Kennedy and Kalispell City Council Charles Harball, City Attorney Chris Kukulski, City Manager Fluoridation Election August 19, 2002 BACKGROUND: An initiative measure has been successfully petitioned to place the issue of fluoridation of the Kalispell municipal water supply on the ballot of the November 2003 regular election. Council may elect, by resolution, to have the matter placed on the November 12, 2002 ballot for voter consideration. If this decision is to be made, it must be made prior to August 27, 2002 (at least 75 days prior to election). RECOMMENDATION: No specific recommendation is being made here by legal counsel. Be aware that very little time or effort has been made to educate the public on this issue and that perhaps more time may be beneficial before the voters consider the issue. FISCAL EFFECTS: The cost to the City for either election will likely be the same. The cost of setting up a fluoridation system is not insubstantial and should be taken into consideration at some point. Respectfully submitted, 00 Charles Ha II, City Attorney Chris Kukulski, City Manager RESOLUTION NO.4738 A RESOLUTION CALLING FOR A SPECIAL ELECTION ON THE QUESTION OF FLUORIDATING THE MUNICIPAL WATER SUPPLY SYSTEM FOR THE CITY OF KALISPELL, TO BE HELD IN CONJUNCTION WITH THE GENERAL ELECTION ON THE 12TH DAY OF NOVEMBER, 2002. WHEREAS, the City of Kalispell operates the municipal water supply system for the City of Kalispell, and WHEREAS, that water supply is not fluoridated, and WHEREAS, the Oral Health Program at the Centers for Disease Control and Prevention and the Montana Department of Public Health and Human Services have set standards for the fluoridation of municipal water supplies, and WHEREAS, fluoridation of a water supply system has been shown to reduce tooth decay, and WHEREAS, a petition has been successfully circulated to City of Kalispell registered voters requesting that the City of Kalispell fluoridate its municipal water supply, and WHEREAS, the County Election Department has certified that the petitions are correctly signed by at least 15% of the City's registered voters, and therefore is qualified to go on the November, 2003 ballot, and WHEREAS, under § 7-5-136(1)(b), MCA, the City Council may call a special election in conjunction with a regular election on the question, putting said question on the November, 2002 ballot. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, AS FOLLOWS: SECTION I. That the City Council of the City of Kalispell does hereby refer to a vote of the electors of the City of Kalispell a proposal to fluoridate the Municipal Water Supply of the City of Kalispell, pursuant to § 7- 5-136(1)(b), MCA. SECTION II. That the proposal shall be submitted to the electors of the City at a City Special Election to be held on November 12, 2002. SECTION III. That the City Clerk and the City Attorney are hereby directed to forthwith prepare the necessary statements, notices, and ballot issue material to assist the Flathead County Election Administrator to have VAattsect\wp\res\4738 fluoridation.wpd the question of fluoridating the municipal water supply submitted to the electors as set forth herein.
