BACKGROUND: In January MDT let the contract for reconstructing US 93 from Ashley Creek into
Kalispell to JTL Group of Kalispell. Preparatory plans are moving forward with satisfying speed and
work is set to begin early in the week of 15 March. The first order of business will be installation of the
City's water and sewer facilities along with the project storm drainage system. The contractor's schedule
indicates all the utility and storm drainage work is to be done within 90 days with all work completed in a
total of 200 days. The contract includes significant penalties for delays and incentive rewards for an early
finish, which we hope the contractor is able to collect. The intent is to finish in one construction season.
City water and sewer facility construction costs taken from the MDT bid totals are currently estimated at
$2,278,720,96 which includes a 10% contingency.
Construction management for the City's utility installations is the City's responsibility. As
previously indicated in various progress reports to the City Council, rather than hire staff to handle this
task we have planned to obtain the temporary support of a qualified consultant, like was done for the
City's utility installations on Main Street when the Main/Idaho intersection was reconstructed. We
prepared RFP/RFQ packages and sent them to Thomas, Dean, & Hoskins, Morrison Maierle and the
City's utility design firm, Forsgren Associates. Responses were due by 10 March and we received
proposals from all three firms. We asked that responses address all the many requirements placed on the
City and contained within the three City/MDT construction agreements recently approved for this project.
Further, the contractor's construction schedule was provided to all so that appropriate resources could be
allocated to cover all the indicated areas of simultaneous work shown in the contractor's ambitious six -
day week / ten-hour day minimum work schedule. In view of the City's large investment and the very
aggressive work schedule, construction management for this job is not considered to be a trivial task.
Submittals were reviewed to determine the consultant's level of understanding of this project and
ability to commit all the potential resources needed to meet our requirements and those of MDT for the
integration of effort into their system. Further, the proposals were evaluated to judge the respondent's
recognition of the potential variability of the general contractor's schedule, and to determine the

consultant's potential flexibility to respond to changing conditions, to either add staff or reduce staff' as
conditions change. Also, the City's work is an integral part of an MDT contract so therefore the firm must
be fully capable of seamlessly working with the City and within the MDT Construction Management
System with all burdensome documentation that entails. Based on our review we have concluded that the
firm of Morrison Maierle is best able to provide the level of support needed for this important project.
They have dedicated adequate resources and additional contingency personnel to the project in order to
respond to any potential variation in. the work schedule, and have allocated those resources and skills in a
way that demonstrated the best understanding of the City's needs and MDT's expectations. Their
performance on the Main/Idaho project was excellent with work completed on time and under budget.
The most common contracting approach for construction engineering and management services
on a project of this type and scale is cost plus a fixed fee with a not to exceed ceiling amount. MDT costs
for these services are 15% of the project amount and have been calculated this way for their portions of
the contract. The City asked for a cost plus a fixed fee estimate with a cost to not exceed estimate that is
essentially a worst -case cost if the general contractor's optimism about his schedule is less than perfect_
Morrison Maierle has proposed a not to exceed cost of $304,324.32 which is about 13% of construction.
We believe the final costs for engineering services will be in the .range of 9.5%to 10_5% which would be
similar to our experience with utilities for Main Street /Idaho Street. The estimated utility construction
costs, based on the bid, plus City costs for construction services is approximately $66,000 less than the
amount budgeted for FY 2004, Construction costs still include a 10% contingency amount that may or
may not be needed to cover unanticipated items revealed during construction. Details of this proposal are
attached for your information.

AGREEMENT TO FURNISH_ the CITY OF KALISPELL
ENGINEERING SERVICES for CONSTRUCTION MANAGEMENT of
U.S.HIGHWAY 93 UTILITY INSTALLATION PROJECT
For the consideration hereinafter set forth Morrison Maierie, Inc., (hereinafter referred to as the
ENGINEER), agrees to provide construction administration, on -site observation, and other
related engineering services as described herein to THE CITY OF KALISPELL (hereinafter
referred to as the OWNER) for a project generally described as the " U.S.HIGHWAY 93
UTILITY INSTALLATION PROJECT."
The project will involve project coordination, interpretation of plans and specifications, and other
tasks related to the construction of City -owned water and sewer utilities to be installed in
conjunction with a Montana Department of Transportation project to reconstruct US Highway 93
from Ashley Creek into Kalispell.
ARTICLE 1. SCOPE OF SERVICES
The ENGINEER agrees to provide the required construction administration, on -site observation,
and other related engineering services for the OWNER's Project. The services to be provided,
and the compensation for such services, shall be as mutually agreed to in this Agreement,
executed by both parties and as described in the attached Proposal for Engineering Services and
the Scope of Services included therein. Unless otherwise indicated, execution of this Agreement
by the OWNER shall constitute notice to and authorization for the ENGINEER to proceed with
the services enumerated in the Agreement.
ARTICLE 2. BASIS OF COMPENSATION
A. BUDGET
The budget for the Scope of Services of this Agreement has been agreed upon by the parties to
this agreement. The Scope of Services, by this reference, is hereby made a part of this
Agreement,
B. COMPENSATION
As consideration for providing the services described as:
Tasks 1 through 4 in Scope of Services, the OWNER shall pay the ENGINEER for time and
materials, at the rates shown on the attached schedule of rates, up to a total of all costs not to
exceed $304,324.32 which includes a fixed fee of $25,730.50. Pay requests shall be submitted
and payment shall be made as described in Article 3.
C. CHANGE OF SCOPE OR PERSONNEL
The Scope of Services and its related budget for this Agreement shall be limited to the scope and

budget so contained herein. Changes in the indicated Scope of Services shall be subject to
renegotiation and shall be implemented by a formal amendment to this Agreement. ENGINEER
shall notify OWNER of any changes in personnel assigned to this project and shall obtain
concurrence of OWNER prior to such changes.
D. ADDITIONAL SERVICES
Additional services not specified in Article I and subsequently requested by the OWNER, or
services mutually agreed to be required for the timely completion of this contract, shall be
described and the cost thereof outlined in a formal amendment to this Agreement
E. LITIGATION ASSISTANCE
The ENGINEER will not be obligated to provide expert witness or other litigation support
related to its services, unless expressly agreed in writing. In the event the ENGINEER is
required to respond to a subpoena, government inquiry or other legal process related to the
services in connection with a proceeding to which it is not a party, the OWNER shall reimburse
the ENGINEER for reasonable costs and compensate the ENGINEER at its then standard rates
for reasonable time incurred in gathering information and documents and attending depositions,
hearings, and the like.
ARTICLE 3. PAYMENT FOR SERVICES
Payment to the ENGINEER, as prescribed in Article 2, shall be made as follows:
A. REQUEST FOR PAYMENT
The ENGINEER shall submit pay requests in a consistent detailed format. The submittal shall
include a summary sheet to indicate total Professional Services, Reimbursable Expenses,
Subcontracted Services and Total Payment Requested. Additional sheets shall be attached as
necessary to describe hours worked and billable rates for each employee, itemized reimbursable
expenses and itemized subcontracted services, including hours worked and billable rates for all
subcontractors' employees.
B. PAYMENT FOR SERVICES
For all services described in Article 1 and subsequent amendments, payment is due within 30
days after the OWNER's receipt of the ENGINEER's pay request. Payment shall be for actual
invoiced costs but shall not exceed the total amount shown in Scope of Services
ARTICLE 4. OBLIGATIONS OF THE ENGINEER
A. AUTHORIZATION TO PROCEED
The ENGINEER will not begin work on any of the services listed in Article 1 until the OWNER

directs him to proceed. Authorization to proceed on work elements not defined in this Agreement
as to scope, cost, and time for completion shall be in the form of a formal amendment as
previously described.
B. STANDARD OF CARE
The ENGINEER will perform the services described in this Agreement and in any work release
documents or change orders, which are issued under this Agreement and signed by both parties.
In performing the services, the ENGINEER will exercise the degree of care and skill ordinarily
exercised by reputable companies performing the same or similar services in the same geographic
area. The ENGINEER is obligated to provide only those services, which are described in this
Agreement, in work release documents signed by the ENGINEER or in change orders signed by
the ENGINEER
C. CONFIDENTIAL INFORMATION
Confidential information shall be designated as such by the OWNER. The ENGINEER and his
subcontractors will not disclose confidential information provided by the OWNER or developed
by the ENGINEER and his subcontractors in the course of its services without the OWNER's
specific prior written consent.
ARTICLE 5. OBLIGATIONS OF THE OWNER
A. AUTHORIZATION TO PROCEED
The OWNER shall authorize the ENGINEER to proceed on Tasks l through 4 in Scope of
Services by executing this Agreement.
B. OWNER -FURNISHED DATA
The OWNER shall provide to the ENGINEER all technical data in the OWNER's possession,
including previous reports, maps, surveys, borings, and all other information required by the
ENGINEER and relating to the ENGINEER's work on the project. Such information shall
include, but not be limited to, the OWNER's requirements for the project, any design criteria or
constraints, and copies of design and construction details or standards that OWNER requires to
be included. The ENGINEER may rely upon the accuracy, timeliness, and completeness of the
information provided by the OWNER in performing ENGINEER's services to the OWNER.
C. ACCESS TO FACILITIES AND PROPERTY
The OWNER shall as necessary make its system facilities and properties available and accessible
for inspection by the ENGINEER and provide labor and safety equipment as reasonably required
by the ENGINEER and as authorized by OWNER.

D. ACCESS TO PRIVATE PROPERTY
The ENGINEER shall obtain permission for access from individual property owners, as
necessary to perform required services on private property.
E. TIMELY REVIEW
The OWNER shall examine all reports, sketches, drawings, specifications, proposals, and other
documents presented by the ENGINEER, obtain advice of an attorney, insurance counselor,
accountant, auditor, and other consultants as the OWNER deems appropriate for such
examination and render in writing decisions pertaining thereto in a timely manner so as to not
delay the services of the ENGINEER.
F. PROMPT NOTICE
The OWNER shall give prompt written notice to the ENGINEER whenever the OWNER
observes or otherwise becomes aware of any development that affects the scope or timing of the
ENGINEER's services or any defect in the work of the ENGINEER or Contractors.
ARTICLE 6. GENERAL LEGAL PROVISIONS
A. FORCE MAJEURE
The OWNER shall not be responsible for any delay or failure of performance caused by fire or
other casualty, labor dispute, government or military action, transportation delay, inclement
weather, Act of God, act or omission of OWNER or its contractors, failure of OWNER or any
government authority to timely review or to approve the services or to grant permits or approvals,
or any other cause beyond the OWNER'S reasonable control.
B. INDEMNIFICATION
Indemnification by OWNER:
The OWNER agrees to indemnify, hold harmless and defend the ENGINEER from and against
any and all liabilities, demands, claims, causes of actions and judgments (including costs and
reasonable attorneys fees) which the ENGINEER may incur, become responsible for or pay out
as a result of death or bodily injury or threat thereof to any person, destruction of or damage to
any property, contamination of or adverse effect on natural resources or the environment, any
violation of local, state, or federal laws, regulations or orders, or any other damages claimed by
third parties, including without limitation any arising out of or related to hazardous materials or
substances and including costs of response or remediation arising out of the application of
common law or laws imposing strict liability, based on or arising in whole or in part from the
negligent acts or omissions or willful misconduct of the OWNER, its employees, agents and
subcontractors-

Indemnification by ENGINEER:
The ENGINEER agrees to indemnify, hold harmless and defend the OWNER from and against
any and all liabilities, demands, claims, causes of actions and judgments (including costs and
reasonable attorneys fees) which the OWNER may incur, become responsible for or pay out as a
result of death or bodily injury or threat thereof to any person, destruction of or damage to any
property, contamination of or adverse effect on natural resources or the environment, any
violation of local, state, or federal laws, regulations or orders, or any other damages claimed by
third parties, including without limitation any arising out of or related to hazardous materials or
substances and including costs of response or remediation arising out of the application of
common law or laws imposing strict liability, based on or arising in whole or in part from the
negligent acts or omissions or willful misconduct of the ENGINEER, its employees, agents and
subcontractors.
C. INSURANCE
The ENGINEER shall acquire and maintain statutory workmen's compensation insurance
coverage. ENGINEER shall acquire and maintain bodily injury and property damage insurance
coverage in an amount not less than seven hundred fifty thousand ($750,000) dollars for each
claim and one and one- half million ($1,500,000) dollars per occurrence. The ENGINEER shall
acquire and maintain bodily injury liability automobile insurance coverage in an amount not less
than seven hundred fifty thousand ($750,000) dollars for each claim and one and one- half
million ($1,500,000) dollars per occurrence and property damage liability automobile insurance
Coverage in the amount of fifty thousand ($50,000) dollars for each occurrence. The ENGINEER
shall acquire and maintain catastrophe or excess insurance coverage in the amount of one million
(1,000,000) dollars for each occurrence and one million (1,000,000) dollars for each aggregate
with ten thousand ($10,000) dollars deductible amount. The ENGINEER shall acquire and
maintain professional liability insurance coverage in the amount of one million ($1,000,000)
dollars with a forty thousand ($40,000) dollar deductible amount.
D. TERMINATION
The OWNER for its convenience may terminate this Agreement by giving 30 days' written notice
to the ENGINEER.
This Agreement may be terminated by either party upon 30 days' written notice should the other
party fail substantially to perform in accordance with this Agreement through no fault of the
other or if the project is stopped by conditions beyond the control of the OWNER.
In the event of termination, the ENGINEER shall be paid in frill for all work previously
authorized and performed up to the termination date, plus termination expenses if termination is
not caused by failure of the ENGINEER to perform.
If no termination is implemented, relationships and obligations created by this Agreement shall
terminate upon completion of all applicable requirements of this Agreement.
E. SUSPENSION, DELAY, OR INTERRUPTION OF WORK
The OWNER may suspend, delay, or interrupt the work of the ENGINEER on the project for the
convenience of the OWNER or for reasons beyond the control of the OWNER or ENGINEER.
In the event of such suspension, delay, or interruption, an adjustment in compensation due the
ENGINEER shall be made for all increases in cost of the ENGINEER's performance under this
Agreement, including personnel relocation and/or replacement costs, and all other identifiable
labor and expense costs.
F. ASSIGNMENT
This Agreement is to be binding on the heirs, successors, and assigns of the parties hereto and is
not to be assigned by either party without first obtaining the written consent of the other. No
assignment of this Agreement shall be effective until the Assignee assumes in writing the
obligations of the assigning party, and delivers such written assumption to the other original
party to this Agreement.
Use of subconsultants by the ENGINEER for technical or professional services shall not be
considered an assignment of a portion of this Agreement.
Nothing herein shall be construed to give any rights or benefits hereunder to anyone other than
OWNER and ENGINEER.
G. LITIGATION
In the event either party to this Agreement shall be required to bring an action against the other
party to enforce this Agreement, or any portion thereof, the prevailing party shall be entitled to
reasonable attorney fees and costs therefore in addition to any damages that may be awarded.
H. VENUE
In the event of Iitigation concerning this Agreement, venue shall be in the Eleventh Judicial
District in and for the County of Flathead, Montana, and this Agreement shall be governed by the
laws of the State of Montana both as to interpretation and performance.
ARTICLE 7. GENERAL PROVISIONS
A. ACCESS TO DOCUMENTS
The ENGINEER shall provide access to any of the documents relating to this project to the
OWNER, the City of Kalispell, or authorized representative of the above during normal working
hours.

The ENGINEER shall maintain project and financial records for this project for at least three
years after final payment and closure of the project.
C. REPRODUCIBLE COPIES
Reproducible hard copies and electronic copies of all records and other forms of documentation
produced for this project shall be provided in standard MDT formats and made available to the
OWNER.
D. COVENANT AGAINST CONTINGENT FEES
The ENGINEER warrants that he has not employed or retained any company or person, other
than a bona fide employee working solely for the ENGINEER, to solicit or secure this
Agreement, and that he has not paid or agreed to pay any company or persons, other than a bona
fide employee working solely for the ENGINEER, any fee, commission, percentage, brokerage
fee, gifts, or any other consideration, contingent upon or resulting from the award or making of
this Agreement. For breach or violation of this warranty, the OWNER shall have the right to
annul this Agreement without liability, or in its discretion to deduct from the contract price or
consideration, or otherwise recover, the full amount of such fee, commission, percentage,
brokerage fee, gift, or contingent fee.
E. SCHEDULE
Time is of the essence for this project. The ENGINEER shall proceed immediately to begin
Performing the services required herein in conformance with the construction schedule of the
general construction contractor as such schedule is presently known and/or may be subsequently
modified by said contractor and Montana Department of Transportation as work progresses
toward final completion. Duration of this project from start of construction to final completion of
utility construction is presently estimated to be 120 calendar days.
Final reports, records, and all other related documentation required for this completion of this
Project shall be submitted to the OWNER and the Montana Department of Transportation within
30 working days final completion.

ARTICLE 8. ATTACHMENTS SCHEDULES AND SIGNATURES
A. AGREEMENT DESCRIPTION
This Agreement (consisting of pages l through 8, inclusive) and attached Proposal for
Engineering Services and Scope of Services constitute the entire Agreement between the
OWNER and the ENGINEER and supersedes all prior written or oral understandings. This
Agreement may only be amended, supplemented, modified, or canceled by a duly executed
written addendum.

Dear Jim:
Morrison-Maierle, Inc. is pleased to present our statement of qualifications for work
related to providing construction administration and on -site observation services for the
construction of water and sewer utilities along US Highway 93. Recognizing that the
City of Kalispell only has about 1 week to review proposals, select an engineer,
negotiate a scope and fee and execute an engineering agreement, we have decided to
present our statement of qualifications in a simple and concise fetter format. Attached to
this letter you will find additional documentation including a project team organizational
chart, a draft work plan, person -hour projections, a letter from NTL Engineering and
Geosciences, Inc. committing to being a part of the Morrison-Maierle team, and
resumes. Also, in a separate envelope, we have developed a fee estimate for providing
construction administration services based on the attached work plan, information
provided by the City of Kalispell (e.g. Agreements between MDT and the City), and
assumptions documented below regarding level of on -site observation that will be
required.
Project Understanding and Approach
The City of Kalispell in conjunction with the Montana Department of Transportation
(MDT) is about to embark on a major construction project. This project will be
constructed in a high traffic area and could be very disruptive to both traffic and local
businesses. Also, in order to keep the project on schedule, the Contractor has proposed
to use as many as three crews that will work 6 days a week for 10 hours a day.
Based on our discussion with the contractor and our experience with similar projects, we
feel the City needs a local consultant that can easily adjust to changes in the contractor's
schedule and work force. For instance, at the beginning of the project, the amount of
work being completed by the contractor may only require the services of two on -site
resident project representatives (RPRs). As work progresses and if the contractor fails
behind, additional construction crews may be added in order to complete the work on
time, therefore requiring additional RPRs.
Our approach to your project includes providing the resources necessary to ensure we
can react to changes in the contractor's schedule and work force. To that end, we have
endeavored to provide a project team that includes 4 RPRs that could be used for this
project as well as an alternate RPR should one of the ethers suddenly become

unavailable due to illness, etc. The bottom line is that even though we do not know right
now how many RPRs will be required, Morrison-Maierle will provide or have available
the resources required for the successful completion of this project.
Project Team
Morrison-Maierle is providing a highly qualified and experienced team that is ready to
help the City of Kalispell complete this important project. The project will be coordinated
by a Project Manager who will be supported by on -site representative project
representatives and other support staff and a subconsultant.
The attached organizational chart and resumes summarize our proposed project team
and qualifications, Terry Richmond will be serving as the Project Manager and will be
responsible for overall coordination of the project personnel. Assisting Terry will be Bill
Buxton, a senior municipal engineer with 10 years of experience in the design and
construction administration of water and sewer utility projects. Purnal Whitehead, who
as nearly 35 years of experience, will serve as our Chief Resident Project
Representative and will be our primary contact with both the contractor and the City
regarding day-to-day construction issues. Other RPRs that have also been committed to
this project include Craig Schaeffer, John Campbell and Ken Chrisinger We feel that
John and Ken are very important members of our team. John has extensive experience
in public works as the water and sewer superintendent for the City of Poison for 18
years. Ken, who also has extensive construction related experience with MDT, is
available to serve as a liaison between the MDT and the rest of the project team, if
necessary. Greg t_ukasik is also shown on the organizational chart as an alternate RPR.
Also, as part of our team we are able to provide Terry Dahlquist and Patrick Self, two
electrical engineers in our Kalispell office that can be used for the observation of the
construction of the electrical and control components of the Cemetery Road Lift Station.
Terry and Patrick can also assist with the commissioning of this lift station. Finally, NTI-
has agreed to be a part of Morrison-Maierle's team to perform utility trench backfill
compaction density testing.
Related Experience and References
Morrison-Maierle has been providing construction related services for nearly 59 years.
In fact, we provide these services on nearly every project we design. In 2004 alone, we
have approximately 50 projects for which we are providing construction administration
and RPR services ranging in complexity from simple water main extensions to multi-
million dollar wastewater treatment plant expansions.
As we stated earlier, our goal is to provide you with a simple and concise statement of
qualifications, however, to do this it would be impossible to list all of our firm's past
experience. Instead, we have included several representative projects with references
for your consideration.

Main Street Water.Main Replacement, Kalispell, MT: Project included design,
construction administration, and construction observation for the installation of
2,600 feet of 20-inch water main and 2,200 feet of 10-inch water main. The
project, from design through construction, required extensive coordination with
the Montana Department of Transportation (MDT). (Reference: Jim Hansz, City
of Kalispell).
2, Sewer Main Replacement, Conrad, MT: Project consisted of the design and
construction administration services related to the replacement of 6,700 feet of
sewer main using pipe bursting. Project also included coordination with MDT for
the crossing of 4t" Avenue, a state Highway in Conrad. (Reference: Steve Ruhd,
City of Conrad, 271-3623).
3. Water Main Replacement, Anaconda, MT: Project included the design and
construction administration services related to the installation of approximately
3,500 feet of 10-inch water main and 1,500 feet of 6- and 8-inch water main
along and adjacent to Main Street in advance of an MDT resurfacing project and
required extensive coordination with MDT both before and during construction.

4. Utility Installation, Glacier Park International Airport, Kalispell, Montana:
Morrison-Maierle has performed design and construction observation services for
nearly $3 million in utility (water, sewer, and stormwater) construction projects at
the Glacier International Airport. Each project required extensive coordination
with airport and FAA officials. (Reference: Mike Daigle 257-5994 or Monte

March 15t", the anticipated date for the start of construction, we can commit to providing
the necessary on -site RPRs to cover the work being completed by the contractor.
After the utility subcontractor is substantially complete with the water and sewer mains
we can have the as -built documentation compiled and submitted to the City within 30
days.
Expected Support from the City
Our goal when assembling this statement of qualifications was to provide a team that
could complete this project with minimal support from the City of Kalispell. We feel that
the addition of John Campbell to our team achieves this goal. In addition to having
years of experience with water and wastewater related projects, John is intimately

familiar with the needs of a public works department after having served for 18 years as
the water and sewer superintendent for the City of Poison. We would also like to
emphasize that myself and Bill Buxton have dedicated our entire careers looking after
the interests of communities such as the City of Kalispell. As a result, we feel
comfortable that we can make the necessary field and other decisions (that do not
involve changes in price or quality) without input from the City.
Regarding the expected level of support from the City of Kalispell, we of course welcome
whatever involvement the City would like to have. However, we do recognize that you
and your staff have other projects to tend to. We feel that the City would wish to attend
the weekly or bi-weekly construction progress meetings in order to keep abreast of the
current issues. Also, a City representative with the authority to make decisions should
be designated and be available for questions should something of an urgent nature arise
and need immediate attention. Overall, we think that the City's .involvement could be
minimal.

SCOPE OF SERVICES (WORK PLAN)
FOR
US HIGHWAY 93 WATER AND SEWER MAIN INSTALLATION
CONSTRUCTION ADMINISTRATION
MARCH, 2004
Morrison-Maierle, Inc., proposes to perform basic construction administration services as
defined below. The person -hour estimates for this work plan were developed assuming
the contractor will be substantially complete in 90 calendar days (working 6 days per
week) and final completion will be achieved in 120 calendar days_
Task 1: Project Management
Task 1 will consist of attending weekly construction progress meetings and general
project administration as described below.
A. Weekly Progress Meetings with Contractor: Morrison-Maierle will conduct
weekly construction progress meetings with the contractor to discuss, at a
minimum, work and testing schedule, traffic control, access and defective work.
After the meeting minutes will be prepared summarizing the main topics of the
meeting, items in dispute, and action items and responsibilities. It is anticipated
that the meeting will be attended by representatives from the City of Kalispell, the
Montana Department of Transportation (MDT), the contractor, and Morrison-
Maierle.
B. Project Administration: Task 1 will also consist of general administration of the
project including rendering clarifications and interpretations of the plans and
specifications, rendering decisions on claims relating to the acceptability of the
contractor's work, and identifying and recommending rejection of work if the work
does not conform to the plans and specifications. With the approval of the City,
Morrison-Maierle may issue field orders authorizing minor variations from the
requirements of the plans and specifications.
C. General Correspondence: Project management services will also include
general day-to-day verbal and written correspondence with the City of Kalispell,
MDT, and the Contractor.
Task 2: Construction Administration
Task 2 will consist of construction administration activities described as follows:
A. Shop Drawing Review: In order to become familiar with the requirements of the
project, Morrison- Maierle will review shop drawings provided by the City of
Kalispell as well as the related project specifications.
B. Applications for Payment: Based on Morrison-Maierle's observations of the
construction, review Applications for Payment prepared by MDT and provide a
recommendation regarding payments to the Contractor.
C. Interpretations and Change Orders: Prepare written responses to Requests for
Information for interpretations of the plans and specifications. The work will also
consist of the preparation of change orders or work change directives, including
required documentation in accordance with MDT procedures.
D. Periodic Site Visits by Engineer: Morrison-Maierle's designated project manager
or assistant project manager will make weekly site visits to observe the
construction progress and quality of work or to discuss other issues.
E. Substantial Completion Inspection and Punch List: With the City of Kalispell,
MDT, and the Contractor perform a substantial completion inspection of the site
and develop a punch list of items that must be completed before final payment.
F. Final Completion Inspection: With the City of Kalispell, MDT, and the Contractor
perform a final completion inspection of the site.
G. Geotechnical Testing: Contract the services of NTL Engineering and
Geosceince, Inc -to perform utility trench backfill compaction density testing and
material quality control.
Task 3: Construction Observation
Task 3 consists of providing on -site resident project representatives (RPR) to observe
the progress and quality of the various aspects of Contractor's work. Specifically, the
RPR will perform the following services:
A. Unless otherwise notified in writing by the City of Kalispell, Morrison-Maierle
would provide the services of an RPR at the Site to provide continuous
observation of Contractor's work on a full-time basis.
B. Review the progress schedule, schedule of Shop Drawing submittals, and
schedule of values prepared by Contractor and consult with the City and MDT
concerning acceptability.
C. Attend meetings with Contractor, such as progress meetings, job conferences
and other project -related meetings, and prepare and circulate copies of minutes
thereof-
D. Serve as the City's liaison with Contractor; working principally through
Contractor's superintendent and assist in understanding the intent of the Contract
Documents. As the City's representative, the RPR will make field decisions as
necessary to complete the project to City and State standards where these
decisions do not increase cost and/or reduce functionality. Where field decisions
may result in an increase in cost and/or reduce functionality, the RPR will
coordinate with City staff and maintain a full record of these decisions.
E. Assist the City in serving as their liaison with adjacent property owners when
Contractor's operations affect the business' operations.
F. Assist in obtaining from OWNER additional details or information, when required
for proper execution of the Work.
K
G. Consider and evaluate Contractor's suggestions for modifications in Drawings or
Specifications and report with recommendations to the City.
H. Conduct on -Site observations of Contractor's work in progress to assist the City
in determining if the Work is in general proceeding in accordance with the
Contract Documents. Report to the City whenever the RPR believes that any
part of Contractor's work in progress will not produce a completed Project that
conforms generally to the Contract Documents or will prejudice the integrity of
the design concept of the completed Project as a functioning whole as indicated
in the Contract Documents, or has been damaged, or does not meet the
requirements of any inspection, test or approval required to be made; and advise
the City of that part of Contractor's work in progress that RPR believes should be
corrected or rejected or should be uncovered for observation, or requires special
testing, inspection or approval.
Verify that tests, Cemetery Road Lift Station equipment and systems startups are
conducted in the presence of appropriate personnel, and that Contractor
maintains adequate records thereof.
Accompany visiting inspectors representing public or other agencies having
jurisdiction over the Project, record the results of these inspections and report to
the City.
K. Maintain at the Site orderly files for correspondence, reports of job conferences,
reproductions of original Contract Documents including all Change Orders, Field
Orders, ,Work Change , Directives, Addenda, additional Drawings issued
subsequent to the execution of the Contract, clarifications and interpretations of
the Contract Documents, progress reports, Shop Drawing and Sample submittals
received from and delivered to Contractor, and other Project related documents.
Prepare a daily report or keep a diary or log book, recording Contractor's hours
on the job Site, weather conditions, data relative to questions of Change Orders,
Field Orders, Work Change Directives, or changed conditions, Site visitors, daily
activities, decisions, observations in general, and specific observations in more
detail as in the case of observing test procedures; and send copies to the City.
L. Maintain a record of changes that resulted in a deviation from the approved
contract documents in order to reflect the as -built conditions.
Task 4: Cemetery Road Lift Station Commissioning:
Task 4 will include services related to the commissioning of the Cemetery Road Lift
Station including lift station testing, electrical service and standby power load testing,
and ensuring that the proper operation and maintenance manuals and other related
items have been properly assembled and submitted to the City.
