BACKGROUND: This is a five lot commercial subdivision on approximately 4.61 acres
located on the east side of North Meridian Road north of Three Mile Drive. The property
is zoned B-2, General Business, and is undeveloped with the exception of a billboard
located on the northeast corner of the site facing Hwy 93. The property is bordered on
the west by North Meridian Road and on the east by Hwy 93 where no access could be
granted because of the steep slopes associated with the property.
A new internal access road would be developed that would serve all five lots within the
subdivision. The access road would be developed to City standards and once
completed, be accepted and maintained by the City. Generally, the new access will
align with an existing driveway to the west that accesses a mobile home park. It is the
intent of the developer to construct some retail, office and possibly a church on the site.
The B-2 zone allows for a wide variety of uses.
This preliminary plat is a minor subdivision because it contains five or few lots and does
not go before the planning board for public hearing, but directly to the Kalispell City
Council for review. The staff is recommending approval of the subdivision subject to the
conditions outlined in the attached staff report KSR-04-3
RECOMMENDATION: Approval of the resolution approving the preliminary plat
for the subdivision subject to conditions would be in order.

HALL ADDITION #82 LOCATED IN SECTION 6, TOWNSHIP 28 NORTH, RANGE 21
WEST, P.M.M., FLATHEAD COUNTY, MONTANA.
WHEREAS, Ronald Barnes, the owner of certain real property described above, has petitioned for
approval of the Subdivision Plat of said property, and
WHEREAS, the proposed subdivision plat of said property is subject to the provisions of Section
2.05 (Preliminary Plat Process -Minor Subdivision), Subdivision Regulations of the
City of Kalispell, and
WHEREAS, the Tri-City Planning Office has reviewed the proposed subdivision and made a
report (#KSR-04-3) to the City Council of the City of Kalispell, said report
considering the criteria set forth in Section 76-3-608 MCA, and
WHEREAS, the City Council of the City of Kalispell at its regular Council Meeting of July 6,
2004, reviewed the Tri-City Planning Office Report #KSR-04-3, and found from the
Preliminary Plat, and evidence, that the subdivision is in the public interest.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL, MONTANA AS FOLLOWS:
SECTION L That the Findings of Fact contained in Tri-City Planning Office Report
#KSR-04-3 are hereby adopted as the Findings of Fact of the City Council.
SECTION IL That the application of Ronald Barnes for approval of the Preliminary Plat of
Westview Business Center, Kalispell, Flathead County, Montana is hereby
approved subject to the following conditions:
1. That the final plat for the subdivision shall be in substantial compliance with the approved
preliminary plat. (Kalispell Subdivision Regulations, Appendix C — Final Plat)
2. That the plans and specifications for all public infrastructure be designed and installed in
accordance with the Kalispell Design and Construction Standards and a letter shall be obtained
stating that they have been reviewed and approved by the Kalispell Public Works Department.
(Kalispell Subdivision Regulations, Chapter 3, Design Standards, Section 3.01).
3. The following requirements shall be met per the Kalispell Fire Department and a letter be
obtained from the department stating that the following requirements have been met (Kalispell
Subdivision Regulations, Section 3.20).
a. Water mains designed to provide minimum fire flows shall be installed per City
specifications at approved locations. Minimum fire flows shall be in accordance with
Uniform Fire Code (1997) Appendix III -A.
b. Fire hydrants shall be provided per City specifications at locations approved by this
department, prior to combustible construction.
c. Fire Department access shall be provided in accordance with Uniform Fire Code (1997)
Article 9.
4. That a letter be obtained from the Kalispell Parks and Recreation Department stating that a
landscape plan has been reviewed and approved for the placement of trees and landscaping
materials within the five foot landscape boulevard developed between the curb and the
sidewalk. (Kalispell Subdivision Regulations, Section 3.11).
The private road within the subdivision shall be named and signed in accordance with the
policies of the Kalispell Public Works Department and the Uniform Traffic Control Devices
Manual and be subject to review and approval of the Kalispell Fire Department. (Kalispell
Subdivision Regulations, Section 3.09).
6. The developer shall provide a letter from the U.S. Postal Service approving the plan for mail
service. (Kalispell Subdivision Regulations, Section 3.22).
Street lighting shall be located within the subdivision and shall be shielded so that it does not
intrude unnecessarily onto adjoining properties. (Kalispell Subdivision Regulations Section
3.09(L)).
8. All utilities shall be installed underground. (Kalispell Subdivision Regulations, Section 3.17).
9. That a minimum of two-thirds of the necessary infrastructure for this subdivision shall be
completed prior to final plat submittal.
10. All areas disturbed during development of the subdivision shall be re -vegetated with a weed -
free mix immediately after development.
11. That preliminary plat approval shall be valid for a period of three years from the date of city
council approval. (Kalispell Subdivision Regulations, Section 2.04).
SECTION I1I. The classification of said premises under the Kalispell Zoning Ordinance
shall not be changed by the action.
SECTION IV. Upon proper review and filing of the Final Plat of said subdivision in the
office of the Flathead County Clerk and Recorder, said premises shall be a
subdivision of the City of Kalispell.

A report to the Kalispell City Council regarding a request for a preliminary plat
approval for five lot commercial subdivision.
BACKGROUND INFORMATION: This is a request for a five lot commercial
subdivision located on the east side of North Meridian Road north of Three Mile Drive
on approximately 4.6 acres zoned B-2, General Business.

B. Nature of the Request: This is a request for a five lot commercial subdivision
that would be served by a new internal roadway that will provide access to all five
lots. The property is zoned B-2, General Business, and located on the east side
of North Meridian Road and north of Three Mile Drive. It contains approximately
4.610 acres and is currently undeveloped. The property is bordered on the east
by Hwy 93 which is constrained by steep slopes and the only access to the site
would be a single access from North Meridian Road.
C. Location of Property: The site is located on the east side of North Meridian
Road north of Three Mile Drive. The property can be described as Lot 5, Hall
Addition #82 in Section 6, Township 28 North, Range 21 West, P.M., M., Flathead
County, Montana.

COMMENTS FROM THE SITE DEVELOPMENT REVIEW COMMITTEE
This matter came before the Site Development Review Committee on June 24, 2004.
There were no serious concerns about the development of this site and the new
internal roadway that would be accepted by the City upon completion which would be
reviewed and approved by the Kalispell Public Works Department for compliance with
the Kalispell Standards for Design and Construction. A new hydrant would be located
within the site and fire access can be adequately provided.
REVIEW AND FINDINGS OF FACT
This application is reviewed as a minor subdivision in accordance with statutory
criteria and the Kalispell City Subdivision Regulations.
A. Effects on Health and Safety:
Fire: This subdivision is in the service area of the Kalispell Fire Department.
The property can be considered to be at low risk of fire because the subdivision
and homes within the subdivision would be constructed in accordance with the
Uniform Fire Code and have access which meets Citv standards. The area
where the new buildings will be constructed will not have steep slopes or
woody fuels. Water mains will be required to be designed to provide minimum
fire flows and shall be installed per City specifications at approved locations.

locations approved by the fire department, prior to combustible construction.
Fire department access will be required to be provided in accordance with
Uniform Fire Code (1997) Article 9.
Flooding: The property is not in an area that is prone to flooding due either to
nearby surface water or because of saturated soils or high groundwater.
Access: Access to the lots will be provided from a new internal access road that
will be constructed to City standards. A new approach will be developed along
North Meridian Road for the new internal access road. No other approaches
will be used or created to serve the lots. It appears that the new approach will
generally align with the approach to the west that enters a mobile home park.
The new approach off of North Meridian Road will need to be reviewed and
approved by the Kalispell Public Works Department in conjunction with their
review of the plans and specifications for water, sewer, road and stormwater
management. It does not appear there would be any health or safety issues
associated with the subdivision and the way is has been proposed. Pedestrian
access has been included as part of the Meridian Road design and once
constructed will provide pedestrian safety in the immediate area.
B. Effects on Wildlife and Wildlife Habitat: This property does not provide any
important habitat to wildlife because of its highly developed urban location and
will not impact wildlife in the area.
C. Effects on the Natural Environment:
Surface and groundwater: Public water and sewer will serve this subdivision
thereby minimizing any potential impacts to the groundwater. There is no
surface water in the immediate area which has the potential to be impacted by
this subdivision.
Drainage: There are some topographical constrains associated with this
property to the east with the steepest part of the slope however lying within the
Hwy 93 right-of-way. All stormwater will need to be retained on site in
accordance with a stormwater management plan developed in accordance with
a plan approved by the Kalispell Public Works Department that has been
designed by a professional engineer.
D. Effects on Local Services:
Water: Water service to the subdivision would be provided by the City of
Kalispell and extended from a water main that lies to the west of this
subdivision along North Meridian Road right-of-way. The water main will be
extended into the site within the new right-of-way and will likely require a
hydrant somewhere near its terminus. The Kalispell Public Works Department
installed a new water main along Meridian Road and to the west in order to
increase the water pressure in the area. It is likely that the required fire flows
can be obtained and meet the requirements of the Uniform Fire Code. The
water system will be completed prior to final plat submittal. The water system
for the subdivision will be reviewed and approved by the Kalispell Public Works
Department and the Kalispell Fire Department as part of the development of
the subdivision. There is adequate capacity within the City's water system to
accommodate this development.
Sewer: Sewer service will be provided by the City of Kalispell with an extension
of existing sewer mains from their existing location to the west within the right-
of-way of North Meridian Road. Design and construction of the mains will be
reviewed and approved by the Kalispell Public Works Department. There is
adequate capacity within the sewage treatment plan to accommodate this
development.
Roads: Traffic projections for this subdivision are dependent on the types of
businesses that will occupy the property which could be retail, office, church or
other type of use allowed in the B-2 zoning district. It can be anticipated that
there will be some moderate impacts to North Meridian Road, however, this is a
highly traveled road and the increase in traffic to the road and its ability to
function will be generally insignificant.
Schools: This development is within the boundaries of the Kalispell School
District #5. This subdivision will not impact the school district since it is
commercial in nature and the developers do not intend to develop the site
residentially.
Parks and Open Space: The state and local subdivision regulations exempt
minor subdivisions and commercial subdivisions from parkland dedication.
Open space will be provided in the form of setbacks around the buildings. No
other open space is required in association with this subdivision.
Police: This subdivision is in the jurisdiction of the City of Kalispell Police
Department. The department can adequately provide service to this
subdivision, however the cumulative impacts of growth further strains the
department's ability to continue to provide the high level of service the
department is committed to.
Fire Protection: Fire protection services will be provided by the Kalispell Fire
Department, and the subdivision will need to meet the requirements of the
Uniform Fire Code. Fire risk is low because of good access and fairly level
terrain, the fire department is recommending that access to the subdivision
and the hydrants are in place prior to final plat approval and / or use of
combustible materials in construction.
Solid Waste: Solid waste will be handled by the City of Kalispell and taken to
the Flathead County Landfill. There is sufficient capacity within the landfill to
accommodate this additional solid waste generated from this subdivision.
Medical Services: Ambulance service is available from the fire department and
ALERT helicopter service. Kalispell Regional Hospital is close, less than one
mile from the site.
E. Effects on Agriculture and agricultural water user facilities: The site has
not been traditionally used for agricultural purposes and is well suited for
urban residential development. Its location within the urban core area and its
proximity to urban services makes this property prime for the type of
development being proposed. There will be no impact on agricultural uses
within the Valley and no impact on agricultural water user facilities since this
property will be served by a public water system.
F. Relation to the Kalispell Growth Policy: This property is in the Kalispell
Growth Policy's potential utility service area and is anticipated for this type of
urban scale development at the time of connection to City utilities. The future
land use map for the area indicates this area is anticipated to be developed as
Mixed Use in the area proposed for development. The property was previously
zoned B-2, General Business, which is in general compliance with the growth
policy and consistent with other uses in the area.
G. Compliance with Zoning. This property was rezoned from residential to
commercial several years ago and is currently zoned B-2, General Business.
The development standards for the B-2 zoning district area is a minimum lot
size requirement of 7,000 square feet and a minimum lot width of 70 feet. The
lots within the subdivision exceed the minimum requirements of the zoning
and will be required to be developed in accordance with the standards for the
B-2 zoning district. The project complies with the zoning for the site.
Compliance with the Kalispell Subdivision Regulations: This subdivision
does not deviate from the Kalispell Subdivision Regulations and no variances
are being sought.
RECOMMENDATION
Staff recommends that the Kalispell City Council adopt staff report ;#KSR-04-3 as
findings of fact and approve the preliminary plat subject to the following conditions:
1. That the final plat for the subdivision shall be in substantial compliance with the
approved preliminary plat. (Kalispell Subdivision Regulations, Appendix C — Final
