SUBJECT Kalispell Regional Medical Center - Amendment to the Buffalo
Commons PUD Agreement for Signs in the Medical / Professional
Pods
MEETING DATE: April 7, 2003
BACKGROUND: This is a request by Kalispell Regional Medical Center for
amendments to the sign standards in the Planned Unit Development Agreement
between Kalispell Regional Medical Center and the City of Kalispell for the Buffalo
Commons development to accommodate the signage for the new hospital expansion
and campus. A request has been submitted concurrently for a zoning text
amendment. The proposed text amendment will be considered as a separate item on
the council agenda. A portion of the hospital is located in the Buffalo Commons PUD
and a portion of it lies in the H- 1, Health Care, zoning district. This was a
consequence of the relocation of Sunnyside Drive to the north of where it used to
exist. The PUD portion of the project lies north of where the Sunnyside Drive right-of-
way used to be located and the H- I portion of the project lies to the south.
The staff worked with the Kalispell Regional Medical Center to craft the amendments
to provide the hospital with the needed changes while remaining consistent with the
rest of the zoning text and the PUD agreement. The staff believe the changes to the
PUD agreement will provide greater clarity in the standards as well as providing a
reasonable approach to the needs of the hospital in providing signs for the campus
without creating undue clutter or visual impacts.
The Kalispell Site Development Review Committee considered the proposed changes
to the PUD agreement as provided for in the agreement and considered them to be
minor. Minor changes can be reviewed and approved administratively, however, the
staff felt that it would be serve the city council by bringing both the text amendment
and the changes to the PUD agreement to the council for approval so that a
comprehensive view of the proposal could be presented. The staff is recommending
that the changes to the PUD outlined in Exhibit B and attached to this memo be
approved by the city council.
RECOMMENDATION: A motion to approve the first reading of the ordinance
amending the PUD would be in order.

DECLARATION OF COVENANTS CONDITIONS AND RESTRICTIONS
(MEDICAL J PROFESSIONAL FACILITIES)
The following amendments to the Buffalo Commons PUD agreement have been
reviewed by the Kalispell Site Development Review Committee and are recommended
for approval by the Kalispell City Council.
Article VI, Section 8. "Signs" is hereby amended as follows:
No signs, billboards or other advertising structure of any kind shall be erected,
constructed or maintained on any parcel for any purpose whatsoever, except such
signs as have been approved by the Architectural Review Committee and the City of
Kalispell.

area per face shall not exceed 14 square feet and the maximum height shall not

not to exceed 60 square feet per face and a height not to exceed six feet.
Additionally, a marquee or wall sign with an area not to exceed 20 square feet per
use with a total sign area not to exceed 40 square feet total for such signs shall
be permitted in addition to a free standing sign of the freestanding sign does not

ORDINANCE NO. 1450
AN ORDINANCE AMENDING ORDINANCE NO. 1226 (PLANNED UNIT
DEVELOPMENT, BUFFALO COMMONS) BY AMENDING THE SIGN STANDARDS FOR
THE MEDICAL/PROFESSIONAL FACILITIES POD, AND DECLARING AN EFFECTIVE
DATE.
WHEREAS, the Declarations of Covenants, Conditions, and Restrictions, Buffalo Commons, (A),
(B), (C),(D) and (E), Section I, Ordinance No. 1226, (Records of Flathead County,
Doc. No. 9527615080) were initially filed on January 26, 1998; and
WHEREAS, the Declarations of Covenants, Conditions, and Restrictions, Buffalo Commons, were
modified on September 29, 2001, by the First Amendment to Declaration of
Covenants, Conditions and Restrictions (No. 2000-273-11080, Records of Flathead
County); and
WHEREAS, Article IX, entitled Amendment, reads:
"This Declaration may be amended by an instrument signed by the owners of
seventy-five percent (75%) of the land..."; and
WHEREAS, Northwest Healthcare Corporation owns at least 75% of the land of Buffalo
Commons, Medical/Professional Facilities, and desire to amend the Covenants.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL, AS FOLLOWS:
SECTION I. That the Declarations of Covenants, Conditions, and Restrictions,
Buffalo Commons, Article VI, Section 8, Signs, is hereby amended as
follows:
