BACKGROUND: This is a request by the City of Kalispell Parks and Recreation
Department to allow the construction of a community pool and skate park in the
northeast portion of Woodland Park. Woodland Park is zoned P-1, Public, which lists
community pools as a conditionally permitted use. The pool and skate park will
occupy approximately 3.5 to 4.0 acres of Woodland Park and will include a pool area,
skate park, bathhouses, concession area, picnic an viewing area as well as a new
parking lot and landscaping. The new facility will be funded through the sale of
general obligation bonds in the amount of $3,675,00 which was approved by the
Kalispell voters in the election last November.
Parks and Recreation Director Michael Baker, representing the City of Kalispell,
attended the public hearing before the planning board and explained the project in
detail. He answered questions and concerns the board had with regard to the
operation and maintenance of the new facility.
The Kalispell City Planning Board held a public hearing at their regular meeting of
March 12, 2002. No one from the neighborhood spoke either in favor or in opposition
to the project. A motion was made and passed on a vote of six in favor and one
opposed, with Jean Johnson voting in opposition, to grant the conditional use permit
subject to the conditions recommended in the staff report.
RECOMMENDATION: A motion to approve the conditional use permit subject to
conditions would be in order.
FISCAL EFFECTS: Minor positive impacts once developed.
ALTERNATIVES: As suggested by the city council.

The Kalispell City Planning Board and Zoning Commission, after
due and proper notice, on March 12, 2002 held a public hearing on
the application, took public comment and recommended that the
application be approved subject to three conditions.
After reviewing the application, the record, the Tri-City
Planning Office report, and after duly considering the matter, the
City Council of the City of Kalispell, pursuant to the Kalispell
Zoning Ordinance, hereby adopts Tri-City Planning Office,
Conditional Use Report #KCU-02-1 as the Council's findings of fact,
and issues and grants to the above -described real property a
conditional use permit to construct a community pool/aquatic
facility and skate park in the P-1, Public zoning district subject
to the following conditions:
SECTION I.
1. That the development of the facilities shall be in
substantial compliance with the approved site plan.
2. That the fire access and suppression system be reviewed
and approved by the Kalispell Fire Department and for
compliance with the Uniform Fire Code.
3. That the drainage plan and the extension of public
utilities and facilities be reviewed and approved by the
Kalispell Public Works Department.

The Kalispell City Planning Board met on March 12, 2002, and held a public hearing
to consider a request by the City of Kalispell to allow the construction of a community
pool and skate park in the northeast portion of Woodland Park. Woodland Park is
zoned P-1, Public, which lists community pools as a conditionally permitted use. The
project includes a pool area, skate park concession area, picnic and viewing areas as
well as the development of a new parking lot and landscaping. The entire project is
anticipated to cover approximately 3.5 to 4.0 acres. The new pool facility will replace
the aging Bruckhauser pool which will be retired and the area redeveloped as a picnic
area and the buildings used for equipment storage and public restrooms.
Narda Wilson, of the Tri-City Planning Office, presented staff report KCU-02-1
evaluating the project. No comments had been received from property owners in the
area. Staff recommended approval of the conditional use permit subject to the three
conditions listed in the staff report.
At the public hearing, Parks and Recreation Director Mike Baker represented the City
of Kalispell and explained the project to the planning board. There were no other
comments to be presented to the board at the meeting.
After the public hearing, the board discussed the proposal. A motion was made and
passed on a vote of six is favor a one opposed, with Jean Johnson voting in opposition,
to forward a recommendation to the city council that the conditional use permit be
granted subject to the conditions outlined on attached Exhibit A.

The Kalispell City Planning Board is recommending the following conditions to the
Kalispell City Council for the above referenced conditional use permit request. A public
hearing was held on this matter at the march 12, 2002 planning board meeting:
1. That the development of the facilities shall be in substantial compliance with the
approved site plan.
2. That the fire access and suppression system be reviewed and approved by the
Kalispell Fire Department and for compliance with the Uniform Fire Code.

put the road about twenty feet away from the house and that would make an
uncomfortable buffer. Rigosovitch asked how many houses they were proposing to
put in the area.
Wilson stated there is no development proposal at this time and when there is one he
would receive another notice of public hearing and a copy of the preliminary plat.
Rigosovitch commented on the original zoning in the area. He understood they were
created because of the type of property that was there. He said that reclassifying
property from Agricultural to Residential was done because it was already de -treed
and the bumps and lumps taken out, so it made it the most economical land to put
houses on. He thought at some point the Valley would grow to the point where there
was no more farmland or agriculture. He wondered why they didn't pick a rock pile on
the edge of the hills where it's not good for anything else. Rigosovitch added that in
Europe they safe guard their agricultural land and build on the surrounding hills, so
they still have a viable economy. He thought it was important to think about that
when rezoning property that had already been set aside for agriculture.
Spooner asked if he used his property for agriculture and Rigosovitch said the land
originally belonged to his wife's grandparents and that it is less than an acre. He said
they just had a huge garden, half of which is in the right of way for the road.
No one wished to speak and the public hearing was closed.
Board Discussion
Atkinson moved and Rice seconded to adopt staff report KA-02-2 as findings of
fact and recommend to the Kalispell City Council that the initial zoning for this
property should be R-3, Residential, upon annexation into the city.
Atkinson commented on the growth pattern in an urban standard and stated the
proposed zoning was a logical growth pattern for the city because the land was
touching city boundaries. He thought it met all the requirements of the master plan
for the area.
Wilson addressed the issue of the preservation of agricultural land. She stated that
when you can take 25 acres and obtain urban services to get a density of 60 to 70 lots
that fill a need within the community and conserve agricultural land that is viable and
located further outside the city limits, they had to accommodate the influx of new
people coming into the valley.
The motion passed unanimously on a roll call vote.

Staff Report #KCU-02-1
Narda Wilson, of the Tri-City Planning Office, gave a presentation of staff report KCU-
02-1, a request to allow the construction of an aquatic facility and skate park in
Woodland Park in the northeast part of the park where ball fields are currently
located. The new aquatic facility will replace the existing Bruckhauser pool to the
southwest of the new pool site. Wilson described the pool as a leisure aquatic facility,
which would have approximately 11,000 square feet of surface area, and a bathhouse
that would have approximately 8,000 square feet with changing rooms. Wilson added
the skate park would be between 5,000 to 10,000 square feet with entire project
covering an area of approximately 3.5 to 4.0 acres. The project would also include
concession and seating areas for pool viewing, picnic seating, fencing, parking,
landscaping, and roadway improvements in the area of Woodland Park. Wilson stated
the project would be funded through the sale of general obligation bonds and the
amount of $3,675,000, which was approved by the City of Kalispell voters as
November. Wilson reviewed the project according to the evaluation criteria for
conditional use permits. Staff recommended adoption of staff report KCU-02-1 as
findings of fact and recommended approval subject to the three conditions listed in the
staff report.
Presentation by the Applicant
Mike Baker, Director of City Parks and Recreation, gave a brief report on the proposal
and answered questions from the board. Baker stated the proposed pool and
skateboard park would be a part of Woodland Park that would be monitored and
maintained by the Parks Department's full time maintenance staff and they would be
able to accommodate more kids in a safer manner. He anticipated some minor
changes in design and layout that would not effect the parking lot or the location of
the parking, the pool or skate park. He said the overall pool capacity would increase
but that it was not a significant increase. The population and demographics of the
area was assessed and met all of the criteria for a neighborhood planned skate park.
Baker said there were stringent insurance regulations and it would be constructed to
meet that criteria. There would be no increase to the City's insurance costs because of
the pool or skate park. He was optimistic about reaching out to the community with
this project and how it was being received.
Johnson asked if the County was approached in a formal written request regarding
partnering with the pool project. Baker said no, they were not formally asked to
participate because they indicated they were not interested and had not been
interested in partnering in other projects in the past such as the new athletic complex.
Johnson asked about the difference in user fees between the City and the County.
Baker gave tentative numbers of five dollars for a City resident all day pass and eight
dollars for City non-residents. This would given them access to all of the activities
that would be offered at the pool. They City anticipates that based on these fees the
pool facility would generate some revenue. The skate park would be free.
There was a brief discussion about season passes and how the concessions would be
operated. Baker explained they were not sure about any of the costs yet associated
with the passes or how the concession would be handled.

Board Discussion
Brechel moved and Anderson seconded to adopt staff report #KCU-02-1 as
findings of fact and recommend to the Kalispell City Council that the
Conditional Use Permit be granted subject to three conditions, as listed in the
staff report.
Johnson encouraged City staff, when there is an expenditure of 3.6 million dollars and
it's going to be enjoyed by the County residents, not to assume the Commissioners or
the County are not going to become a party to it and insist they become a party to it.
Anderson agreed.
The motion passed on a roll call vote with six in favor and one opposed.
Johnson voted in opposition.
OLD BUSINESS
No old business was discussed.
NEW BUSINESS
There was a brief discussion on future work programs, such as the growth policy plan,
land use issues, and resource documents. It was concluded that because of
negotiations between the City and County regarding boundaries they would wait until
an agreement was reached before continuing.
Wilson noted that the board would be working on developing an annual work program
probably in May.
ADJOURNMENT
The meeting was adjourned by motion at approximately 8:35 p.m. The next regular
meeting of the Kalispell City Planning Board and Zoning Commission will be held on
Tuesday, April 9, 2002, at 7:00 p.m.

A report to the Kalispell City Planning Board and Kalispell City Council regarding a
request by the City of Kalispell for a conditional use permit to allow the operation of a
community pool and skate park in a P-1, Public, zoning district. A public hearing on
this matter has been scheduled before the planning board for March 12, 2002,
beginning at 7:00 PM in the Kalispell City Council Chambers. The planning board will
forward a recommendation to the Kalispell City Council for final action.

1. Size and Location: The development of a community pool / aquatic facility
and skateboard park would take place in the northeastern portion of Woodland
Park. Woodland Park is a City park located at the northwest comer of Conrad
Drive and Woodland Park Drive. It contains approximately 38.5 acres. The
property can be described as Assessor's Tract 30A+ located in Section 8,
Township 28 North, Range 21 West, P.M.M., Flathead County, Montana.
2. Nature of Request: The City is applying for a conditional use permit to allow
the construction of an aquatic facility and skate park in Woodland Park in the
northeast part of the park where ball fields are currently located. The new
aquatic facility will replace the existing Bruckhauser pool to the southwest of
the new pool site. The pool is described as a "leisure aquatic facility" and will
gave approximately 11,000 square feet of surface area. This will include a lap
and instruction pool, diving pool, shallow play area for children, water slide
and river ride areas. There will also be a bathhouse that will have
approximately 8,000 square feet with changing rooms for family, women and
men as well as first aid and lifeguard rooms. There will be concession and
seating areas for pool viewing and picnic seating. The skate park will be
between 5,000 to 10,000 square feet with the facilities covering an area of
approximately 3.5 to 4.0 acres_ The project will also include fencing, parking,
landscaping and roadway improvements in this area of Woodland Park.
The pool and skate park will be funded through the sale of general obligation
bonds in the amount of $3,675,000. The bond sale was approved by the City of
Kalispell voters in the election last November. The bonds will have a 20 year
term. There is a general breakdown of the cost of the pool, skate park and
other improvements included in the application, but generally the cost of the
pool will be approximately $1,334,200, bath house will cost $969,800, skate
park will cost $130,000, site development costs are estimated at $555,000 and
the remaining costs will be for the other site improvements, the concession
stand and equipment. It is anticipated that the bid for the facility will be
awarded in the summer of 2002 and the project will be completed by summer
of 2003.
D. Existing Land Use and Zoning: This area of Woodland Park has been used
for ball fields in the past and there are some bleachers and backstops in the
general vicinity of the new facilities. The zoning for the property is P-1, Public.
Community pools are listed as a conditionally permitted use in the P-1 zoning
districts.
E. Surrounding Zoning and Land Uses Zoning: The land uses surrounding
Woodland Park are a mix of commercial and residential in the immediate area.
The specific land uses and zoning are as follows:
North: Small businesses, B-2 zoning
South: Small businesses and residences, B-1 and R-3 zoning
East: Businesses, mini -storage and residences, City B-1 and
County R-5 zoning
West: Single-family homes, R-3 zoning
F. Master Plan Designation: This land use designation for this property is
indicated on the Kalispell City -County Master Plan Map as public. This
proposal can be found to be in compliance with the master plan.

H. Evaluation of the Request:
a. Adequate Useable Space: The entire area of Woodland Park contains
approximately 38.5 acres. The area where the pool and skate park are
proposed will occupy approximately 3.5 to 4.0 acres in the northeast
portion of the park. This area will easily accommodate the pool, skate
park, concession area, bathhouses, parking, landscaping and any other
necessary improvements.
b. Adequate Access: Access to the pool area and skate park would be
taken from two existing accesses into the park. The main access to the
pool area would likely be taken off of Woodland Park Drive to the east,

with another existing access to the south from Conrad Drive to the
south. Access to the site is good.
C. Environmental Constrain= This property is generally level and has
some limited environmental constraints associated with topography to
the north and drainage. There are no significant constraints associated
with the property that would not be easily overcome with the
development of the site or that would result in any degradation to the
environment.
a. Parking Sc_he=: There is existing parking in Woodland Park that would
be used in association with the park as well as the pool and skate park
that exists throughout the park. Overall there are approximately 175
existing parking spaces with 51 parking spaces near Bruckhauser pool,
approximately 20 parking spaces in the lot immediately to the southwest
of the pool area, an additional 30 spaces near the pond to the south as
well as other parking further to the west. An additional 66 parking
spaces would be developed in conjunction with the pool and skate park
facility. Of those 10 employee spaces will be to the northeast of the
facility, 22 spaces adjoining the pool area and 33 spaces between the
pool area and the skate park. Bike racks will also be provided directly
outside of the bathhouse area.
b. Traffic Circulation: Traffic circulation and access to the site is generally
good with Woodland Park Drive providing the main access to the
facilities. Conrad Drive will provide a secondary access to the south.
These are existing accesses that will use existing paved roadways within
the park. The will be a drop-off area via a new loop driveway between
the pool and the skate park areas. Traffic circulation in and around the
site is generally good and will be adequate to accommodate the
anticipated vehicle traffic associated with the operation of the pool
facilities as well as for emergency vehicles.
C. f42e1 3 ace: No formal open space requirements are required under the
zoning ordinance other than the required setbacks, however, there are
lawn areas that exist to the south as well as to the east and west. Open
space is also provided with lawn areas, walkways and landscaping that
exists throughout Woodland Park.
d. Fencing/ScrePning Land-cai ing: There is some landscaping currently
existing on site which will be maintained along with additional
landscaping provided with raised grassy mounds for viewing, newly
planted trees and shrubbery in the landscape areas to the west and
south of the pool and surround the skate park. Landscaping will also be
provided within the parking lots and within the pool area. The existing
tree buffer to the south will be maintained as well as some of the
existing lawn areas.

e. image: The only signage that will be used in conjunction with the pool
and skate park will be directional signage for traffic flow and control.
There is an existing sign at the entrance to Woodland Park from Conrad
Drive to the south that will not be changed.
a. Schools: This property is within the boundaries of School District #5.
Because this involves the creation of a recreational facility, no specific
impacts on the school district can be anticipated as a result of this
proposal.
b. Parks and Recreation: The effects this project will have on the
recreational opportunities within the community will be tremendous and
will provide a variety of activities to serve a broad citizen base. The
contribution to the parks and recreation services will be substantial.
C. police: This property is currently served by the Kalispell Police
Department. No substantial increase in impacts to the police can be
anticipated as a result of the proposed expansion.
d. Fire Protection: The fire access and suppression system will be
improved by increasing the fire flow capabilities in the immediate area by
extending a water main along Woodland Park Drive and looping into the
existing main in the park. Hydrants will be located in strategic areas
within the facility and the buildings will be constructed to comply with
the Uniform Fire Code. A fire access and serve land has been
established near the north part of the park. The Kalispell Fire
Department has been involved in the development of the fire
suppression and access for the site during the preliminary stages of the
projects and will continue to be involved with the project to its ultimate
completion.
e. Water and Sewer: City water and sewer currently serve the property.
New utilities will be required to be extended to the project site to
accommodate new hydrants as well as the bathhouse and concession
area. There will not be a significant impact on these services as a result
of this project.
f. Solid: Solid waste pick-up will be provided by the City of
Kalispell. No significant impacts on the County landfill can be
anticipated as a result of this development.
g. Roads: Primary access to the site will be gained from Woodland Park
Drive to the east, a paved County road. This roadway was recently
upgraded by the County with an overlay of asphalt and widening of the
street. A secondary access to the site will be to the south off of Conrad
Drive, a paved City street. The roads in the area are adequate to
accommodate the new recreational facility_

h. Immediate Neighborhood Impact: The general character of this area is
commercial with some residential uses to the west and limited
residential to the south. The overall impact to the area will be a
moderate increase in traffic along Woodland Park Drive to the east and
minimal impacts to the areas to the south and west. The pool facility
will operate from 6:00 AM to 11:00 PM seven days a week from June
until the end of August. The traffic impacts associated with the pool will
be seasonal. The skate park will be open year round weather permitting.
The impacts associated with the skate park will be minimal.
RFAGTION OF NF RRY PROPERTY OWNER
A notice of public hearing was mailed to property owners within 150 feet of the
subject property approximately 15 days prior to the hearing. At the time of writing
the staff report, no comments have been received by the staff.
RTTMMARY OF FINDERCM
1. The size and location of the site is adequate to accommodate the proposed
project.
2. The site with regard to the location of the facilities, buildings, parking and
landscaping area is in compliance with the standards of the City.
3- Existing public services and facilities are adequate to accommodate the
proposed use.
4. Positive impacts to the immediate neighborhood and community can be
anticipated such as the expansion of recreational opportunities for a broad
section of the community, enhancement of the park facilities, reduction in
problems associated with skateboards in the downtown areas and on private
property.

a. Traffic flow and control:
Traffic flow and control will be handled with designated drive lanes in and around the
shared parking area located east of the pool and west of the Skate Park. This parking area
is accessed from the interior two lane paved park road to the south of the site. In addition
there is a one way drop off two-lane drive directly south of the pool.
b. Access to and circulation within the property:
Access to and from the aquatic / skate park facility and surrounding open spaces will be
handled with existing two lane paved roads entering the park from the east off of
Woodland Park Drive and from the south off Conrad Drive. The park has adequate
designated drive lanes throughout the remainder of the park that will provide ample
traffic flow and control.
C. Off — Street Park and loading:
The proposed design of the aquatic / skate park facility includes a shared parking lot
consisting of 66 parking spaces, .located between the pool area and skate park. This
includes 10-employee spaces northeast of the facility, 22 spaces adjoining the pool area
on the east and 33 spaces to the west of the skate park. There is additional existing
parking of approximately 20 spaces located southwest of the pool area, and additional
existing parking areas throughout the park that will service any over flow. There will be
a fire and service lane located at the north end of the parking lot. Bike racks will be
located directly outside of the bathhouse to the east. A one way two-lane drop off drive
traveling east to west and accessed from the entry to the parking lot will be located south
of the pool area.
d. Refuse & service areas:
The plan provides for a sufficient refuse and service area, located at the north end of the
parking lot and east of the bath house.
e. Utilities
Utilities exist to Woodland Park and will be extended to the site for the new facility.
f. Screening and buffering:
Screening and buffering will be achieved through existing trees and topography of the
site (large hill bordering northeast) and with additional landscaping. The plan provides
for raised mounded grass viewing, and includes newly planted trees and shrubbery in
landscape buffers to the west and south of the pool, and surrounding the skate park and in
and around the parking lot. An existing dense treed area to the south will remain.
g. Signs, yards and other open spaces:
Only regulation signage will be placed to direct traffic flow. Woodland Park is
approximately 37 acres and provides large expanses of open space and green areas
around the entire project site.
Height, bulk & location of structures:
The facility is planned for the northeast comer of Woodland Park. The structures are
designed to be aesthetically pleasing and in conformance with a community pool facility.
The pool facility will generally include the pool, bathhouse, concessions, Skate Park and
related site development and improvements on a site area of approximately 3.5 to 4.0
acres.
The pool will consist of a generally irregular configuration of approximately 11,000
square feet of surface area and will include: instruction and lap swimming, diving,
shallow child play area, tower water slides and a lazy river ride. The bathhouse will
consist of approximately 8,000 square feet in area and will include: entry, tickets and
passes, exterior pool viewing area, family change room, women's change room, men's
change room, guard's room and first aid area. Concessions will consist of concessions
for pool and park area, pool viewing and picnic seating, concessions access, vehicle drop
area and safety fence. The skate park will consist of approximately 8,000 - 10,000 square
feet of skate park The site development will include support of a pump building and
emergency access. Please see attached site plans for specific locations of facilities.
h. Location of proposed open space uses.
The new aquatic / skate park facility will be constructed in the northeast comer of the
existing Woodland Park, on a site area of approximately 3.5 to 4.0 acres. This existing
park setting will allow for large expanses of open space to the west of the facility, along
with additional open spaces located directly south of the drop off lane, south of the
parking lot and north and south of the skate board park.
Hours and manner of operation.
Park hours are from 6 a.m. to 11 p.m — 7 days a week. The existing Bruckhauser pool
facility will be in operation through the summer of 2002, while the new facility is under
construction. Construction is scheduled to begin July 17, 2003. The new facility will
open June of 2003 from the last day of school (approximately 2"d week of June) until the
first day of school (approximately last week in August). The skate park will open in
May of 2003 and open will remain open weather permitting, throughout the year.
j. Noise, light, dust, odors, fumes and vibration.
During the summer of 2002, there will be additional noise, dust and vibration during the
construction of the pool. These construction impacts (noise, dust, etc.,) will be limited.
Summer 2003 will consist of the normal sounds of children / adults at play and will be
very comparable to the existing Bruckhauser pool. Sounds of children playing consisted
with a park atmosphere will be characteristic of this area and project. However, due to
the new location noises will have a tendency to be buffered more due to site features,
topography and existing landscaping.
Also the new site is further removed from residential areas along Woodland Avenue.
Lighting will consist of existing street lights and some security lights for the buildings.
After dark activities will not be lighted or promoted. The pool will require chlorine and
other chemicals necessary to operate a pool facility but should not have a negative or
dangerous impact in the way of fumes or odors. There should not be any vibration
impact associated with this facility once it is opened..

The City of Kalispell proposes to construct a leisure pool facility within Woodland Park, Kalispell,
Montana. The mechanism for funding the project is selling of bonds approved by the City voters
for the project amount of $3,675,000.00. The project is defined as a "leisure pool facility" and is
intended to replace the existing Bruckhauser Pool located in Woodland Park, Kalispell, Montana.
The pool facility will generally include the pool, bathhouse, concessions, skate park & related site
development. The pool will consist of a generally irregular configuration of approximately 11,000
