Kukulski, City Manager SUBJECT Kalispell Public Schools / Edgerton School - Annexation and Initial Zoning Upon Annexation of P- 1, Public MEETING DATE: May 19, 2003 BACKGROUND: This is a request for an initial zoning designation of P- 1, Public, upon annexation to the city for property that lies on the west side of Whitefish Stage Road and north of West Evergreen Drive. The property is occupied by Edgerton School, an elementary school in the Kalispell Public Schools. The property contains approximately 8.44 acres and is connected to the Kalispell sewer via the North Village Sewer District. The City has been interested in having the school district annex this property in the past because of the connection to sewer, but it has become somewhat more important of late because of the amount of annexation and development that has occurred in the area. The property has become surrounded by the city limits and generally been left as an island in the county. All of the parties have agreed that the annexation of the school is timely. Currently the property is in the County zoning jurisdiction and is zoned County RA- 1, a Residential Apartment zoning district. A public hearing was held before the Kalispell City Planning Board at a special meeting of April 29, 2003 regarding this matter. No one was present to speak either in favor or in opposition to the proposed zoning upon annexation. A motion was made and passed unanimously by the Kalispell Planning Board to forward a recommendation to the Kalispell City Council that initial zoning for this property should be P- 1, Public, upon annexation to the city. RECOMMENDATION: A motion to adopt the first reading of the ordinance for P-1 zoning upon annexation would be in order. FISCAL EFFECTS: Minor impacts related to the provision of services. Public Schools / Edgerton School - Annexation and Initial Zoning of P- 1, Public Dear Chris: The Kalispell City Planning Board met on April 29, 2003 and held a public hearing to consider a request by the Kalispell Public Schools for an initial zoning designation of P-1, Public, upon annexation into the city for Edgerton School. The school property proposed for annexation and initial zoning is located on the west side of Whitefish Stage Road and north of West Evergreen Drive. It contains approximately 8.44 acres and has been developed as an elementary school. Because of recent development and annexation in the area, this property has become nearly wholly surrounded by the city Emits. Because it is on the City of Kalispell sewer system via the North Village Sewer District, the City has been desirous of having this property annexed for quite some time. The property has been approved for annexation by the school board as required under the state statutes for the annexation of contiguous government land and subsequently a request for annexation was submitted. Narda Wilson, of the Tri-City Planning Office, presented staff report KA-03-4 evaluating the proposed zoning. She noted that the Kalispell Growth Policy recognizes this property as public land and the property would likely remain a school with some potential for future expansion because of the size of the site. The staff recommended that the board forward a recommendation for P-1, Public, zoning upon annexation. There was no one at the public hearing to speak either in favor or in opposition to the proposal and the public hearing was closed. The board briefly discussed the use of the property for a school and the fact that it was nearly an island in the area. They agreed that the annexation was timely. A motion was as made and passed unanimously to recommend to the Kalispell City Council that the property be zoned P- 1, Public, upon annexation to the city. MOTION Anderson moved and Taylor seconded the motion to adopt staff report KA-03-7 as findings in fact and recommend to the Kalispell City Council that the property be zoned B-2 upon annexation. BOARD DISCUSSION Johnson wanted to know why they applied for B-2 zoning but going to use it as multi -family. Graham responded that the B-2 is consistent with the zoning in the area and allows them a number of permitted uses, including the multi -family as a permitted use. EDGERTON SCHOOL This is a request by Kalispell School District #5 for the initial REQUEST FOR INITIAL zoning designation of P-1, Public, upon annexation of ZONING OF P-1 UPON Edgerton School to the city of Kalispell. ANNEXATION STAFF REPORT Wilson gave a staff report to the board and noted that the school district is requesting the annexation of Edgerton School located at 1400 Whitefish Stage Road. The property contains approximately 8.44 acres and is used as an elementary school operated by the Kalispell Public Schools. The property get sewer from the City of Kalispell via the North Village Sewer District and is surrounded by Buffalo Stage and other development that is now inside the city limits. The City wanted the school district to ask for annexation because it was one of the few parcels in the area on the City sewer system that is not in the city. The proposal went to the school board as is required under statute and the administration official has requested annexation. The property is currently in the county and is zoned RA-1, a residential apartment district. There is mixed residential and some support non-residential uses in the area. The Kalispell Growth Policy recognizes this as public land so the P-1 is an appropriate zoning designation. This property will not likely develop into something other than a school. The staff recommends that the Kalispell City Planning Board and Zoning Commission adopt staff report KA-03-4 as findings of fact and forward a recommendation to the Kalispell City Council that the initial zoning for this property should be P-1, Public, upon annexation. BOARD DISCUSSION Rick Hull said he believes this property was originally set apart from the subdivision as a school site. ROLL CALL The motion passed unanimously on a roll call vote. ADOPTION OF KALISPELL Consideration of adoption of the Kalispell Interim Zoning INTERIM ZONING Ordinance as a permanent document in compliance with the ORDINANCE Kalispell Growth Policy 2020. STAFF REPORT #KZ-03-1 Wilson presented a staff report and noted that on September 26, 2002 the Attorney General for the State of Montana issued an interpretation for 1999 legislation relating to the growth policy that has had a significant impact on the City of Kalispell and other communities with regard to zoning and zone amendments. The opinion stated that only non - substantive changes could be made after October 1, 2001 in zoning matters until a compliance growth policy is in place. Since several substantive and non -substantive changes had been made between October 1, 2001 and the time of the opinion, the Kalispell City Council adopted an interim ordinance to ratify those changes while the growth policy was in progress, at the advice of the city attorney. The Kalispell City Council adopted the Kalispell Growth Policy 2002 on February 18, 2003. The growth policy provides the legal basis for the adoption of zoning regulations. Because the growth policy has been adopted, adoption of a permanent Kalispell Zoning Ordinance will finalize the previous amendments, both substantive and non -substantive changes. This action is more of an administrative gesture than a substantive change. There were some changes that were made with the interim document which changed references the Flathead Regional Development Office to the Tri-City Planning Office, the Kalispell City -County Planning Board to the Kalispell City Planning Board and references to the master plan were changed to growth policy and so on. Adjacent Land Uses and Zoning: Most of the properties surrounding the school are residential in nature with the exception of a professional / medical office building to the northeast and a church to the south. The remaining properties in the area are well -established residential uses. The Buffalo Stage area to the north, south and west is in the city of Kalispell and is zoned RA- 1, a Residential Apartment district although the primary housing type is single family with some duplex town homes. To the east are well -established residential subdivisions of Mission Village and Hillcrest Subdivision, which are in the county and have a zoning designation of R-2, Residential. The primary housing type to the cast is single-family. G. General Land Use Character: This general land use character of this area can be described as being residential in character with a few non-residential uses in the area. The school proposed for annexation is one non-residential use along with a professional / medical office, a church and small commercial development to the south at the northeast comer of West Evergreen Drive and Whitefish Stage Road. H. Availability of Public Services and Facilities: Edgerton School is served by the City of Kalispell sewer treatment plan via the North Village Sewer District. Evergreen Water District provides water to the facility. Fire and police services will be provided by the Kalispell Police Department and the Kalispell Fire Department once the property is annexed. The police will be responsible for responding to the site in case of incident. The fire department will respond in case of fire or medical emergencies. The statutory basis for reviewing a change in zoning is set forth by 76-2-205, M.C.A. This has traditionally provided an area for the Edgerton School and there is no reason to believe that the land would be used in another manner. The proposed zoning appears to be suitable for this property and the area in general. The general character of the area is primarily residential with some non-residential uses in the immediate area.
