SUBJECT Public Hearing on the Preliminary Plat Approval of the Amended
Plat of Gateway West Addn. #34.
MEETING DATE: December 6, 2004
BACKGROUND: The Kalispell City Planning Board held a public hearing at their
regular meeting of January 15, 2002 regarding this request for preliminary plat
approval of an eight lot commercial subdivision on approximately 11.31 acres located
south of Two Mile Drive and west of the Gateway West Mall.
This subdivision has languished for nearly three years because, in part, of the
developer's interest in partnering with the City of Kalispell in the reconstruction of
Financial Drive to City standards. The upgrade of Finance Drive is a significant off -
site improvement related to the subdivision. The developers requested a variance to
the City standards as part of their initial subdivision application. The planning board
recommended denial of the variance, but prior to this matter coming before the city
council the developer requested council action be postponed.
At the November 15, 2004 work session following the regular city council meeting,
Susan Moyer with the Community Development Department presented a proposal to
the council to assist in the reconstruction of Financial Drive to City standards. Since
this property is in the West Side Urban Renewal District and the upgrade of the
roadway would benefit the overall development of the commercial properties in the
immediate area, the staff recommended supporting this project.
The zoning for this property is B-3, a Community Business District. This district has
a 7,000 square feet minimum lot size requirement and the minimum lot width is 70
feet_ All of the lots within the proposed subdivision exceed the minimum lot size
requirement of the district
The property is currently undeveloped with the exception of an existing office building
known as the Crop -Hail Building located on proposed Lot 8 which contains 2.85
acres. The property would be subdivided to create seven additional lots that will be
accessed by a new internal roadway. Subdivision access will be from an existing
roadway off of Two Mile Drive, Financial Drive. Currently this functions as a private
driveway which serves this property and the Gateway West Mall.

Because of the length of time between the planning board consideration and city
council action for this subdivision, the city attorney has recommended that the city
council hold a public hearing regarding this proposal rather than taking the
subdivision before the planning board again. Although this is a bit irregular, it is the
intent to satisfy the public notice requirement while allowing a pragmatic approach to
further review and consideration of the proposed subdivision and associated
improvements.
The developer has provided an updated list of adjoining land owners which will be
used to notice the public hearing before the council which has been scheduled for
December 20, 2004. At the December 20, 2004 regular meeting, the city council Will
be asked to consider any additional public testimony, the planning board
recommendation regarding the preliminary plat approval, the staff report and the
upgrade of Financial Drive to City standards.
RECOMMENDATION: A motion to adopt the resolution of intention to hold a public
hearing on the proposed preliminary plat.

A RESOLUTION OF INTENTION TO CONSIDER THE PRELIMINARY PLAT FOR LOT
OF THE AMENDED PLAT OF PART OF THE GATEWAY WEST MALL ADDITION
NO. 34 AND DIRECTING THE CITY CLERK TO PROVIDE NOTICE OF THIS
RESOLUTION AS PROVIDED BY LAW, AND SETTING A PUBLIC HEARING.
WHEREAS, Cascade Partnership, the owner of the certain real property described above, has
petitioned for approval of the Subdivision Plat of said property, and
WHEREAS, the Kalispell City Planning Board held a public hearing on January 15, 2002, on the
proposal and reviewed Subdivision Report #KPP-01-3 issued by the Tri-City
Planning Office, and
WHEREAS, the Kalispell City Planning Board has recommended approval of the Preliminary Plat
of Lot 1 of the Amended Plat of Part of the Gateway West Mall Addition No. 34,
subject to certain conditions and recommendations, and
WHEREAS, the City Council of the City of Kalispell postponed action on the preliminary plat at
the request of the developer until this time, and
WHEREAS, the Developer now desires to have the City Council of the City of Kalispell consider
whether to approve, disapprove or conditionally approve the proposed preliminary
plat, and
WHEREAS, the length of time between the Kalispell City Planning Board public hearing and
consideration and possible action by the City Council of the City of Kalispell has
been substantial, and
WHEREAS, the Developer and the City Council of the City of Kalispell are in agreement to now
consider the preliminary plat proposal, and
WHEREAS, in order to satisfy the public interest and to allow public participation and comment,
the City Council of the City of Kalispell shall, on the 20th day of December, 2004, at
7.00 pm in the Council Chambers in City Hall, hold a Public Hearing, pursuant to
MCA 7-1-4127 to hear all persons and things relative to the proposed preliminary
plat.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL, AS FOLLOWS:
SECTION I. That it is the intention of the City of Kalispell that they will consider
the preliminary plat known as Lot I of the Amended Plat of Part of
the Gateway West Mall Addition No. 34.
SECTION IL The City Clerk shall forthwith prepare and publish in the Daily Inter
Labe, a daily newspaper published at Kalispell, Montana, proper
notice of this Resolution of Intention which shall be published twice,
with at least 6 days separating each publication.
SECTION III. During the period between the first publication of said notice by the
City Clerk and the public hearing, the City Clerk will receive
expressions in writing of the approval or disapproval of the proposed
preliminary plat.
SECTION IV. At the regularly scheduled meeting of the City Council of the City of
Kalispell, the City Cleric shall forward all written communication
received by said Clerk for Council's consideration.
SECTION V. The City Council, after considering all written communication as well
as oral testimony, may adopt a resolution approving, disapproving, or
conditionally approving said preliminary plat.
PASSED AND APPROVED BY THE CITY COUNCIL AND SIGNED BY THE MAYOR OF THE
CITY OF KALISPELL, THIS 6TH DAY OF DECEMBER, 2004.
