Kukulski, City Manager SUBJECT Foppiano Construction - Annexation and Initial Zoning of R-3 MEETING DATE: November 3, 2003 BACKGROUND: This is a request by Foppiano Construction, Inc. for an initial zoning designation of R-3, Single Family Residential on 1.0 acre of land located on the east side of Denver Avenue immediately east of the intersection with Phoenix Street. The property presently contains a single-family residence. This R-3 zoning designation anticipates single-family housing as a permitted use with minimum lot sizes of 7,000 square feet. The property is currently zoned county R- I single-family residential with a one -acre minimum lot size. Note that a 4-lot minor subdivision on this property was submitted to the planning office for review and action just prior to consideration or the zoning proposal by the planning board. A minor subdivision is not submitted to the planning board for consideration, instead it goes directly to the City Council for consideration. The proposed 4-lot subdivision does comply with the requested R-3 zoning. On October 14, 2003 the Kalispell City Planning board held a hearing for the purpose of determining the most appropriate zoning for this property. At the hearing, the applicant's representative spoke in favor of the purposed R-3 zoning, no one spoke in oppositions and the hearing was closed. After the public hearing the Board discussed the request and its relationship to the surrounding neighborhood noting that this is a continuation of the pattern of development on three sides. A motion to adopt staff report #KA-03-19 as findings of fact and forward a recommendation that initial zoning for this property should be R-3 as recommended by the staff upon annexation passed on a unanimous vote of 6-0. A completed cost of services analysis is attached for your review. RECOMMENDATION: A motion to adopt the first reading of the ordinance for R-3 zoning upon annexation would be in order. FISCAL EFFECTS: Minor positive impacts once fully developed. ALTERNATIVES: As suggested by the City Council. SECTION II. Upon the effective date of this Resolution, the City Clerk is directed to make and certify under the seal of the City, a copy of the record of these proceedings as are entered on the minutes of the City Council and file said documents with the Flathead County Clerk and Recorder. From and after the date of filing of said documents as prepared by the City Clerk, or on the effective date hereof, whichever shall occur later, said annexed territory is part of the City of Kalispell and its citizens and property shall be subject to all debts, laws and ordinances and regulations in force in the City of Kalispell and shall be entitled to the same privileges and benefits as are other parts of the City. SECTION III. The territory annexed by this Resolution shall be zoned in accordance with the Kalispell Zoning Ordinance. SECTION IV. At the public hearing the applicant's representative spoke in favor. There was no other public comment. After the public hearing the Board discussed the request and the density allowed under the proposed zoning. A motion to consider R-3 zoning passed on a unanimous vote of 6--0 to adopt staff report KA-03-18 as findings of fact and forward a recommendation that initial zoning for this property should be R-3 as recommended by the staff upon annexation. Peter Pappas, Architect, Deaver CO, stated he was available to answer questions. PUBLIC COMMENT No one else wished to speak and the public hearing was closed. MOTION Atkinson moved and Johnson seconded to adopt staff report KPP-03-10 as findings of fact and, based on these findings, recommend to the Kalispell City Council that the preliminary plat for this subdivisionn be approved subject to the 10 conditions. BOARD DISCUSSION Hull asked Marquardt if there were any proposals to bury the creek. Marquardt answered not at this time. Jentz said burying the creek would create a liability. Atkinson asked Pappas if the storm water system was doable. Pappas answered that according to studies they have done, it is. He said they will lift the building pads to get the buildings out of the flood plain, and will reconfigure the detention pond. Hull commented that Dairygold was fined $5.2 million for polluting this stream, that this stream has been the subject of a lawsuit, and that the applicants cannot fill it. Jentz said the flood plain development permit program is sophisticated and there is a limit to what the applicants can do. He said that a designated flood way is a "no touch" area. Kalispell City Planning Board Minutes of the meeting of October 14. 2003 Page 9 of 12 STAFF REPORT KA-03-19 Torn Jentz, with the Tri-City Planning Office, gave a presentation of Staff Report KA-03-19, a request by Foppiano Construction, Inc. for initial zoning of R-3, Single Family Residential, on approximately 1 acre upon annexation to the City of Kalispell. Jentz showed a site plan. He stated this is a one acre parcel. There is an existing single family home in the .middle of the parcel that is for sale. Ashley Meadows is the eastern boundary, and the proposed street will form the southern boundary, which is surrounded by subdivisions. He stated this will be a minor subdivision with four lots going in. He said the applicants are requesting R-3 zoning and they want to build four single family homes. It is in compliance with the growth policy. PUBLIC HEARING The public hearing was opened to those who wished to speak on the issue. APPLICANTS/AGENCIES Jim Burton., surveyor for the project, stated that R-3 fits with the developer's plan, and the lots are larger than the zone requires, and is the next possible subdivision to come in. He said they want to come into the city and hook up to services. PUBLIC COMMENT No one else wished to speak and the public hearing was closed. MOTION Anderson moved and Atkinson seconded to adopt staff report KA-03-19 as findings of fact and, based on these findings, recommend to the Kalispell City Council that the initial zoning be R-3, Single Family Residential, on approximately I acre upon annexation to the City of Kalispell. BOARD DISCUSSION Atkinson asked if the adjacent lot was in the county. Jentz answered that the owner of Ashley Meadows lived there and developed the subdivision around his home. Hull asked if the South Meadows Drive on the map was an easement or if it was a road. Jentz answered it is a road, but it goes over wetlands and needs a bridge. A public hearing has been scheduled before the planning board for October 14, 2003 beginning at 7:00 PM in the Kalispell City Council Chambers. BACKGROUND INFORNAATION This report evaluates the appropriate assignment of a city zoning classification in accordance with Section 27.03.010(4) of the Kalispell Zoning Ordinance. The developer has petitioned for annexation and initial zoning classification of R-3; a Single -Family Residential district. The property is currently in the County zoning jurisdiction and is zoned County R-1, a Suburban Residential District. Location and Legal Description of Property: The property proposed for annexation lies cast of Lome Pine View Estates on the east side of Denver immediately the east of the Phoenix Street intersection. The property proposed for annexation and initial zoning can be described as Assessor's Tract 7AACA ( Tract 2 of COS # 11,352) in Section 19, Township 28 North, Range 21 West, P.M.M., Flathead County, Montana. C. Existing zoning: The property is currently in the County zoning jurisdiction and is zoned R-1, Suburban Residential. The suburban residential district is intended to serve as an area where limited density would be encouraged such as in the 100-year floodplain or on steep slopes or in areas where estate type development is anticipated. D. Proposed Zoning: City R-3, Single -Family Residential, has been proposed for the property. The R-3 zoning district allows single-family dwellings as permitted uses. The minimum lot size for the district is 7,000 square feet and a minimum lot width of 60 feet with setbacks of 20 feet in the front, 20 feet in the rear and five feet on the sides. E. Size: The area proposed for annexation and zoning contains approximately I acre. F. Existing Land Use: Currently this property is in residential use. Zoning: The immediate area is characterized by single-family homes on urban sized lots. To the west lies Lone Pine estates. A new subdivision, Ashley Meadows, received preliminary plat approval this spring on property, to the south and east. North: Large lot subdivision with single -fancily homes, County R-1 zoning East: Single-family homes; City R-4 and County R- l zoning South: Ashley Meadows, City R-4 zoning. West: Single-family homes, Lone Pine Estates, City R-3 zoning H. General Land Use Character. The area can be described as a pocket of rural land within an area of transition between the urban areas of Kahsuell to the east and the more rural undeveloped area of the county to the west. The immediate area is characterized by new single-family homes on urban sized lots to the west, south and east with larger single-family homes on larger lots to the north. An urban density residential subdivision, Lone Pine Vieux Estates, lies immediately to the west of this property across Denver and both Ashley Meadows and the Stratford Subdivision which are urban density subdivisions are currently under development on approximately 30 acres to the south of this property. I. Availability of Public Services and. Extension of Services: Public services, including City water and sewer, are available to this site and will be extended into the property in accordance with the City of Kalispell's Extension of Services Plan and an accordance with Kalispell's Design. and Construction Standards. EVALUATION BASED ON STATUTORY CRITERIA The statutory basis for reviewing a change in zoning is set forth by 76-2-205, M.C.A. Findings of fact for the zone change request are discussed relative to the itemized criteria described by 76-2-203, M.C.A. Does the requested zone comply with the growth policy? The property is designated by the Kalispell Growth Policy future land use map as "Urban Residential" which anticipates residential development with a density of between 3 to 12 dwelling units per acre. Because of the provision of public water and sewer to the site, the proposed R-3 zoning designation is in compliance with the future land use designation for the area. The R-3 zoning has a minimum lot size requirement of 7,000 square .feet per unit. This same development .pattern is reflected in the R-3 zoned subdivision to the west, Lone Pine Estates. The property currently contains a single-family residence. The owner has indicated a desire in the near future to create several additional single-family lots. The proposed zoning is in compliance with the anticipated land use for the area. 2. Is the re nested zone deli ed to lessen con§zestion in the streets? The immediate neighborhood is single-family in nature. The proposed zoning reflects this and will insure that this pattern will continue. if the property is developed additionally in the future, the intensity of development from this site will be minor in nature and will insure that the adjacent traffic routes are not unduly burdened. #KA-03-19 Rage 2 of 4 3. WiL the requested zone secure safety from fire, panic, and ,other angers? Adequate access and public facilities are available to the site in the case of an emergency. There are no features related to the property which would compromise the safety of the public. New construction =ill be required to be in compliance with the building safety codes of the City which relate to fire and building safety. All municipal services including police and fire protection, water and sewer service is available to the area and will be extended as part of the development of this property at some point in the future. 4. Will the requested zone promote the health and general welfare? The requested zoning classification will promote the health and general welfare by restricting land uses to those such as single --family residences, that would be compatible with the adjoining properties and providing a place for new housing in the community. 5. Will the requested zone provide for adequate light and air? Setback, height, and coverage standards for development occurring on this site are established in the Kalispell. Zoning Ordinance to insure adequate light and air is provided. 6. Will the requested zone prevent the overcrowding of land? As previously noted this area has been anticipated for urban residential development and now that public water and sewer are in Denver and immediately available to this site, an R-3 zoning designation is appropriate. The property presently has a single- family residence. Future re -development of the site could accommodate upwards of 3 more lots. All public services and facilities will be available to serve the existing residence. Any overcrowding of land would occur if infrastructure were inadequate to accommodate the development in the area. This is unlikely to occur. 7. Will the requested zone avoid undue concentrations of people? Minimum lot standards and use standards as well as subdivision development standards will avoid the undue concentration of people at the time the property is developed. 8. Will the requested zone facilitate the adequate provision of transportation, water, sewerage, schools arks and other ublic requirements? All public services and facilities are currently available or can be provided to the property. Development should be encouraged in areas where these services are available. Parkland is limited in this Location.. The annexation of this lot will not increase the impact to parks as the current house already exists on this property. 9. Does the requested zone give consideration to the particular suitability of the prope for -particular uses? The proposed R-3 zoning district is consistent with the surrounding zoning and land uses in the area and gives due consideration of the suitability of this property for the permitted uses in the district. 4KA-03-19 Page 3 of 4 10. Does the requested zone give reasonable consideration to the character of the district? The general character of the area to the east, ,vest and south is urban sized lots for residential development. The same type of development can be anticipated to occur on this property and will be consistent with the character of the district. 11. Will the proposed zone conserve the value of buildings? Value of the buildings in the area will be conserved because the R-3 zoning will promote compatible and like uses on this property as are found on other properties in the area. 12, Will the requested zone encourage the most..iappropriate use of the land throughout the municipality? Urban scale residential development should be encouraged in areas were services and facilities are available such as is being proposed on this parcel. The proposed zoning is consistent with the future land use designations for the area and surrounding zoning in the area. RECOMMENDATION It is recommended that the Kalispell City Planning Board and Zoning Commission adopt Staff Report #KA-03-19 as findings of fact and recommend to the Kalispell City Council that the initial zoning for this property upon annexation be R-3, Single -Family Residential.
