
Hills Golf Course west of Fairway Boulevard Townhouses. The wastewater treatment
plant has sufficient capacity to service this property.
• The sanitary sewer operation and maintenance costs associated with this
development will be approximately $27,944 per year at full build out. This includes
the collection and treatment of the sanitary sewerage generated by the residents.
Although the sewer infrastructure will be considered new, the downstream
maintenance costs increase as flows increase. These costs will be offset through
revenue generated by the monthly sewer use fees paid by the sewer service
customers.
Storm Drainage: No storm drain system exists in the area. Storm water flows can be
handled on site with natural absorption areas for infiltration since these properties are
adjacent to the golf course. The terrain is generally level with grass on the course for
vegetation resulting in minimal erosion or drainage problems during and after
development.
• No new storm water management facilities will be developed, owned or maintained by
the developer or the City of Kalispell and no additional costs would be incurred.
Streets: The north end of West Nicklaus Avenue located at the north end of Glacier
Village Greens, Phase IV, is to be constructed to the north end of Palmer Drive located at
the north end of Glacier Village Greens, Phase VI. The north end of East Nicklaus
Avenue located at the north end of Glacier Village Greens, Phase XI, is to be constructed
through Glacier Village Greens, Phase 14, 18 and 22. There is an emergency vehicle
access provided for the north end of East Nicklaus Avenue. The City will maintain the
roadways that will service these lots as part of the road maintenance in the subdivision.
• As the development builds out, the increase in maintenance costs will be offset by the
increase in income from levies. As the income from the levies increases it will provide
for additional personnel and/or equipment for the maintenance of the streets. The
street maintenance costs associated with this development will be approximately
$6,850 per year. This amount per year is the anticipated amortized cost of a single
chip seal treatment of the pavement every five years ($3900/year), plus the cost
($16.67 per lot for 177 lots) for pothole repair, street sweeping and snow plowing.
Solid Waste Collection: The City of Kalispell can and would provide solid waste pick-up
for the site when this property becomes eligible for municipal service.
• Some additional services, equipment or other costs would be incurred by the solid
waste department for garbage collection as a result of the development of these lots
that has not been quantified.
Police City of Kalispell Police Department will be available to provide services to this
property upon annexation at approximately the same level as other properties within the
City albeit response times may be delayed because of the distance of this property from
the fire and police stations.
• Based on the 2000 U.S. Census information the average household size in the city of
Kalispell is 2.21 people. Using this assumption, there would be an additional
approximately 389 people added to the city population once this subdivision is fully
occupied. According to the Kalispell police department, the cost of services is
$55,062 per 500 residents per year or approximately $110 per resident per year.
Additional costs to the police department would be 389 x $110= $42,790 per year.

Fire: City of Kalispell Fire Department will be available to provide services to this
property upon annexation at approximately the same level as other properties within the
City albeit response times may be delayed because of the distance of this property from
the fire and police stations.
Based on the 2000 U.S. Census information the average household size in the city of

approximately 389 people added to the city population once this subdivision is fully
occupied. According to the Kalispell fire department, the cost of services is
approximately $68.84 per person per year. Additional costs to the fire department

City Administration: The City of Kalispell would provide administrative services to the
residents of the subdivision from the mayor and city council; city manager, city attorney,
finance department and city clerk.
The combined budgets of the city manager, mayor, city clerk, city attorney and city
court is approximately $576,251. The estimated population based on the 2000
census and with a 1.3 percent annual increase would be 14,595. Per capital cost for
administrative operations would be approximately $39.48. With an additional 389
people estimated to be added to the population, additional administrative costs are
estimated at $15,358.

A report to the Kalispell City Planning Board and the Kalispell City Council regarding
an initial zoning designation of R-4 upon annexation to the city of Kalispell. A public
hearing has been scheduled before the Kalispell City Planning Board and Zoning
Commission for November 12, 2002, beginning at 7:00 PM, to consider appropriate
zoning for the area proposed to be annexed. The planning board will forward a
recommendation for appropriate zoning to the Kalispell City Council for consideration.
The developer has petitioned for annexation and an initial zoning designation of R-4, a
Two -Family Residential district, on approximately 29.041 acres on the north side of
Glacier Village Greens Golf Course. East and West Nicklaus Drives will be extended to
the north with West Nicklaus Drive eventually connecting with Palmer Drive.
Currently the property is zoned County R-5, a Two -Family Residential district, under
the Flathead County Zoning Regulations. A preliminary plat for a 173-lot residential
subdivision to be platted as Glacier Village Greens Phases 14 through 22 has been
submitted concurrently with this annexation and initial zoning request.
This report evaluates the appropriate assignment of a City zoning classification in
accordance with Section 27.03.010(4) of the Kalispell Interim Zoning Ordinance. The
Kalispell City Council has annexed all other phases of the Glacier Village Greens
development in previous actions and have assigned a zoning designation consistent
with the R-4 that is being requested for this property. This property will be annexed
under the provisions of Sections 7-2-4601 through 7-2-4610, M.C.A., Annexation by
Petition.

B. Location and Legal Description of Property: A request by Owl Corporation on
behalf of Glacier Village Greens, Inc. for annexation into the city of Kalispell and
an initial zoning designation of R-4, Residential, for what will be platted as Glacier
Village Greens Phases 14 through 22 on approximately 29.041 acres. The
property proposed for annexation can be described as a portion of Assessors
Tracts 2A+ in Section 32, Township 29 North, Range 21 West, P.M.M., Flathead
County, Montana.

C. Existing Zoning: The properties proposed for annexation are in the County
zoning jurisdiction and are in the Evergreen and Vicinity Zoning District. The
property proposed for annexation are currently zoned R-5, Two -Family
Residential. This district is defined as "A residential district with minimum lot
areas. Development within the district will require all public utilities and all
community facilities. Duplexes are allowed in this district." Permitted uses in
this district are generally limited to residential uses. The conditionally permitted
uses allow some non-residential uses but those are limited to churches, daycare
centers, mini and RV storage, RV Parks and campgrounds and golf courses. The
minimum lot size requirement of the County R-5 zoning district is 5,400 square
feet.
D. Proposed Zoning: The proposed R-4, Two -Family Residential, zone allows
duplexes and single-family residences as permitted uses and has a minimum lot
size requirement of 6,000 square feet and a width of 50 feet. The proposed City
R-4 district more closely reflects the existing and intended uses for Village Greens
than does the City R-5, Residential / Professional Office.
E. Size: The area proposed for annexation and zoning contains approximately 0.604
acres.
F. Existing Land Use: The property proposed for annexation is currently
undeveloped.
G. Adjacent Land Uses and Zoning: The land use in the area is primarily single
family residential along with some duplex town -homes. The golf course and
clubhouse are part of the Glacier Village Greens development, but are not part of
the area proposed for annexation.
H. General Land Use Character: The general land use character of this area
surrounding the golf course development can be described as primarily
residential, but with some non-residential uses that would generally be
considered support services such as the church and school. A neighborhood
commercial development on the corner of West Evergreen Drive and Whitefish
Stage Road is in the process of being developed.
I. Utilities and Public Services: All available public services and facilities will be
provided to these properties at the same level of service as other properties
similarly situated in the city limits.

EVALUATION BASED ON STATUTORY CRITERIA
The statutory basis for reviewing a change in zoning is set forth by 76-2-205, M.C.A.
Findings of fact for the zone change request are discussed relative to the itemized
criteria described by 76-2-203, M.C.A.
Does the requested zone comply with the Master Plan?
The property proposed for annexation was previously designated as Urban
Residential in the former Kalispell City -County Master Plan and current zoning
assignments in the both the City and County were based upon that land use
designation. Staff is recommending that the Glacier Village Greens area be
given a City zoning designation of R-4, Two -Family Residential, consistent with
other zoning adopted for the development.
Is the requested zone designed to lessen congestion in the streets?
No significant increase in the impacts to the area will be created from annexing
these properties into the City. The uses would be consistent with those
anticipated in the area. Whitefish Stage Road is anticipated for an overlay
between Idaho and West Reserve Drive in the fall of 2002.
3. Will the requested zone secure safety from fire panic, and other dangers?
No features on the property exist which would compromise the safety of the
public. Any new construction would be required to be in compliance with the
building safety codes of the City which relate to fire and building safety.
Adequate access is available to accommodate emergency vehicles and life safety
equipment.
4. Will the requested zone promote the health and general welfare?
The proposed zoning classification will promote the health and general welfare
by helping to promote the goals of the master plan for the area and encouraging
compatible uses in the area.
Will the requested zone provide for adequate light and air?
Setback, height, and coverage standards for development occurring on this site
are established in the Kalispell Zoning Ordinance to insure adequate light and
air is provided. Proposed development standards under the City R-4 zoning are
similar to the existing County R-5 zoning.
6. Will the requested zone prevent the overcrowding of land?
The proposed zoning designation attempts to provide some consistency in the
development standards that are currently in place and have governed the
development of the area since its inception. The proposed zoning attempts to
prevent the overcrowding of land by providing similar standards.
7. Will the requested zone avoid undue concentration of people?
Minimum lot standards and use standards, as well as subdivision development
standards, will avoid the undue concentration of people at the time future
properties are developed.
8. Will the requested zone facilitate the adequate provision of transportation,
water, sewerage, schools, parks, and other public requirements?
All public services and facilities are currently available or can be provided to the
property. Services to the area will be provided on a basis that is consistent with
all other properties inside the city limits.
9. Does the requested zone give consideration to the particular suitability of the
Property for particular uses?
The proposed zoning designation is generally consistent with the land use
designations of the master plan and with the existing uses that have developed
in the area. The zoning gives adequate consideration to the suitability of the
land proposed for zoning.
10. Does the requested zone pave reasonable consideration to the character of the
district?
The general character of the area is primarily single-family residential and
town -homes with some supporting uses such as the churches, school and
neighborhood commercial under development in the area. The proposed zoning
has attempted to create a residential designation for the Village Greens area
similar to that which exists and under which the development was originally
conceived.
11. Will the proposed zone conserve the value of buildings?
Value of the buildings in the area will be conserved because the proposed
zoning attempts to accommodate existing uses and providing the zoning that
would accommodate the intended uses for the area in the future.
12, Will the requested zone encourage the most appropriate use of the land
throughout the municipality?
The proposed zoning is in substantial compliance with the other zoning of the
golf course development and consistent with zoning that has been assigned in
both the City and the County areas.
SUMMARY AND DISCUSSION
The proposed City R-4 zoning is the same zoning that has been assigned to other
phases of Glacier Village Greens and is a continuation of the same pattern of
development. Extension of services to the site to City standards will take place as part
of the development of the subdivision. Adequate access is available to serve the

property and any future development will be consistent and compatible with existing
development in the area. Public services and the facilities serving this subdivision will
be extended and constructed in accordance with the City of Kalispell Extension of
Services Plan and the Kalispell Design and Construction Standards.
RECOMMENDATION:
It is recommended that the Kalispell City Planning Board and Zoning Commission
adopt Staff Report #KA-02-12 as findings of fact and forward a recommendation to the
Kalispell City Council to adopt R-4, Two -Family Residential, upon annexation.

the City of Kalispell for annexation of the real property described below into the City of

The Petitioner(s) requesting City of Kalispell annexation of the property described herein and
further described in Exhibit A hereby mutually agree with the City of Kalispell that immediately
upon annexation of the land all City of Kalispell municipal services will be provided to the
property described herein on substantially the same basis and in the same manner as such services
are provided or made available to other properties within the rest of the municipality.
Petitioner(s) hereby state that there is no need to prepare a Municipal Annexation Service Plan for
this annexation pursuant to Section 7-24610, M.C.A. since the parties are in agreement as to the
provision of municipal services to the property requested to be annexed.
The Petitioner(s) further herein express an intent to have the property as herein described
withdrawn from the EVERGREEN Rural Fire District under the provisions of Section 7-33-
2127, Montana Code Annotated; and that incorporated into this Petition to Annex is the Notice
requirement pursuant to said Section; and that upon proper adoption of an ordinance or resolution
of annexation by the City Council of the City of Kalispell, the property shall be detracted from

Attached with this memo is information relating to items that will go before the
planning board on the above referenced date. You will note that three of the four
items were continued from the August meeting because of various unresolved issues.
1. Annexation and zoning request by Owl Corporation for an initial zoning designation
of R-4, a Two Family Residential district upon annexation into the city of Kalispell
for Glacier Village Greens Phases 14 thru 22. A preliminary plat for these phases
has been submitted concurrently with the request for annexation. The property to
be annexed will be platted as Glacier Village Greens Phases 14 thru 22 on 29.041
acres located near the northern portion of the Glacier Village Greens golf course.
2. Preliminary plat request by Owl Corporation for approval of Glacier Village Greens
Phases 14 through 22, creating 173 lots for single family and duplex townhouses
in the northern portion of the Glacier Village Greens Golf Course. These phases
will extend West Nicklaus Avenue, Palmer Drive and East Nicklaus Avenue to the
north. A request for annexation has been submitted with the preliminary plat for
these phases.
These items will go before the Site Development Review Committee now meeting in the
City Hall Conference Room while the Kalispell Building Dept undergoes a remodel.

portion of Assessor's Tracts 2A in Section 32, Township 29 North, Range 21 West,
P.M.M., Flathead County, Montana.
