Resolution 4692 - Glacier Village Greens AssessmentsCity of Kalispell Public Works Department Post Office Box 1997, Kalispell, Montana 59903-1997 - Telephone (406)758-7720, Fax (406)758-7831 REPORT TO: Mayor and City Council FROM: Jim Hansz, Director of Public Works SUBJECT: Assessments in Glacier Village Greens MEETING DATE: April 15, 2002 BACKGROUND: During the community meetings preceding the annexation of Glacier Village Greens (GVG) there was considerable discussion of the impact of City assessments on the properties to be annexed. The City Manager correctly pointed out that the subdivision plats presently require proportioning parkland in each phase equally to the lots in that phase. The example that was reported to the Council October 11, 2000, and discussed in previous homeowner meetings, involved an average homeowner share of parkland area of 3,050 square feet per lot. It was indicated that this would be the typical amount added to the average lot, it usually having an average size of 6,500 square feet. In preparing the current year assessment roll it has become clear that some property owners actually will be affected to a much greater degree than will their neighbors. Some phases of GVG have no homeowner parkland; others have a large amount. While the current average is still 3,050 square feet, lots in phase IV would be assessed an additional 11,395, square feet, and lots in phase VIII would be assessed nothing extra. We see this as a problem when viewed in the context of pre -annexation discussions and property owner expectations. Annexation was presented to the residents as having a certain financial impact. This will not be the case. It will vary greatly between property owners with essentially the same size parcel. With the City Council presently considering other assessment changes, we believe Glacier Village Greens assessments for homeowner parkland should be equalized and set at the average amount. This is currently 3,050 square feet but may change as new phases are constructed. This action will provide the desired equity and not lead to justifiable dissatisfaction when assessments are received. RECOMMENDATION: Staff recommends setting assessments in Glacier Village Greens for homeowner parkland based on the average amount per residential lot. ACTION REQUESTED: MOTION TO APPROVE A RESOLUTION SETTING SPECIAL ASSESSMENT QUANTITIES FOR HOMEOWNER PARKLAND IN GLACIER VILLAGE GREENS AT A UNIFORM AVERAGE AMOUNT TO ENSURE EQUITY BETWEEN PARCELS AND CONSISTENCY WITH PRE -ANNEXATION COMMITTMENTS. Chris A K skVJi Director of Public Work y Engineer City Manager Report compiled April 9, 2002 RESOLUTION NO. 4692 A RESOLUTION SETTING SPECIAL ASSESSMENT QUANTITIES FOR HOMEOWNER PARKLAND IN GLACIER VILLAGE GREENS AT A UNIFORM AVERAGE AMOUNT TO ENSURE ASSESSMENT EQUITY BETWEEN PARCELS AND CONSISTENCY WITH PRE - ANNEXATION COMMITMENTS. WHEREAS, all phases of the Glacier Village Greens Subdivision were annexed on October 16, 2000, with an effective date of November 1, 2001, and WHEREAS, the Glacier Village Greens Subdivision plat requires proportioning parkland in each phase to the lots within that phase, and WHEREAS, the various phases of Glacier Village Greens have differing quantities of parkland, thereby creating disproportionate assessment values for comparable properties between phases, and WHEREAS, in order to assure equitable assessments within Glacier Village Greens, the average amount of the total subdivision parkland per residential lot, currently 3,050 square feet, should be used for assessment purposes for residential lots. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA: SECTION I. That the homeowner parkland assessments for Glacier Village Greens be equalized at a value equal to the average amount of total subdivision parkland per residential lot, currently 3,050 square feet. SECTION II. This Resolution shall become effective immediately upon passage by the City Council and approval by the Mayor.
