BACKGROUND: This is a request by Grant Spoklie for amendments to the Kalispell
Zoning Ordinance to reduce the parking requirements for beauty and barber shops
from three spaces per operator or one space per 100 square feet whichever is greater
plus one space per employee to a requirement that would be two parking spaces per
operator.
The Kalispell City Planning Board met on April 8, 2003 and held a public hearing to
consider this request to the zoning ordinance. The planning staff and zoning
administrator have worked with the applicant to try to find a reasonable approach to
parking for these uses and supported the applicants proposal. P.J. Sorensen,
Kalispell Zoning Administrator, also addressed the planning board and said this
particular parking requirement has been problematic particularly with the
requirement for parking based upon square footage. He supported the proposed
change and said he felt it was a reasonable and practical requirement.
At the public hearing no one spoke either in favor or in opposition to the proposed
zoning text amendment. The board discussed the proposed reduction in the parking
requirements. There was some concern expressed that if there was a popular shop
with customers waiting there wouldn't be adequate parking. The board generally felt

A motion was made and passed unanimously that the planning board recommend to
the Kalispell City Council that the proposed amendments be approved as proposed.

AN ORDINANCE AMENDING SECTION 27.26.050(4) OF THE KALISPELL INTERIM
ZONING ORDINANCE, (ORDINANCE NO. 1439), BY AMENDING THE PARKING
REQUIREMENTS FOR BEAUTY AND BARBER SHOPS, AND DECLARING AN
EFFECTIVE DATE.
WHEREAS, Grant Spoklie has submitted a written request to amend Section 27.26.050(4) of the
Kalispell Interim Zoning Ordinance, by amending the Off Street Parking
requirements for Beauty and Barber Shops from three spaces per operator to two
spaces per operator, and
WHEREAS, the request was forwarded to the Kalispell City Planning Board and Zoning
Commission by the Tri-City Planning Office after having been evaluated under
27.14.030, Kalispell Interim Zoning Ordinance, and
WHEREAS, the Kalispell City Planning Board and Zoning Commission recommended that two
parking spaces be required per operator in any area that allows Beauty or Barber
Shops as a conditional or permitted use, and
WHEREAS, the City Council has reviewed the TCPO Report and the transmittal from the
Kalispell City Planning Board and Zoning Commission and hereby adopts the
findings made in Report #KZTA-03-2 as the Findings of Fact applicable to this
Ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL AS FOLLOWS:
SECTION I. The City of Kalispell Interim Zoning Ordinance, Ordinance No. 1439,
is hereby amended as follows on Exhibit "A", attached hereto and
thereby made a part hereof.
SECTION II. All parts and portions of Ordinance No. 1439 not amended hereby
remain unchanged.
SECTION III. This Ordinance shall take effect thirty (30) days after its final passage.

The regular meeting of the Kalispell City Planning Board and

Commission regular meeting of March 11, 2003.

STAFF REPORT
Narda Wilson, with the Tri-City Planning Office, gave a
#KZTA-03-2
presentation of staff report KZTA-03-2, an amendment to the
Kalispell Interim Zoning Ordinance proposed by the
applicants to amend Section 27.26.050(4), Off Street Parking
for Beauty and Barber Shops. Staff reviewed statutory
criteria and recommended the proposed amendment be
approved. She noted that from practical experience the
required parking could be excessive particularly when based
on the one space per 100 square feet. The amendment from
requiring three spaces per operator to two spaces per
operator seemed more reasonable than the current
requirements. This was based on research of how other
communities regulate parking for this use.

MOTION
Atkinson moved and Johnson seconded to adopt staff report
KZTA-03-2 as finding of fact and, based on these findings,
recommend to the Kalispell City Council that the proposed
amendment to the Kalispell Interim Zoning Ordinance be
approved.
BOARD DISCUSSION
Atkinson said he saw the logic of the proposal but was
concerned about the size or Popularity of the shop resulting
in 2 to 3 customers waiting for a chair.

Wilson said this request was based on research and
experience in practice. PJ Sorenson, Zoning Administrator
for the City of Kalispell addressed the board and agreed that
smaller beauty salons do not seem to need the extra parking.
He said the additional square footage evaluation pushes the
parking requirements beyond reasonable need.
Atkinson said reducing the excess parking would be a
positive aspect to reduce density in downtown Kalispell and
this might help in a small way.
Norton asked and Sorenson answered that a house converted
to a beauty shop or house with mixed used would be
analyzed based on square footage devoted to each business.
Taylor asked if this amendment would have any negative
effect on any existing beauty or barber shop. Wilson
answered that she thought it would create a positive effect by
potentially freeing up additional space for other uses.
Van Natta said his concern was the possibility of having
more than one customer in the shop with the operator at one
time. Wilson said if there were concerns about inadequate
parking at the one to two space ratio, the ratio could be
increased to 2.5 spaces per operator.
Atkinson asked if that change would adversely affect the
applicant but Wilson said she didn't think it would.
MOTION (AMENDMENT)
Hull offered an amendment to change the required number
of parking spots to 2.5 lots per operator No second was
heard and the motion died for lack of a second.

forward a recommendation to the Kalispell City Council for final action.

shops as a permitted or conditionally permitted use could potentially be effected by
the proposed change. This would include primarily commercial areas of the City.

D. Staff Discussion: The applicant is interested in developing a parcel located in a
commercial area of the City with a beauty shop. In assessing his practical parking
needs the parking requirements appeared to exceed what was required and
reasonable for the proposed use. In discussion with the staff regarding this issue,
both the Zoning Administrator and planning staff tended to agree that the parking
requirements for these types of uses is excessive. The staff worked with the applicant
to determine what a reasonable and practical ratio of parking would be. The staff
consulted professional publications regarding the matter as well as comparing what
other communities of similar size did to address parking requirements for beauty and
barber shops. Some of the requirements were based on square footage generally in
the range of one space per 250 square feet and some were based on a ratio of
operators to parking spaces.
After considering the various alternatives, the staff generally agreed that the most
straightforward and reasonable formula would be based upon two spaces per
operator. The rationale behind this is that typically the operator would serve one
client at a time that would require one parking space. The operator would also
need a parking space thus generating a need for two spaces per operation.

Typically beauty and barber shops do not have additional employees who do not
perform a service function.
The statutory basis for reviewing a change in zoning is set forth by 76-2-205, M.C.A.
Findings of Fact for the zone change request are discussed relative to the itemized
criteria described by 76-2-203, M.C.A.

The Kalispell Growth Policy encourages commercial activity to be directed to
existing commercial as either expansion or infill. The use of zoning for the
implementation of the growth policy goals and objectives is a primary tool. This
amendment to the zoning regulations furthers the goals and objectives of the
growth policy by encouraging infill and development in established areas of
Kalispell and creates a more efficient use of land.

The proposed amendments would not generally impact the types of uses allowed
in the district. The effect of the amendment to the parking standards should
not increase or decrease congestion. Traffic associated with the use would not
generally be effected.
The amendments would not compromise the security and safety of the
community and are only intended to provide greater flexibility in establishing
minimum standards and to allow for reasonable development.
The general health and welfare of the public will be promoted by providing
additional lands to be developed in the established commercial areas, and to
provide greater flexibility in the parking provisions for this area.
Greater density in development would be encouraged through this amendment.
However, light and air are provided through development standards relating to
setback requirements for structures and lot coverage. The proposed changes do
not compromise the development standards of the district.

These amendments would only effect the commercial areas of Kalispell where
density is encouraged. Based upon an independent assessment of development

in the downtown area, it appears that parking is being underutilized. Based on
personal observations, it appears that parking standards are typically in excess
of demand. The amendments to the zoning ordinance will encourage a more
efficient use of land in the commercial areas of the City where land it is at a
premium. These changes should not result in the overcrowding of land or the
undue concentration of people.

Full public services and facilities would be available to the commercial areas
where these regulations would take effect. The proposed changes would not
impact the facilitation of public services and utilities.

This amendment gives adequate consideration to the suitability of these parking
standards to the commercial areas which are intended for a high intensity use,
infill and the development of underutilized property.

commercial areas which should have the highest concentration of uses that can
be reached through different methods including a reduced requirement for
parking.
The value of buildings will be preserved by encouraging infill, redevelopment
and reinvestment in the commercial areas.
The most appropriate land use throughout the jurisdiction will be promoted by
providing reasonable standards appropriate to the type of development in the
commercial areas of the community.
Staff recommends that the Kalispell City Planning Board adopt staff report #KZTA-03-2
as findings of fact and, based on these findings, recommend to the Kalispell City
Council that the proposed amendment to the Kalispell Interim Zoning Ordinance be
approved.

(11). Within Special Parking Maintenance District No. 2. Property
Located within Special Parking Maintenance District No. 2 shall
provide one (1) parking space for every four hundred (400) square feet
of gross floor area, but in no case shall more parking be required than
is otherwise provided for under Chapter 27.26, Off Street Parking.
27.26.050: Minimum Standards By Use. Required parking spaces shall be in
conformance with this section and where alternative standards prevail, the

sales and service, plus I space per 200 square feet of storage and/or
office gross floor area, plus 5 spaces off-street waiting (loading) spaces
per drive-in lane.
(4). Beauty and Barber Shops: 3 spaces per operator or I space per 100
square feet of gross floor area, whichever is larger, plus I space per

(5). Botanical and Zoological Gardens: I space per 10,000 square feet
of lot area.
(6). Bowling Alleys: 8 spaces per alley.
