MEETING DATE: October 4, 2004
BACKGROUND: This is a request by Flathead Electric Cooperative for a conditional
use permit to allow an electrical distribution station in an R-3, Urban Single Family
Residential, zoning district. The property is located on the southeast corner of
Grandview Drive and Highway 93. This will be a pad mounted electrical distribution
station that will serve the needs of the growing area. The property is accessed via a
20 foot wide gravel easement and the property will be serviced approximately once a
month or more if unusual circumstances arise. It is not well -suited for residential
development because of its high visibility from and proximity to Hwy 93. Staff
recommended approval of the permit subject to conditions.
The Kalispell Planning Board held a public hearing on the matter at their regular
meeting of September 14, 2004. During the public hearing a representative of
Flathead Electric Cooperative, Brian Plunkett and engineer with the firm, explained
the proposal and stated the station would be fenced and screened. He noted the City
of Kalispell already has a sewer lift station on the site and this would be a good fit for
the site. They will remove the existing old building and do routine maintenance on
the site. He explained how a pad mounted distribution station works and noted that
the noise from the station will be similar to an idling vehicle.
After the public hearing, the board discussed the proposal. A motion was passed
unanimously to forward a recommendation to the city council that the conditional use
permit be approved subject to the conditions listed irz Exhibit A.
RECOMMENDATION: A motion to approve the conditional use permit subject to
conditions would be in order.
FISCAL EFFECTS: Minor positive impacts once fully developed.

September 14, 2004, held a public hearing on the application, took public comment and
recommended that the application be approved subject to four conditions.
After reviewing the application, the record, the TCPO report, and after duly considering the
matter, the City Council of the City of Kalispell, pursuant to the Kalispell Zoning Ordinance, hereby
adopts Tri-City Planning Office, Conditional Use Report #KCU-04-9 as the Council's findings of
fact, and issues and grants to the above -described real property a conditional use permit to construct
an electrical distribution station. for Flathead Electric Cooperative in the Urban Single Family
Residential, R-3, zoning district subject to the following conditions:
I, The proposal will be developed in substantial conformance with the relevant zoning
regulations, approved site plan and other application materials. That the conditions associated
with this permit shall be met prior to the operation of the facility.
2. The station shall be completely surrounded by a security fence that shall beat least eight feet in
height.
The perimeter of the electrical distribution station shall be landscaped with sight -obscuring
trees, shrubs or bushes. Such landscaping shall be designed to improve the appearance of the
site while allowing for normal operational and safety factors of the station.
4. The conditional use permit is valid for a period of 18 months from the date of authorization
after which time if the commencement of activities has not occurred the permit shall be void.
A continuous, good faith effort to design the building, obtain financing and other activities shall
be considered a commencement.

A report to the Kalispell City Planing Board and Kalispell City Council regarding a
request for a conditional use permit to construct a pad mounted electrical distribution
station in an R-3, Urban Single Family Residential, zoning district. A public hearing
to review this request has been scheduled before the planning board on September
14, 2004 in the Kalispell City Council Chambers. The planning board will forward a
recommendation to the city council for final action.
BACKGROUND INFORMATION:

B. Size and Location: The property where the electrical distribution station is
proposed contains approximately .07 7 3 of an acre and is an irregularly shaped
parcel that is generally 157 feet wide and approximately 215 feet deep. The
property is located at the southeast corner of Grandview Drive and Hwy 93 and
can be described as Assessors Tract 2DCC located in Section 1, Township 28
North, Range 22 West, P.M.M, Flathead County, Montana.
C. Summary of Request: This is a request for a conditional use permit to construct
an electrical distribution station for Flathead Electric Cooperative to expand their
service potential at the northern end of Kalispell.. Electrical distribution stations
are listed as a conditionally permitted use in the Kalispell Zoning Ordinance and
there are specific performance standards for such a use under Section 27,35.050.
The request will also be reviewed with respect to the standard CUP criteria that
simply requires fencing and landscaping around the perimeter of the site. This
treatment has been included as part of the application and development proposal.
Access would be via an unpaved access easement from Harrison Blvd that is 20
feet wide and currently exists. It is anticipated that the site would be visited on a
monthly basis to do meter readings and other maintenance. Additional trips
would be on an as needed, but irregular, basis. The existing structure on the
property would be removed as part of this development.
D. Existing Land Use and Zoning: This property currently contains a vacant older
garage/shed on the east side of the tract. The remainder of the property is vacant.
The lot is a remnant piece left over from the development of Parkvi.ew Terrace to
the east, several townhouse projects to the south and southeast and highway
R/W dill activities {with the widening of US 93 and Grandview Drive. The property
is zoned R-3, Urban Singie Family .Residential, with a minimum lot size of 7,000
square feet. The site exceeds the minimum lot size requirements with 0.7 73 of an
acre or 11, 7 00 square foot.
E. Surrounding Zoning and Land Uses Zoning: The property lies in an area of
mixed uses and zoning. The site is generally isolated by topography lying well
below the grades of US 93 and Grandview Drive which form. the west and north
boundaries respectively. The northeast corner of the site abuts a city utility lot
(sewer lift station, generator, etc.). To the east lies single-family residences, to the
southeast and immediate south lie several townhouses primarily 4-plex in mature.
Across Grandview to the northeast lies the Flathead Valley Community College.
North: City R-1 Flathead Valley Community College
East: City utility substation and singe family residences. R-3 zoning
South: 'Townhouse complexes, R-3 zoning.
West: The Greenery - County SAG-10 zoning
F. Growth Policy Plan Designation: The Kalispell City Growth Policy designates
this area as Urban Residential and anticipates 3 to 12 dwelling units per acres.
The proposed project is in general compliance with the land use designation of the
Growth Policy map and furthers the goals of the Growth Policy by providing for a
support facility and infrastructure to provide for the future needs of the
community without unduly impacting the neighborhood character.

EVALUATION OF THE REQUEST
The application is reviewed in accordance with the conditional use review criteria in
the Kalispell Zoning Ordinance.
1.. Site Suitability:
a. Adequate Useable Space: The site has adequate space to meet the zoning
setbacks and access needs as well as to provide for landscaping and adequate
circulation within the site. The site of the parcel exceeds the needs of the
facility and will be setback far enough from the road to avoid impacts to the
neighborhood.
b. Adequate Access: Access to the site will be gained via. an P<�isting 20 foot
gravel drivewav off of Harrison Blvd. There may be some needed improvements
to wring the road up to an acceptable fire access standard for an `'ail weather
surface" however, the police department is recommending that the road remain
in an unpaved state to avoid uninvited use by skateboarders, bikers and others
that would be difficult to police and manage. Additionally, the limited use by
FEC would not create undue impacts related to dust or noise.
c. Environmental Constraints: The site is level. No floodplain, surface water or
wetlands are evident on the site. No significant environmental constraints are
apparent on the property.
2. .Appropriateness of design:
a. Parking and site circulation: No parking is necessarily required for this type of
use. Access to the site and a gravel pad will be provided for routine
maintenance purposes. It is not anticipated that there would generally be more
than one vehicle at a time visiting the site. There is adequate space for
parking, access and good site circulation..
b. Olsen Space: No specific open, space requirements exist in the zoning
regulations for a development of this type other than the setbacks and lot
coverage which have been met. Uniform Building Code may provide guidance
on the minimum space between structures. There is adequate space on the
site to accommodate landscaping and the proposed parking areas.
c. Fencing/Screening/Landscaping: Section 27.35.050 of the Kalispell Zoning
Ordinance require an eight foot high security fence and screening because this
facility abuts a residential development. Plans submitted by the applicant
incorporate this treatment in their design and is standard for this type of
facility. The site plan proposes fencing and landscaping around the facility as
indicated in the photos.
d. Signs: No sign was included with the application and it is not anticipated that
any signs will be posted on the site other than those related to restricting
access and trespass.
3. Availability of Public Services/Facilities:
a. Schools: This site is within School District 7#5. No impact to the district
may be anticipated from the proposed facility.

area since there will be no residents on the site.
c. Police: Police protection will be provided by the Kalispell Police Department.
No unusual impacts or needs are anticipated from the proposed use.
d. Fire Protection: Fire protection will be provided by the Kalispell Fire
Department. No adverse or unusual impacts are anticipated to result from
the facility.
c. Water and sewer: Water and sewer requirements will not be used For the
development of this site and ,,viil not be impacted by this development.
f. Solid Waste: No solid waste handling is anticipated to be needed as a result
of this facility.
g. Streets: Traffic generation from the development is estimated at two vehicle
trips per month to read meters and incidental maintenance outside of this
may occur occasionally.
4. Neighborhood Impacts. Except during construction, no significant impacts
are anticipated from noise, vibration, or dust. A notice of public hearing was
mailed to property owners within 150 feet of the site approximately 15 days
prior to the hearing. As of this writing, staff has received no comments from
neighbors on the proposal.
5. Consideration of historical use patterns and recent changes: The proposal
is compatible with the immediate area. There is other public infrastructure
owned by the City of Kalispell in the immediate area and the property is
setback far enough from other uses that impacts should be minimal. There are
a mix of housing types in the area including town homes and single family
residences. This is a good use of the property considering limited access and
its proximity to Hwy 93.
6. Effects on property values: No significant negative impacts on property
values are anticipated. As previously mentioned, the proposal is compatible
with the neighborhood, and the development and land use impacts would be
typical of that anticipated for the area.
RECOMMENDATION
Staff recommends that the planning board adopt the staff report #KCU-04-9 as
findings of fact and recommend to the Kalispell City Council that the conditional use
permit be approved subject to the following conditions:
1. The proposal will be developed in substantial conformance with the relevant
zoning regulations, approved site plan and other application materials. That the
conditions associated with this permit shall be met prior to operation of the
facility.

1.0 INTRODUCTION (To address Item 2 of the CCTIP application)
Flathead Electric Cooperative, Inc (FEC) is requesting a conditional use permit for Tract 2DCC
in L I Sol T28N R22W, The land will be used to place a substation that will provide additional
capacity to FEC's 12.5kV distribution system serving approximately a four mile radius. The
real estate on the corner of Grandview and Highway 93 offers a great advantage in delivering
power to the future development of the area along with increasing the power quality to the
existing residential and commercial loads. Although the surrounding property is mainly
residential, the City of Kalispell has formerly approved the use of an adjacent piece of property
for a sewer lift station and a gas regulation point. All existing structures on the property will be
removed by the current land owner. Please see the attached COS that identifies the property.
FEC is in the infant stage of the design on this substation. However the proposed use of this
property will be consistent with to the general design specified below.
2.0 GENERAL DESIGN (To address Item 3 of the CC.TP application)
2.1 PADMOUNT SUBSTATION
A padmount substation can be defined as a distribution substation that has no overhead
power lines entering or exiting the facility. Although relatively new to the industry,
padmount substations are becoming popular in high profile areas where new
developments create additional load growth. These new developments increase
demand on a utility's system, taxing it to a point where power quality and reliability
become issues.
One of the main advantages that a padmount substation has over a traditional
(overhead) substation is the substantially reduced space requirement. A traditional
overhead substation is shown in Figure 1. Figures 2 and 3 show a padmount substation
that has the same capacity. This is the same substation shown from two view points.

Figure 4 shows a piece of equipment known as metal -clad switchgear. FEC plans to
use a unit similar the one shown. This will actually take the place of some of the
equipment shown in figure 3. The metal -clad switchgear will also be used as a control
building, housing circuit breakers, metering panels, relays, etc.

2.2 AESTHETICS
As shown earlier, a completed padmount substation looks like a clean collection of
boxes in a field. However, FEC will plan to surround the entire substation with a
decorative wall system.. Although the decorative wall is not required for a padmounted
substation, Flathead Electric under "emergency" conditions could set up a temporary
overhead trailer system, if fenced, to protect the public and continue distributing
electricity. This system will not only increase the safety, but also theoverall
appearance of the substation. Landscaping is also part of the design of this substation.
Below are some examples of what to expect of a wall system. Other examples are
available upon request.

Once the initial construction of the substation is complete, FEC will access the station
once a month for meter reads and operation records. Quarterly substation inspections
are also performed to ensure equipment functionality. The only other access to this site
will be power outage invoked or for routine switching.
Outlined in red, figure 5 shows the approximate area in which the substation will be
located. The decorative fencewillbe eight to ten feet in height buffering the site and
sound of the substation equipment (i.e. the notorious 60 Hertz hum) from its
surroundings. Again, figure 3 depicts a good example of the equipment that will be
within the fenced area.

3.0 TIME LLNE
The time to design and build a substation is typically 18 months. It is FEC's goal to have the
padrnount substation design completed by fall of 2004 and constriction completed by late summer
of 2005. Once the design has been reviewed and approved by all parties involved, materials will be
ordered and construction can begin.
Due to long equipment lead times, it is imperative that a conditional use permit for this substation
property be approved as soon as passible. Please call e if you have any questions or concerns as
to what FC has planned for this property.

Corporation. The applicants are proposing converting a single family home into a
day care center for up to 40 children that will operate during the day Monday

2. A request for a conditional use permit to allow an electrical distribution station
for Flathead Electric Cooperative .on . property zoned R-3, Urban Single_ Family
Residential, containing approximately 0 773 acres. The applicants are proposing
to construction. "pad mounted" electrical substation. Access will be obtained from
an existing easement off of Harrison Avenue and will be serviced only. The
perimeter of the site will be landscaped to avoid visual. impacts. Electrical
distribution stations are listed as a conditionally permitted use in the R-3 zoning
district. The property is generally located on the southeast corner of Grandview
Drive and Hwv 93.
