Subdivision No. 182 - Request for one-year preliminary plat extension
MEETING DATE: March 17, 2003
BACKGROUND: This is a request by Jeff Larson on behalf of his client, Robert Rinke, for a
one-year extension to the preliminary plat of Subdivision No. 182. This subdivision is a
four lot residential subdivision located on the east side of Fifth Avenue East, north of 18th
Street East. The property was annexed to the city and given an RA-1 zoning classification
by ordinance 1345. The preliminary plat was approved by Resolution #4529 for a three-
year period. Mr. Larson has had difficulty in terms of getting DEQ approvals in time to file
for final plat and is therefore requesting a one-year extension for the approved preliminary
plat. Section 2.05D(7) of the Kalispell Subdivision Regulations does allow the applicant to
request and the Council to grant a one-year extension to the original 3 year approval time.
RECOMMENDATION: A motion to grant a one-year extension to the preliminary plat
approval of Subdivision No 182 as outlined in Resolution 4529 would be in order.
FISCAL EFFECTS: Minor positive impacts once fully developed.
ALTERNATIVES: As suggested by the city council.

On behalf of my client, I am requesting a one year extension for the Preliminary Plat for the
above referenced project. The owner has been working on installing the improvements and
we have received the Master Plan exemption approval from D.E.Q., but we do not have
enough time to complete the project and get the Final Plat recorded in the allowed time.

RESOLUTION NO. 4529
A RESOLUTION APPROVING THE PRELIMINARY PLAT OF SUBDIVISION NO. 182,
FLATHEAD COUNTY, MONTANA.
WHEREAS, Robert Rinke, the owner of certain real property
known as Subdivision No. 182, Kalispell, Flathead County, Montana
has petitioned for approval of the Preliminary Plat of said
property, and
WHEREAS, the Kalispell City -County Planning Board and Zoning
Commission held a public hearing on December 14, 1999, on the
proposal and reviewed Preliminary Plat Report KPP-99-4 issued by
the Flathead Regional Development Office, and
WHEREAS, the Kalispell City -County Planning Board and Zoning
Commission has recommended approval of the Preliminary Plat of
Subdivision No. 182, subject to certain conditions and
recommendations, and
WHEREAS, the City Council of the City of Kalispell at its
regular Council Meeting of January 3, 2000, reviewed the FRDO
Report #KPP-99-4, reviewed the recommendations of the Kalispell
City -County Planning Board and Zoning Commission, and found from
the Preliminary Plat, and evidence, that the subdivision is in the
public interest.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL, MONTANA AS FOLLOWS:
SECTION I. That the Findings of Fact contained in Flathead
Regional Development Office Report #KPP-99-4 are hereby
adopted as the Findings of Fact of the City Council.
SECTION Ii. That the application of Robert Rinke for
approval of Subdivision No. 182, Kalispell, Flathead County,
Montana is hereby approved subject to the following
conditions:
1. That the subdivision shall be developed in substantial
compliance with the approved Preliminary Plat except as
amended by the conditions of approval.
2. The access strip portions of proposed Lots 2 and 4 shall
be dedicated as road and utility easement and that
easement shall extend the entire length of the lot to
provide for the potential extension of future access to
the east.

That the access to proposed Lots 2 and 4 shall be shared
and that the access road shall be paved to a minimum
width of 20 feet.
4. That an approved fire access turnaround area to proposed
Lots 2 and 4 shall be developed with either a hammerhead,
T-turnaround or other arrangement that has been reviewed
and approved by the Kalispell Fire Department.
5. Sewer and water facilities shall be approved by the
Kalispell Public Works Department and the Montana
Department of Environmental Quality.
6. All new utilities shall be placed underground.
SECTION III. The classification of said premises under the
Kalispell Zoning Ordinance shall not be
changed by the action.
SECTION IV. That this Preliminary Plat approval shall be
valid for a period of three (3) years from the
date of approval.
SECTIONV. That upon proper review and filing of the
Final Plat of said subdivision in the office
of the Flathead County Clerk and Recorder,
said premises shall be a subdivision of the
City of Kalispell.
PASSED AND APPROVED BY THE CITY COUNCIL AND SIGNED BY THE MAYOR OF
THE CITY OF KALISPELL, THIS RAY DAY OF JANUARY, 2000.
