Kukulski, City Manager SUBJECT Conditional Use Permit for Glacier Village Greens Homeowners Association Community Center MEETING DATE: April 5, 2004 BACKGROUND: This is a request by the Glacier Village Greens Homeowners Association for a conditional use permit to allow the construction of a community center for use of the residents of the subdivision. This property is in an area zoned R-4, Two Family Residential, which lists community centers as a conditionally permitted use. The building footprint would be approximately 64 by 36 feet or 2,300 square feet in size and would be single story. The community center would be used for a variety of activities including exercise and crafts classes, birthday and wedding parties, bingo as well as other meeting type uses. It is intended that the use of this facility would be for residents and their guests and would not be rented or used by the general public. Hours of operation would vary depending on the activity or event, but generally it would be anticipated that the hours of operation would be between 8:00 AM and 10:00 PM, but not necessarily on a daily basis. The building is being proposed in an area of the subdivision that has been traditionally used as a park area. There is playground equipment and a grassy area that would be retained with the equipment being moved to another location to accommodate the building. This property, Lot 167, adjoins to homes to the north and an undeveloped park area to the south. The area to the north would be landscaped between the property boundaries to mitigate impacts. Impacts should generally be minimal with some occasional additional traffic and parking which might take place during special events. A 24 foot wide paved private access road will be developed to the community center along with a paved parking area. Some identification signage The Kalispell Planning Board held a public hearing on March 9, 2004 and several people from the neighborhood and Glacier Village Greens community spoke. There were some questions regarding parking, traffic, landscaping and hours of operation which were answered by the homeowners association representative. The board discussed the proposal and potential issues. A motion to forward a recommendation for approval of the conditional use permit by the Kalispell City Council was passed unanimously by the board subject to the recommended condition. It may be noteworthy that neither the staff nor the planning board have recommended that sidewalks be installed along the frontage of this lot and this was not an issue that was presented as a concern by the residents of Glacier Village Greens. It may be an issue that council wants to discuss at the meeting. The property is located on the west side of West Nicklaus Avenue and contains approximately 1.78 acres. Narda Wilson, with the Tri-City Planning Office presented staff report KCU-04-1 and evaluated the proposal. She explained that this property is zoned R-4, Two -Family Residential which lists community centers as a conditionally permitted use and recommended approval subject to conditions. During the public hearing the applicant's representative and two persons spoke in favor, and two persons expressed concerns regarding traffic, parking, runoff and hours of operation. After the public hearing, the board discussed the proposal. A motion was passed unanimously to forward a recommendation to the city council that the conditional use permit be granted subject to the conditions outlined on attached Exhibit A. The intent of this application, to be reviewed by the Kalispell Planning Beard and the Kalispell City Council, is allow the HOA to build and operate a Community Center on Lot 167 within the Glacier Village Greens community. This proposal for a Community Center will be a wonderful addition to the Glacier Village Greens (GVG) community. As future phases of GVG are built out, there will be approximately 1000 residents within this subdivision. I've attached a site map showing the location of Lot 167 in relation to the overall Glacier Village Greens development, as well as a site map showing the existing structures and then the proposed building, with the existing outdoor restroom facility and the proposed road layout. A-D). To address traffic flow and control, please see the attached site map. Ten parking spaces are required by the Kalispell Zoning ordinance for a Community Center of this size. There are additional spaces provided. The roadway to the Center will be paved to a 24' width. Traffic will enter and exit via this private roadway from Vilest Nicklaus Avenue. All parking and loading will be off-street. Refuse and service areas are located at the north side of the building. E-F), This building will be served by Evergreen Sewer and Water as is the entire Glacier Village Green development. This lot is largely bordered by HGA°s vacant parkland. There are two residential lots that back up to Lot 167, and could potentially be impacted by the Community Center. The HGA proposes a landscape bufferto help mitigate the impacts that may occur from traffic and activity. The site has been used for recreational purposes in the past. There is playground equipment on the property and this will be retained, although it will be moved to accommodate the building. G-0. Signage will be minimal (directional or address) and comply with zoning regulations. Please refer to the architectural rendering attached for elevations of the proposed structure. This will be a relatively small structure with a single story and an average roof pitch. The open spaces are noted on the site layout and will still be available for recreational purposes. J-K). The Fours of operation will be variable. it is conceivable that there will be activities, i.e.; special events (parties. weddings, baby showers, family reunions, subdivision picnics, etc.,) can the weekends. There will be everting meetings and classes, BINGO, lectures, and other activities. City Engineer Roger Krauss, Police Chief Jim Stewart, Fire Marshal Narda Wilson, City Planner Craig Kerzman, Building Official Jim Atkinson, Agency on Aging Jeff Clawson, Plans Examiner Steve Herzog, DOT OLD BUSINESS: 1069 North Meridian — Michael Blend; addition/conversion of a garage to office — Jeff Clawson indicated that additional engineering is needed for the building permit. Plans with landscaping and drainage were shown to Andrew Sorensen. The project was approved subject to the following conditions: Subject to coordinating the landscaping with the Parks Department. Walgrens — Walgrens submitted and updated its project layout to comply with our dimensions, shifting the building and adding a landscape buffer. Steve Herzog said their access onto Highway 93 can only be "right in, right out" Since there is a lot of stacking on First Ave West at Highway 2, Narda Wilson suggested that both entrances on First Ave W be reduced to 30' in width with the north entrance reduced by 10' on the north side and the south entrance reduced by 10' on the south. Steve Herzog said reducing the 30' width would reduce the access to two lanes which is safer. After looking at the traffic patterns within the site, it was recommended that the 30' drive by the drive -through window be necked down to 24, one-way to avoid drivers disrupting the circulation of traffic on the site, and driving through to access the main roads. To accomplish this, Walgrens can either move the building over or widen the landscape area next to the drive through. PJ said that Walgrens made architectural changes to the building and sign to improve the building. There was some concern that the placement of the trash compactors might impede traffic and create a problem for the Fire Department, Jim Stewart will coordinate with Walgrens. Walgrens was given conditional approval on their project with the following conditions: 1. Narrow the accesses on First Ave W to 30' and coordinate this revision with the Department of Transportation and the City of Kalispell, Public Works. 2. The Highway 93 access is to be "right in, right out". 3. Neck down the drive -through area to 24'. 4. Submit a revised site plan. 5. Make sure the compactors meet Fire code. Coordinate this with Jim Stewart, Fire Marshal. 6. Submit drainage information to Andrew Sorensen, Public Works. 7. Coordinate the landscaping with the Parks Department. Planning Board Items: Northlands PUD Highland Development - The road access to this development was discussed by Narda Wilson.. The developer will be required to connect to roads in Empire Estates. There will be two additional road accesses onto Northridge and Foxhill. There is a consideration to build a road half way between Three and Four Mile Drive. The Department of Transportation has two plans to access Stillwater with an overpass over the Highway 93 Bypass or with a "right in, right out access only onto the Bypass. Narda Wilson suggested that a temporary road to Stillwater be built before the Bypass is built in order to accommodate the traffic flow. The condition of approval would be based on coordinating this road with the DOT in Helena, and a traffic analysis by the County, City and State. Steve Herzog said the new Bypass will probably not be built for 7 years — 10 years. The first phase of this project involves 83 single family lots. At full build out it will encompass approximately 300 lots. Jim Stewart wants the roads opened up and connected in order to facilitate Fire Department access. In addition, there is a land locked property which must be provided with access. Glacier Village Greens — Glacier Village Greens wants to build a clubhouse by the pond off West Nicklaus and needs a conditional use permit. The building is approximately 2000 square feet on 4 — 5 acres. Andrew Sorensen thought the amount of impervious surface for the parking, approximately 6000 square feet, did not pose a drainage problem. Evergreen will provide water and sewer will be provide by the Village Sewer, until otherwise notified. A conditional use permit will be granted with the following condition: the facility will be for members only and cannot be rented to the public at - large. Annexation — A lot on the west side of 7tn Ave West to be annexed. The development will have access off 7tn Ave W. The lot will be divided into four lots under a subdivision they will pursue later. PJ was concerned that a 60' right-of-way might be required. Narda did not see this as a problem. 2 NEW BUSINESS 160 Keliy Road — Some of the development of this site was done when it was a part of the County, and there are inherent problems with the site such as drainage and Fire Department access. Jinn Atkinson of the AOA is concerned about parking and his agency is looking to rent additional land in order to control parking. Jim Stewart said that additional hydrants are proposed for Kelly Road at this site but an additional building, set back off of Kelly Road, might present a need for additional hydrants. It was agreed that the plans submitted for an additional building on the site where inadequate. The owner must submit new plans to scale showing the site, existing buildings, proposed buildings, green areas, utilities and hydrants. OTHER DISCUSSION: Corner Lots: PJ suggested that developers should be encouraged to increase the size of their corner lots so that the size of houses built on these lots will be more in keeping with the size of houses in the rest of the development. Fair rounds: Andrew Sorensen said that the bids that came in on the new fairground building were well over the $800,000 they had estimated for the construction costs.
